How AI Is Testing the ‘Bounds of the First Amendment’
Artificial intelligence technology is making its way into more areas of daily life. But there are still many unknowns about AI, including major legal questions about the ways the technology should be governed, and which AI-generated speech is, or is not, protected under the First Amendment. Generative AI, in its most basic form, is “trained on vast amounts of data,” according to Ryan Bangert, senior vice president of strategic initiatives at Alliance Defending Freedom. “It ingests petabytes of information in order to learn how human language works, in order to understand how it is that human syntax grammar is structured, and then it predicts what comes next.” Generative AI is “not a mind, it's not a consciousness, it's not a human being,” Bangert says. “It's a piece of software, a very complex piece of software, that's fulfilling an algorithmic function.” Therefore, he adds, generative AI is “not a First Amendment rights-bearing entity.” In their new paper, “The Ghost in the Machine: How Generative AI Will Test the Bounds of the First Amendment,” Bangert and Jeremy Tedesco, senior vice president of corporate engagement at Alliance Defending Freedom, parse the relationship between AI and the First Amendment. Indiana’s Aggressive Divestment From China
State leaders in Indiana have taken significant steps to divest from China and from the environmental, social, and governance agenda. “We have the good fortune in Indiana to have a Legislature that is on top of making sure that we divest from Chinese entities and from ESG-focused funds,” Indiana state Comptroller Elise Nieshalla says. The ESG agenda has benefited China through its promotion of solar and wind energy, and electric vehicle batteries, all which China mass produces. While some state asset managers are promoting investment in solar panels and EV batteries for electric vehicles in the name of “clean energy,” Nieshalla contends the methods China is using to produce those goods are far from clean. “I think we have seen a true hypocrisy,” she says, “because while … the whole ESG movement has been putting intense pressure on the United States toward renewable energy and to move away from reliable energy—i.e., coal, oil and gas—they are making significant investments in fossil fuels in China, India, Brazil, and [those nations] do not implement the clean energy technology that we do with fossil fuels.” The energy agenda moving away from coal, oil, and gas is not only benefiting China, but also harming the U.S. economy at a time when the U.S. is burdened with a national debt of more than $35 trillion. French Teacher Fired for Rejecting Personal Pronouns Wins Lawsuit Almost 6 Years Later
French teacher Peter Vlaming was fired in 2018 for shunning the use of pronouns to refer to a transgender-identifying student. On Sept. 30, the West Point School Board in Virginia agreed to pay him $575,000 in damages and attorneys’ fees. "I'm so relieved that our basic fundamental rights of freedom of expression, of freedom of religion have been formally upheld," Vlaming told The Daily Signal. The School Board cleared Vlaming’s termination from his record and changed its policies to conform to the new Virginia education policies established by Gov. Glenn Youngkin, R-Va. Vlaming is a Christian, so he believes God created male and female. Still, the teacher was willing to respect the rights of his students to disagree. When one of his female students started identifying as male, Vlaming avoided referring to her with pronouns, instead using her preferred name. On Halloween of 2018, his students participated in a virtual reality tour of French catacombs, during which the transgender-identifying student almost ran into a wall. "Don't let her hit the wall!" Vlaming called out instinctively. The student called her parents, who complained to the school. Vlaming was placed on administrative leave and given an ultimatum that he would be fired if he didn't use preferred personal pronouns. Vlaming refused to comply and was fired. Nearly six years later, Vlaming, represented by the religious liberty nonprofit law firm Alliance Defending Freedom, won his case. "Stand your ground with love," Vlaming advises other teachers. Sticking With Trump: CEO’s Sign Makes a Big Statement in Small-Town America
Anthony Constantino grew up in Amsterdam, New York, at a time when the city was bustling with activity. In the years that followed, however, many of the manufacturing jobs disappeared, leaving its factories empty and its residents without work. Rather than flee upstate New York, Constantino instead co-founded Sticker Mule in 2010. The company makes products ranging from magnets and stickers (hence the name) to buttons and T-shirts. Today, it employs about 1,000 people in the Amsterdam area. And until recently, Sticker Mule was known for its products—not its politics. That changed on the day former President Donald Trump survived an assassin’s bullet. Fed up with the hatred toward Trump, Constantino posted on Sticker Mule’s X account an appeal to “help end the hate.” In that post on the night of July 13, he also declared his support for Trump. "I've been seeing the hate directed at President Trump and his supporters for the last eight years. And I don't like it,” Constantino told The Daily Signal in an interview Friday. “When a bullet hit President Trump, I spoke up, and I've been doing everything I can to try to stop the hate.” Since that fateful night in July, Constantino hasn’t slowed down. This week, he unveiled a massive 100-foot-wide sign atop his Amsterdam factory along the Mohawk River. He spoke with The Daily Signal about the sign—and the controversy that ensued—for a special episode of our podcast. Illuminated in white and red letters, the “Vote for Trump” sign nearly landed Constantino in jail for allegedly violating zoning rules and distracting drivers. “As soon as the local Democrat mayor heard about the excitement and the enthusiasm for the sign, he got a restraining order issued against me, blocking me from displaying the sign under threat of jail time,” Constantino explained. “My lawyer said, Anthony, if you show that sign, you're going to end up in jail. I thought they were joking; they were serious.” A judge’s last-minute order spared him. Monday’s celebration proceeded as planned with thousands of onlookers. Constantino’s new political action committee—Sticker PAC—produced a video casting the controversy as a “fight for free speech.” Even if Constantino’s advocacy for Trump displeases some of Sticker Mule’s customers, the CEO isn’t planning to stay silent when it comes to politics. “I'm very proud of my organization for the way they've handled all this and they've endured all this. They stayed focused on doing exciting things for our customers, exciting things for the business,” he said. “Everyone stuck by my side. We haven't lost a single employee." Constantino told The Daily Signal that he remains motivated to stop the political division in America and bring the country together. He believes Trump is the leader who can do it. Andrew Lewis on Pennsylvania's Potential: 'We Should Be Leading'
Andrew Lewis, a former Pennsylvania state representative, is the new president at the Commonwealth Foundation, the state's premier public policy organization. He stepped into the job in September, just as America turned its attention to the Keystone State, which will play a decisive role in the 2024 election. In an interview with The Daily Signal, Lewis pinpointed the key issues facing Pennsylvania voters, starting with the higher prices they're paying for gas, groceries, and housing. "The big issue on everybody's mind is inflation and the cost of living," Lewis said. "Over the last few years, voters and citizens have been given what's tantamount to a 20% tax hike ... and not being able to afford what they used to be able to afford just a few years ago." As a near-lifelong Pennsylvanian, Lewis shared his aspirations for the state, faulting poor leadership as an impediment hampering the Keystone State. He cited Pennsylvania's strategic location and natural resources as key advantages, but blamed high taxes and regulations as reasons why its residents are fleeing for other states. "We're the Keystone State. We're the epicenter of the East Coast. We've got great competitive advantages here," Lewis explained. "We should be leading economically, we should be adding to our population base. We've got so much potential, but unfortunately, a lot of leftist policies have held the state back for years." Lewis plans to use his experience in the state legislature to guide the Commonwealth Foundation's efforts and help Pennsylvania achieve its true potential. He cited the energy sector as crucial to Pennsylvania's economy, warning that restrictive government policies could undermine its competitive advantage. "If you were to rank Pennsylvania as its own nation, you would see we're in the top of exporters globally," Lewis said. "We have this massive opportunity." Education reform is another priority for Lewis. As a lawmaker, he championed parental rights and the need for school choice. "Parents know best what their kids need for their educational journey," he said. "And it's not always the government school." The Lifeline Scholarship Program, which would provide educational opportunities for students in underperforming schools, was a step away from becoming law until Democrat Gov. Josh Shapiro issued a line-item veto in 2023. Shapiro, who touted his support for the idea during his 2022 campaign for governor, flip-flopped when faced with pressure from teachers unions. Looking ahead to the future, Lewis outlined his vision for the Commonwealth Foundation, promising to maximize the organization's impact through policy development, government affairs, and storytelling. From Football Field to Supreme Court: Movie Tells True Story of Coach Joe Kennedy
A lot of things in Coach Joe Kennedy’s life have been unexpected—not the least of them being taking a major case to the Supreme Court or having a movie made about his life. Kennedy's decision to take a knee in prayer after football games placed him in the middle of a national controversy, and thrust him into a spotlight he never asked for or wanted, since, as he acknowledges, he sees himself as a pretty “average Joe.” The film “Average Joe” hits theaters Thursday and aims to go beyond what Americans know about the coach from news headlines to share his personal life story, says director Harold Cronk. Kennedy was thrust off the football field and into the courtroom nearly a decade ago after he was told he could not take a knee in silent prayer on the 50-yard-line after football games. His decision to persist in his commitment to the Lord cost him his job at Bremerton High School in Bremerton, Washington, about 30 miles west of Seattle. In 2022, after a seven-year legal fight, Kennedy won his case before the Supreme Court. In early September 2023, he returned to the football field and again took a knee in prayer at the end of the game. Later that same month, he made the choice to “retire,” telling The Daily Signal at the time that he and his wife “finished the fight.” “You know, we were in the race to finish the fight, and we’ve remained faithful, and that’s it,” he said. What Life Is Like in North Carolina After Hurricane Helene
LLife is on pause in Hendersonville, North Carolina. Hurricane Helene devastated the city, located about 25 miles south of Asheville. Most people have not returned to work, and in some instances, there is no workplace to return to, because floodwaters swept entire buildings from their foundations. Hendersonville resident Alexander Potter told The Daily Signal neighbors have been the first line of defense in his community as people swung into action to ensure the elderly were taken care of and no one went hungry. Alexander anticipates the initial cleanup will take months. After spending several days on the ground talking with locals like Alexander and seeing the devastation firsthand, The Daily Signal’s Tim Kennedy says it will likely take years for the community to rebuild. Wearing high heels or flats to work is a small thing most women don’t give too much thought to, but when seconds matter while running to a bomb shelter, a simple decision over footwear becomes critical. Most women in Israel don’t wear heels because, when the sirens sound, Israelis have only about 30 seconds to make it to a bomb shelter, Yael Eckstein, president of the International Fellowship of Christians and Jews, explains. “Just the other day, four days ago, we woke up at 5 a.m. to a siren sounding,” said Eckstein, who lives in Israel with her husband and four children. “We had 90 seconds to wake up our four kids and get them to our shelter in time. Thank God we have a shelter in our home, but even 90 seconds to wake up the kids, get them down to the shelter, we didn’t have time to bring our puppy, and so my kids were crying that the puppy was outside, and I had to make the decision of keeping my kids safe or going out and getting the puppy and risking our lives.” For people living in Israel, these are “everyday situations,” she says. Series Pt. 3: Want to Pay in Cryptocurrency? In Louisiana, Now You Can.
In a move toward modern financial practices, Louisiana residents can now pay for state services using cryptocurrency. “Louisiana has always, I think, lagged behind other states when it comes to doing things that are in modern commerce,” Louisiana state Treasurer John Fleming says, adding that he hopes to change that. Cryptocurrency is “going to have a huge role” in the future of finance, Fleming says. Sometimes referred to as digital currency, cryptocurrency does not require a bank account. Louisiana is now accepting bitcoin, bitcoin lightning, and USD coin payments. The first cryptocurrency payment was made to the Louisiana Department of Wildlife and Fisheries on Sept. 17. The digital currency payments are converted into dollars following the transaction, Fleming explains. Why Faith-Based Groups Are Better at Solving Social Challenges Than Government
Americans have a responsibility to be civically engaged in their communities and when it comes to solving social challenges, faith-based communities have the best track record, according to Stacy Blakeley, the CEO of The Policy Circle. During a study examining the foster care and refugee crises today, The Policy Circle, a nonprofit dedicated to encouraging civic engagement, discovered that “faith-based groups [be they Christian, Jewish, or other] had a remarkable ability to solve for the social challenges in our communities,” Blakeley tells "The Daily Signal Podcast." Adam Crum: US Energy Costs Would ‘Go Down Substantially’ If Alaska’s Resources Were Fully Tapped
Energy costs across the U.S. “would probably go down substantially” if the U.S. sharply increased mining and production of Alaska’s natural resources, according to Adam Crum, commissioner for the Alaska Department of Revenue. Geographically, Alaska is by far the largest U.S. state at more than 663,000 square miles. It is also among the most natural resource-dense states in the nation. Alaska became a state in 1959, and under its Statehood Act, it is “mandated that the mineral resources and the subsurface rights were collectivized by the state so that the state could actually collect the royalties and production taxes off of that to fund the government,” Crum explains on “The Daily Signal Podcast.” While other states, such as Texas and North Dakota, can have “individual farmers who actually have mineral rights, nobody has that in Alaska,” he said, explaining that his state was “set up to be a resource-development state since inception.” One of the world’s largest zinc and lead mines can be found in northwest Alaska and has now “been producing for over 40 years and has provided very extensive jobs,” according to Crum. The mine has allowed the local indigenous population in northern Alaska to “not only have an economy to stay there, but you have this town now, it's about 4,000, 5,000 people of primarily Inupiat Eskimos living up there. They get to benefit from this, and they can still get to live a subsistence lifestyle,” Crum explains. Asked about the environmental effects of mining and drilling in Alaska, the revenue commissioner said life expectancy has increased in native communities where natural resources are being extracted as industry has strengthened local economies and increased the quality of life. Gov. Dunleavy: Russian and Chinese Military Activity Near Alaska Is ‘Becoming More Frequent'
The U.S. military is responding after Russia and China increased their military activity near Alaska. The U.S. military deployed 130 Army airborne soldiers with mobile rocket launchers earlier this month to the Aleutian Islands of western Alaska. The action comes after Russia and China conducted joint military exercises close to Alaska. “There's been naval exercises, there has been joint flyovers … not necessarily our airspace, but identification airspace, which is between the Russian airspace and our airspace,” Alaska Gov. Mike Dunleavy said, adding that the military activity near Alaska is “becoming more frequent.” Earlier this month, Russia and China carried out a week of joint naval exercises in the Sea of Japan. On Monday, the U.S. Naval Institute reported that the U.S. "detected Russian aircraft operating in the Alaska air-defense identification zone.” “I think these are, you know, chess cases and probes,” Dunleavy said of Russia and China’s actions. “But because of the instability in the world, and to some degree, I think some of these countries are questioning America's resolve, [so] you may be seeing more of these activities in the future.” Mainland Russia is only 55 miles from Alaska, making America’s northernmost state key to national security, especially as Russia is actively building its Arctic military capabilities. Held Hostage in Syria, He Says ‘Everything’ Was Taken From Him But His Faith
Syria was one of the last countries left on Sam Goodwin’s list. He was young and on a mission to join a small group of people alive today who have visited every country in the world. By 2019, Goodwin had already traveled to 180 countries, including those with hostile regimes in Iran, North Korea, and Venezuela. “I had always traveled, because it was fun and I enjoyed it, but most importantly, I learned from it,” Goodwin says. “Travel was always the best education I'd ever had.” With fewer than 20 U.N.-recognized sovereign states left to visit at the time, Goodwin—then 30—arrived in Syria on May 25, 2019. He had been in the country only for a couple hours when, while walking to meet his guide, “this black pickup truck abruptly pulled up next to me, two armed men jumped out of the back seat, and instructed me to get inside,” he said in an interview on “The Daily Signal Podcast.” Goodwin would spend the next 27 days in solitary confinement in a prison cell with no windows. “Everything had been taken from me, my material possessions, my communication, my freedom,” he said. “But no matter what, I knew that my faith was absolute, and I would have been in a completely different situation without it. News Flash: Bias In Media Is Not New, Seasoned Journalist Says
John Miller entered the field of journalism in Washington D.C. in the early 1990s. There were only a handful of outlets staffing conservative commentary writers at the time, and, even then, Miller says he remembers being frustrated by the liberal bias in the media. “This notion that, you know, a generation ago we used to have objective reporters at The New York Times is nonsense,” Miller, executive director of The College Fix, says. “I mean, they were doing the same thing back then, also pretending they were something they were not. They were putting their finger on the scale constantly when they were covering elections, and candidates, and debates, and Congress, and so forth.” Today, Miller argues that conservative have “a louder voice today than they've ever had before in the media.” But the challenge now, according to Miller, “is populating this media with good writers, with good talkers, people who can make podcasts and so on. And lots of folks are doing it, obviously, but we need more people coming in and more talented people coming in.” In addition to leading The College Fix, Miller also serves as director of the journalism program at Hillsdale College, where he daily takes part in training young conservative journalists. He is a board member of The Daily Signal.
