In this episode, I talk about human nature, influence ops, conspiracy slop, and the calculated turn against President Trump by what I call Team Centipede.This isn’t a document-heavy episode. Instead, I walk you through media, posts, events, associations, and observations. I highlight some things I’ve gotten right, some things I’ve gotten wrong, and admit to being fooled myself.It’s not a particularly positive or negative episode—just a candid one. Lawful shoot. No crime was committed by the officers. I don’t have any criticism of the officers involved. Pretti is physically resisting law enforcement the entire time. From the very first moments of the altercation, from before he is OC sprayed, he is disobeying and obstructing law enforcement. He goes hands-on with them. Gets sprayed multiple times, goes non-compliant. An officer begins to take him into custody. Pretti resists. Curls into a ball, tucks his arms and legs under him. More officers work to get Pretty spread out so they can cuff him and take him into custody. Over a half dozen officers end up involved; at least three are working to gain control of Pretti while a fourth disarms him and a sixth observes. As he is disarmed and an officer is shouting, “Gun! Gun!” and agents are reacting to that, drawing their weapons or taking a step back to draw, Pretti is still fighting to stand up and does begin to stand up. He goes from knees and elbows on the ground and tucked (resisting pose) to trying to stand up. He gets his right foot under him, planted on the ground, and he still has his phone in his right hand (which not every agent knows is a phone). This is when he is shot. It’s tragic, but justified. However, there’s enough grayness/ambiguity about it that it’s exploitable. It’s the sort of incident that these Antifa/BLM/counterinsurgency cells work to manifest into existence because through them they can gain a martyr, public attention, civil friction, fracturing of political opposition, narrative programming material, and capitulation from authorities. 01:27:00 This was NOT Alex Pretti’s first altercation with federal law enforcement.01:32:00 Context: Protests, fraud scandal, activation of insurgent groups, local and state law enforcement not working with federal law enforcement, Democrat leadership not cooperating, threats against law enforcement up 8000%, etc01:35:00 Ret. In this episode I take you through the most recent happenings and filings in the civil suit Daniel Richman brought against DOJ (Richman v. United States).The episode is long but not at all short on interesting developments and disclosures.The Richman case, which at first presented as a fairly straightforward return of seized property case, has turned out to be far more peculiar. The extent of what most people know about it is the surface-level take of “Grrr, bad judge protects Comey by stopping Trump DOJ from getting Richman’s communications.” Or something along those lines.It’s more significant and layered than that.DOJ has been ordered to return Richman’s property, the materials seized in 2017, 2019, and 2020 as part of the Comey Memo and Arctic Haze investigations, back to him. Yes.However, they have ALSO been ordered to create a single forensic copy of those materials and file it under seal in the District Court of EDVA. This ensures that the materials can be accessed, searched, developed, or whatever DOJ wants to do with them AS LONG AS they get a judicial search warrant to do so.It’s an equitable solution to the situation.But there’s more.Turns out, there are several copies of these materials, more than DOJ originally was aware of. And they are not segregated nor filtered for privilege. And they may contain classified information.This has major implications for the case against James Comey (if that can be revived on appeal) but also for any future re-indictment of him (which can’t happen without materials from Richman, if it can happen at all).If DOJ wants to bring the same case back from the dead or bring another case charging Comey with the same offenses and based on information from these materials, they need LAWFUL access to them.And they need to do so within the next few months. In this episode, I briefly discuss former Special Counsel Jack Smith sitting for a closed-door hearing before the House Judiciary Committee and then dive into the case of Richman v. United States.It’s a very interesting civil case that’s like a follow-up to the dismissed criminal case against Comey, Richman of course being Person 3 from the indictment against Comey. Richman is trying to get a judge to order DOJ to give him back the materials seized from him pursuant to four Arctic Haze search warrants. Or, destroy what they took. Since that material was central to the case against Comey, DOJ losing access to it would kill any effort to reindict Comey on the same charges.The Richman case is interesting enough in that way, but there’s a bit more going on here, and I think the case could cement DOJ’s access to the materials rather than permanently remove it. In this episode, the Trump Administration has designated Cartel de los Soles (Cartel of the Sun) as a Foreign Terrorist Organization, but some folks say the group doesn’t even exist.In other news, a new report reveals that Andrew and Tristan Tate’s electronic devices were seized earlier this year when they visited the U.S. Their attorney says the devices were never returned. This confirms the long-rumored investigation(s) of the two brothers by U.S. authorities was active earlier this year and that the investigation was being run out of DHS’s HSI unit. A unit that specifically hunts human traffickers.Finally, I have a ‘for your consideration’ segment regarding Comey’s handwritten note that was filed as an exhibit a couple weeks ago in United States v. Comey. The vast majority of people have taken it as evidence, confirmation even, that Comey lied in a September 30, 2020 hearing. In this episode, we go over the criminal case against multiple Antifa-affiliated defendants who recently received either a plea deal OR a superseding indictment, which added new charges—including rioting, attempted murder, and terrorism. Then we turn to the criminal case against Comey and the numerous significant issues that are elucidated in a new ORDER and MEMORANDUM from Magistrate Judge Fitzpatrick. Though U.S. Attorney Halligan was able to get a STAY on that order, the case appears to be in dire straits, as missteps, misconduct, violations of the defendants’ rights, and improper procedures before the grand jury by Halligan and others involved in the investigation have surfaced. Perhaps there are reasonable explanations for all those issues. We may get those explanations before the end of this week. In this episode, I bring you up to speed on the latest filings in United States v. Comey, particularly regarding the grand jury proceedings that generated the indictment and the issue of Lindsey Halligan’s appointment as Interim U.S. Attorney for the Eastern District of Virginia. One judge is examining whether or not privileged material was shared with the grand jury, and another judge is considering the lawfulness of Halligan’s appointment. Both issues have the potential to sink the case. In support of their case and the appointment, DOJ has filed new affidavits from two FBI agents and one each from Attorney Halligan and AG Bondi, plus a timeline of the grand jury proceedings. Next, I walk you through a newly disclosed 2017 email chain about a potential investigation into the Hillary Clinton campaign’s payment for the Steele Dossier. An FBI agent sought to open the probe and requested advice on proceeding from a key figure in the DOJ’s Public Corruption Unit and a chief legal official in the U.S. Attorney’s Office for the District of Columbia. Both advised against pursuing it. The email chain was provided to Senator Grassley by FBI Director Patel and Attorney General Bondi after Grassley was tipped off by a whistleblower.Finally, in the show’s final hour, I present a “for your consideration”-style segment. I take you back to 2016 and revisit the early months of Crossfire Hurricane and Russiagate, framing the saga in a fresh—or perhaps evolved—light. While many individual elements have been discussed on the podcast before, I assemble them with a new narrative that I hope elucidates the story of the scandal in a new way. In this episode, we unpack some significant and possibly highly consequential filings in United States v. Comey. There are notable additions to Comey’s defense, motions regarding the implementation of a filter team protocol, and two hard-hitting motions to dismiss. I do my best to go over all of the key points of these developments in the first 30-45 minutes of the show, then spend the rest of the episode going over them in greater detail. I cross-reference the motions against IG reports, media leak memos, Senate transcripts, and other filings in the case. It’s something approximating a line-by-line autopsy of the case. My big takeaway from it all, at this time anyway, is that the case against Comey seems fatally flawed both in the facts at issue and in its origin. I think it will be dismissed, and it’s possible that Halligan will be disqualified from her office, similar to how Alina Habba was. I also think that it may be meant to fail. Because it isn’t about “getting Comey.” I suspect the aim here is to toss a bone to the Complainicans, one, and two, more importantly, to get at some evidence currently shielded by attorney-client privilege and some evidence currently behind classification. The indictment is a vessel for bringing about legal processes to pierce the attorney-client privilege that covers one set of evidence and to declassify another set. A legal crowbar.That’s my working theory at this time. Half past clever? Maybe. In this episode, voting machine company Smartmatic has been added as a defendant in a criminal case related to the 2016 Philippine elections. It is alleged that Smartmatic and the already indicted executives of the company bribed a Philippine election official, also indicted, to award over $180 million in contracts to the company for voting machines. Also, there’s a new criminal case against Antifa affiliates in Texas for the July attack on officers at an ICE detention facility. It’s a first of its kind case, which charges the individuals for material support of terrorists, in this instance-Antifa. Plus, I have a humorous story about classified documents in a print queue possibly leading to the arrest of a State Department official engaged in espionage on behalf of the People’s Republic of China. In this episode, I go over the OIG Report on Andrew McCabe and relevant text messages between Lisa Page and Peter Strzok in light of the recent indictment against former FBI Director James Comey.Since we can reasonably assume that PERSON 1 in the indictment is Hillary Clinton, it’s possible that PERSON 3 is either Andrew McCabe or Lisa Page. Other candidates are Daniel Richman, James Baker, and James Rybicki, but for this episode we are going to consider the indictment from the angle that it’s McCabe or Page. The OIG Report on McCabe shows that he lied about Comey’s approval of leaks to the media and that he lied to Comey, to INSD agents, and to OIG investigators about his use of Lisa Page as an anonymous source for the Wall Street Journal’s Devlin Barret. It wasn’t until he realized Horowitz had the Page-Strzok text messages that he began to tell some of the truth. If this indictment against Comey is based on lies told by McCabe, then who do you believe? McCabe or Comey? It is raining declassified documents in D.C., and in this episode we rifle through a couple sets of them: the HPSCI whistleblower memos and documents concerning a hidden Durham investigation about 8 other investigations into leaks of classified information to U.S. media. Plus, we investigate a newly declassified email that connects back to a CIA report Director Ratcliffe released at the end of June of this year. In this episode, declassified FBI memos reveal that beginning in 2017, an HPSCI staffer and career intelligence officer alerted the FBI and DOJ OIG to one or more schemes directed by then-Rep. Adam Schiff to leak classified information to media in order to smear, “indict,” and “topple” the Trump Administration. This whistleblower met with authorities at least five times between 2017 and 2023, but charges were not brought against Schiff or anyone else involved in the scheme. Might that be about to change? The statute of limitations has run out on the singular act of leaking in 2017, but since this involved several (eight or more) people engaging in a coordinated effort, it could be seen by an intrepid prosecutor as, perhaps, a grand conspiracy to weaponize intelligence and law enforcement institutions against a President and his administration. The statute of limitations on something like this has barely begun to tick. Also, the judge overseeing the Maxwell case has denied DOJ’s bid to unseal the grand jury material. This, of course, has made people on both extremes of the political spectrum very upset. But should they be? No, and even if the judge were able to grant the request, which by law he cannot, would we learn anything new? No, we wouldn’t, and revealing that may be the entire point of the unsealing effort. And I ask, did AG Bondi just appoint a special counsel? Because this news makes a lot more sense if she did!We also dig into the Durham Report and Classified Appendix again, as I reframe several events from 2016 within the context of the Clinton Plan. Did Trump collude with Russia? No. Did Hillary collude with Russia? Possibly.
