The Alex Pretti Shooting
In this video, I do my best to provide an overview, a frame-by-frame breakdown, context, and an analysis of the Alex Pretti shooting based on the information that is available as of January 27, 2026. Lawful shoot. No crime was committed by the officers. I don’t have any criticism of the officers involved. Pretti is physically resisting law enforcement the entire time. From the very first moments of the altercation, from before he is OC sprayed, he is disobeying and obstructing law enforcement. He goes hands-on with them. Gets sprayed multiple times, goes non-compliant. An officer begins to take him into custody. Pretti resists. Curls into a ball, tucks his arms and legs under him. More officers work to get Pretty spread out so they can cuff him and take him into custody. Over a half dozen officers end up involved; at least three are working to gain control of Pretti while a fourth disarms him and a sixth observes. As he is disarmed and an officer is shouting, “Gun! Gun!” and agents are reacting to that, drawing their weapons or taking a step back to draw, Pretti is still fighting to stand up and does begin to stand up. He goes from knees and elbows on the ground and tucked (resisting pose) to trying to stand up. He gets his right foot under him, planted on the ground, and he still has his phone in his right hand (which not every agent knows is a phone). This is when he is shot. It’s tragic, but justified. However, there’s enough grayness/ambiguity about it that it’s exploitable. In this episode I take you through the most recent happenings and filings in the civil suit Daniel Richman brought against DOJ (Richman v. United States).The episode is long but not at all short on interesting developments and disclosures.The Richman case, which at first presented as a fairly straightforward return of seized property case, has turned out to be far more peculiar. The extent of what most people know about it is the surface-level take of “Grrr, bad judge protects Comey by stopping Trump DOJ from getting Richman’s communications.” Or something along those lines.It’s more significant and layered than that.DOJ has been ordered to return Richman’s property, the materials seized in 2017, 2019, and 2020 as part of the Comey Memo and Arctic Haze investigations, back to him. Yes.However, they have ALSO been ordered to create a single forensic copy of those materials and file it under seal in the District Court of EDVA. This ensures that the materials can be accessed, searched, developed, or whatever DOJ wants to do with them AS LONG AS they get a judicial search warrant to do so.It’s an equitable solution to the situation.But there’s more.Turns out, there are several copies of these materials, more than DOJ originally was aware of. And they are not segregated nor filtered for privilege. And they may contain classified information.This has major implications for the case against James Comey (if that can be revived on appeal) but also for any future re-indictment of him (which can’t happen without materials from Richman, if it can happen at all).If DOJ wants to bring the same case back from the dead or bring another case charging Comey with the same offenses and based on information from these materials, they need LAWFUL access to them.And they need to do so within the next few months. In this episode, I briefly discuss former Special Counsel Jack Smith sitting for a closed-door hearing before the House Judiciary Committee and then dive into the case of Richman v. United States.It’s a very interesting civil case that’s like a follow-up to the dismissed criminal case against Comey, Richman of course being Person 3 from the indictment against Comey. Richman is trying to get a judge to order DOJ to give him back the materials seized from him pursuant to four Arctic Haze search warrants. Or, destroy what they took. Since that material was central to the case against Comey, DOJ losing access to it would kill any effort to reindict Comey on the same charges.The Richman case is interesting enough in that way, but there’s a bit more going on here, and I think the case could cement DOJ’s access to the materials rather than permanently remove it.
