On this week's episode, Host Susan Guthrie is joined by top family law attorney, Holly Davis, to discuss the fascinating celebrity divorce of Ben and Julianna Zobrist, which has been playing out for months in the media with allegations of fraud. Susan and Holly unpack the claims and bring a dose of reality into the conversation to help you to understand the role of fraud in divorce. Top family law attorney, Holly Davis discussed the facts of the case and what the legal effect of Ben's position is when it comes to a final judgment from the court. It is not unusual for a disgruntled spouse to cast aspersions on their ex, but is it just legal positioning or will it actually affect the outcome and sway the judge in court? Find out in this fascinating episode! Some of the topics we discuss: Judges are supposed to be neutral, but will facts like this tend to push them to one party's side? How can an allegation of fraud play out in a divorce case? Does it become a separate case, or do the two legal cases become combined? How would a finding of fraud manifest in a final divorce decree? Ep 203Everything You Need to Know to Get a Restraining Order with Attorney Uswah Khan on Divorce & Beyond #203
October is Domestic Violence Awareness Month and this week host Susan Guthrie speaks with Attorney Uswah Khan who has helped scores of victims of abuse obtain restraining orders in order protect themselves, and their children, from suffering further at the hands of their abusers. On average, nearly 20 people per minute are physically abused by an intimate partner in the United States. During one year, this equates to more than 10 million women and men. Restraining orders offer one of the few tools that a victim has to try to protect themselves from ongoing abuse but getting a restraining order can be scary, confusing and complicated. To make matters worse, many victims cannot afford to retain an attorney to help them navigate the court process making it even more difficult to apply for relief. Attorney Uswah Khan has spent the past few years representing and assisting victims of domestic violence as the staff attorney at The Center for Family Justice in Connecticut. In this episode, Uswah demystifies the process of obtaining a restraining order and walks you through the steps so that you are empowered to get the protection that you, and your children, need. This episode truly will save lives! If you or someone you know is a victim of domestic or intimate partner violence please contact The National Domestic Violence Hotline at 1-800-799-SAFE (7233) or Text "START" to 88788 For more information on the Family Justice Center Alliance, which develops and supports Family Justice Centers that help survivors and their children find the services they need in ONE place visit: https://www.familyjusticecenter.org About this week's special guest: Attorney Uswah Khan has been practicing family law in the State of CT for over 18 years. Most recently, she served as staff attorney at a Family Justice Center assisting victims of domestic violence. Erin Levine, Founder and CEO of legal tech phenom, HelloDivorce is here to give you the FYI on DIY Divorce! Ep 92The Forgotten Victims of Gray Divorce: The Effects on Adult Children with Therapists and Authors, Carol Hughes and Bruce Fredenburg #188
In this episode, Susan Guthrie speaks with Therapists, Carol Hughes and Bruce Fredenburg, authors of "Home Will Never Be the Same Again: A Guide for Adult Children of Gray Divorce," about the effects of parental divorce on adult children, and how the negative repurcussions can be minimized. It is no secret that gray divorce is on the rise world-wide. In fact, divorce among those who have been married for 30 years or more or who are divorcing later in life, is one of the largest segments of those who are divorcing today. Much has been written about the unique difficulties faced by those who divorce close to or during retirement and after long-term marriages, but there is a forgotten segment of people who are deeply impacted by the divorce - the adult children whose parents are going through a gray divorce. Carol Hughes and Bruce Fredenburg, both family therapists, collaborative professionals and mediators, have done a deep dive into this topic with years of personal experience with patients and families as well as a great deal of research which they have distilled into a ground-breaking new book, "Home Will Never Be the Same Again: A Guide for Adult Children of Gray Divorce." It is easy to believe that children who are adults, perhaps with families of their own, will have little to no impact when their parents divorce but the reverse is actually true. Carol and Bruce provide guidance for parents, children and even therapists in their book and this episode provides insights and tips into this growing paradigm! Ep 88The Solution for Tackling the Divorce Detour with Storey Jones, Creator of dtour.life on The Divorce & Beyond Podcast with Susan Guthrie, Esq. #184
In this episode, Susan Guthrie speaks with Storey Jones, Founder of dtour.life, an innovative and easy to use platform that helps you tame the chaos and overwhelm of the life detour called divorce! Storey Jones went through her own 7-year divorce ordeal several years ago and she came out of it with one certainty and that was that "no one should have to go through what she went through in her divorce!" Storey has spent the years in between examining the obstacles that she faced and focused on creating a technology solution to address each one and so, dtour.life was born. In this episode, Storey walks us through those divorce obstacles and how you can tackle them! To Receive the Special Offer on a dtour.life subscription for listeners, sign up for your membership here: dtour.life and use code "SUSAN20" for 20% OFF! More information about this week's Special Guest, Storey Jones: Been there. Done that. Survived and thrived. In 1998 Storey Jones married a technology entrepreneur. By 2001 his company had executed a successful IPO and then an accounting scandal brought everything crashing down leaving her in a highly complex seven-year legal quagmire that included every unimaginable financial and emotional challenge including a protracted high-conflict divorce and custody battle. Though she lost everything including her home, possessions, savings & retirement, she gained a purpose. She recognized the glaring chasm between the human experience of divorce and the legal system; she developed a new business model as a divorce consultant to assist men and women in becoming far more informed, prepared and supported as they navigate their own unique processes. She also worked closely with divorce legal teams to help their clients be better prepared participants in their own divorce. After well over a decade as a divorce consultant in the San Francisco Bay area, Storey has now leveraged that experience to build the first holistic end-to-end platform for divorce to bring innovation and technology to an outdated system. She is determined to change the experience by providing education and smart efficiency with expansive day-to-day tools that are designed so both clients and professionals can seamlessly work on and understand the same financial and other case-related data. dtour.life is designed from the ground up to fundamentally redefine this life transition for both spouses and professionals. Prior to founding Lemon Tree Advisors and dtour.life, Storey was president of Addis, a bay area brand strategy and design firm where for 13 years she was integral to its growth and vision. Storey has a B.A. from Colgate University. Ep 72Why 50/50 Parenting Really Means Equally Shared Responsibility with the Founder of Wealthy Single Mommy, Emma Johnson on The Divorce & Beyond Podcast with Susan Guthrie, Esq. #168
In this episode, Susan Guthrie speaks with Author, Speaker and Activist, Emma Johnson, the Founder of Wealthy Single Mommy, about the highly charged topic of fully equal shared parenting and why it needs to become the norm in families. There are few topics that raise more emotion among parents than the issue of shared parenting time or 50/50 parenting. When parents separate, they must work out a plan that involves their children being raised in two households and often they find they have very different ideas of what is best for their kids. Enter Emma Johnson, Founder of Wealthy Single Mommy and Moms for Shared Parenting, who is a leading activist in the equal parenting movement who is here to challenge the long-held societal norms that we hold so close. The belief that children are best served when they are mostly with their mother and less with their father is still deeply embedded in many parents hearts and minds as they negotiate their parenting time. Emma recently conducted a Single Mom and Income Survey which mined data from thousands of single mothers and other sources which shows that, among other key take-aways, kids do best when they are with their parents equally and the only way to close the gender pay gap is to have equally shared parenting responsiblity between the genders. This is a fascinating discussion of so many key points that counter the societal norms of parenting, equality and gender roles. This episode is a must listen for everyone, not just parents going through divorce, and Emma Johnson is the voice of change that we all need to hear! More information about this week's Special Guest: Emma Johnson is a journalist, activist, and the creator of WealthySingleMommy.com, the largest single mom community in the world. A divorced mother of two who was herself raised by a single mother, Emma is the author of The Kickass Single Mom (Penguin), which was named by the New York Post as a “Smart, Must-Read.” Emma has been quoted on single motherhood and gender equality in The New York Times, The Wall Street Journal, NPR, The Doctors and hundreds of other outlets. Emma launched the activist group Moms for Shared Parenting as a call for policy and cultural change to focus on the benefits for children, women, men, feminism and our society when parents share equally in raising children. She has spoken about single motherhood and gender equality at the United Nations and Google. Ep 68It's Never Too Early to Start Healing with Karen Millon on The Divorce & Beyond Podcast with Susan Guthrie Esq. #164
In this episode, Susan Guthrie speaks with podcast host, coach and author, Karen Millon, about the universal human experience of trauma, both large and small, and the need to heal so we can live our best lives. "Trauma is one of the biggest equalizers" says Karen Millon, this week's guest on the podcast. Everyone, no matter how blessed they are, suffers from traumas in life. There are small "t" traumas and Large "T" traumas, but they all add up and they all require healing in order for us to lead happy and healthy lives. It probably comes as no surprise that divorce qualifies as a Large "T" trauma and couple that with the other traumas encountered in any well-lived life, it becomes imperative to find help to heal. That's where Karen steps in as an expert in the variety of healing modalities available to us. As a Healing Coach she can help you on your healing journey and where additional expert help is needed, Karen can help match you with the right modality and provider. In this episode Karen walks you through: How much of our trauma starts in childhood, no matter how "perfect" that childhood was. The reality of trauma responses and how they manifest in our lives. What the first key step is in healing. Different healing therapies such as EMDR, somatic experiencing and more. Why you have to go back to a trauma to break free from it. How her journey to healing, and that of her first husband, helped them to have "An Amazing Divorce" which led to her new book. It truly is never to early to start healing so tune in to this episode today and start your journey! ************************************************ More Information About This Week's Special Guest: Karen Millon is a Colombian-born and Canadian-raised entrepreneur and personal development advocate. Ms. Millon holds a degree in Business Administration from the University of Western Ontario. And while business is her professional venue, her passion is healing and wellness. Healing was the cornerstone of her Amazing Divorce, a book that she wrote and is coming out in the fall of 2020 so when Millon realized that the subject of healing in general wasn’t garnering as much national discussion as other, more niche forms of trauma and recovery, she funneled her business skills into a high-level media platform devoted to the subject of recovering from any and all forms of trauma. Her brand and her business operate as a liaison between healing and trauma experts and the uninitiated. Millon’s HEALIN podcast features weekly dialogues with professional therapists, nutritionists and other well-being professionals. Visit www.healin.net for more information on Karen Millon's Healin. Ep 65The End of Kim & Kanye? The Devastating Effect of Mental Health Issues on Relationships with Dr. Elizabeth Cohen on The Divorce & Beyond Podcast with Susan Guthrie Esq. #161
In this very special episode, Susan Guthrie visits again with Dr. Elizabeth Cohen, "The Divorce Doctor," to discuss many ways that mental health issues can negatively affect our relationships and how that plays out in divorce. For the past several months the tabloid covers at the grocery checkout have been filled with headlines predicting the imminent divorce of "Kimye" a/k/a Kim Kardashian West and Kanye West. These headlines follow on the heels of numerous stories and articles highlighting the many ups and downs of relationship that has seemed to be challenged in the face of Kanye West's struggles with bi-polar disorder. His many highs and lows have played out in the public eye and have highlighted the often swept under rug challenges couples face when one, or both, are dealing with mental health issues. Our favorite psychologist, Dr. Elizabeth Cohen returns with a compassionate but pragmatic discussion of the difficulties that people face when they or a loved one are challenged by mental health issues. In this episode Dr. Elizabeth shares: How additional stressors, such as divorce or relationship issues, can impact mental health. Why treatment is not a sign of weakness. What she means by "we need to honor hope." Why falling in love makes us so vulnerable. How to deal with a partner who may be suicidal. AND SO MUCH MORE! Statistics say that marriages where one of the partners is struggling with mental health issues are 2x more likely to end in divorce and when the mental health issue is a bi-polar dianosis, the couple is 95% more likely to divorce. This is an issue that will affect you or someone you love and it's time to shine a light on these mental health challenges so listen to this episode today! Dr. Elizabeth will be joining Susan again for more episodes soon so here is your opportunity to ask her anything!
