Watching hundreds of Israeli citizens being massacred, raped, and kidnapped by violent Hamas invaders has been utterly horrific.Sadly, these atrocities were made all the easier because Israel generally prohibits the private possession of arms for purposes of self-defense. There is no "Israeli version" of America's Second Amendment. How differently would the last days have been if the victims of Hamas had been armed only as well as a typical American home, where the AR-pattern rifle is perhaps the most commonly owned long gun in the country? So, yesterday I got a 4-page, single-spaced, physically mailed, paper hate letter from the head of the CO Public Defender's Training Director. Backstory: Earlier this year at their request I did a FREE (pro bono) legal consult/expert witness testimony for one of their indigent clients charged with MURDER & MANSLAUGHTER. Normally I charge a minimum of $10,000+ for this, did it forR FREE. Happy to in this particular case. My consult/testimony was pivotal in securing that client's ACQUITTAL on ALL charges. Jury confirmed my value when interviewed after verdict, defense counsel used MY slides in his closing argument, etc. PD office is happy with my work, they invite me to speak at their annual conference, which I do AGAIN FOR FREE, travel AT MY OWN EXPENSE, hundreds of dollars more. Fine, no worries. THEN THEY APPARENTLY LOOKED AT MY SOCIAL MEDIA, and realized that I "don't share their values on equity and inclusion." And they felt compelled to explain this to me in a SINGLE-SPACED, FOUR-PAGE PHYSICALLY MAILED letter I received today. Worst part: They WANT BACK the sexually ambiguous public defender's T-shirt they had given me in thanks for speaking at the conference. AND they've PROHIBITED me from wearing the T-shirt on my social media. Earlier this week I read the 71-page decision of Judge Roger Benitez, a Federal trial court judge, in holding (FOR THE SECOND TIME) that California's standard-capacity magazine violates the Second Amendment.Obviously, the gun controllers are losing their minds over this decision, and so it was well-anticipated that the California Attorney General, Bonta, would appeal the ruling to the 9th Circuit.Instead of following normal 9th Circuit procedure and have the matter proceed to a 3-judge appellate court, however--where the mag ban had PREVIOUSLY been found unconstitutional, only to be reversed by an en banc panel of the 9th--the 9th circuit has decided today (Sept. 28), to by-pass normal procedure and go straight to en banc.Reversing 2A-favorable trial court and 3-panel appellate court rulings is a favored practice of the 9th Circuit, and reliably results in pro-2A rulings being overturned, usually in decisions that can only be described as irrational word salad. Yesterday a judge dropped all charges, including murder, against former Philly police officer Mark Dial over the August 14 shooting death of non-compliant suspect Eddie Irizarry. The immediate result was rioting and widespread looting throughout Philadelphia. This past Sunday a 78-year-old Florida man, Edward Druzolowski, shot dead his neighbor, 42-year-old Brian Ford, during a confrontation over Ford cutting trees on the shooter's property. This morning, prestigious Law Professor Jonathan Turley published a post on his blog about this event. Although in my experience Professor Turley generally produces world-class legal content--as his academic and legal success attest--this particular post struck me as effectively muddying and conflating a number of distinct use-of-force law doctrines and cases. Earlier this year Federal law enforcement sought to execute a search warrant an a mother and her two adult sons for living unlawfully on Federal park land.Because one of the sons had previously made threatening statements, the arrest was made surreptitiously by plain-clothes officers pretending to need a jump-start for their truck.When one of the brothers, named Timber, prepared to help the as yet unidentified officers, they initiated his arrest. That brother then started screaming for help from his other brother, Brooks, who happened to move around in a wheelchair.Brooks rolled up in his wheelchair, saw his brother struggling with two men, and pointed a revolver at the two men. Unknown to Brooks he was more or less surrounded by other plain-clothes cops, who immediately began firing at him. Brooks would survive the shooting, but be paralyzed through his gunshot injuries. A Tennessee man working with his father suddenly sees his father's pickup truck being driven away by a thief. Father and son jump into the son's vehicle, and pursue the stolen pick-up, eventually catching up near some railroad tracks.The father and son approach the stolen truck, only to have the thief start waving a machete around. Earlier this year 18-year-old United Kingdom prankster @SecretMizzy (real name: Bacari O'Garro) and a couple of friends simply walked into the home of a family of strangers. The pranksters pretended they had come for a fictional study group, and made themselves comfortable on the sofa. On June 1, 2023 a masked 14-year-old Jor'Dell Richardson threatened a liquor store clerk with an apparent pistol, committing an armed robbery along with several other masked young black men. Police arrived as the 14-year and other robbers fled the store carrying armfuls of merchandise.Police chased and tackled Richardson to the ground, at which point they became aware of the apparent pistol in his waistband. During the struggle on the ground Richardson attempted to reach for the apparent pistol, at which point he was shot and killed by the arresting officers. It would later be discovered that Richardson's apparent pistol was, in fact, a BB gun. Last week the local prosecutor released his report on this Officer Involved Shooting, concluding that a prosecution of the officers involved with not be legally or ethically justified. On August 24, 2023, Ta'kiya Young decided to drive her car into an Ohio police officer. That officer fired a single round through her windshield, causing mortal injury. Unknown to the officer, Young was pregnant, and the baby was also lost.Police were stopping Young as she sat in her car in a shopping parking lot because she was suspected of stealing alcohol from a local store. Young was, of course, non-compliant with lawful orders, to the point of threatening a police officer with imminent deadly force.As it happens, Young was black, and the officers involved were white, so we have fertile ground for the racial polarization of this case. ​A homeowner in Wichita Falls TX awakens in the middle of the night to find an intruder breaking into his home. Lacking a firearm, the homeowner resorts to the weapons he does have at hand--and that happens to be a short spear! As it happens, the homeowner happens to be a member of the Society for Creative Anachronism (SCA), a group that role-plays old World combat wearing real armor and replica swords and spears. And he saw his opportunity, and took it, punching his short spear into the guts of the home intruder. A female security guard in a New Orleans library found herself the target of a man's ire. As the man ran from the library with the guard in pursuit, he purportedly threw both a rock and his cell phone at her, then continued fleeing. Her response? On October 21, 2021, actor #AlecBaldwin pointed what he knew to be a real gun at Ukrainian cinematographer Halyna Hutchins, while filming on the set of the movie "Rust" in New Mexico, without first ensuring that the real gun was not loaded, and shot and killed her. On these simple facts alone Alec Baldwin's conduct in the death of Halyna Hutchins qualifies as involuntary manslaughter under New Mexico law every day of the week and twice on Sunday. Although Baldwin was initially charged with manslaughter, that charge was dropped in April of this year, for reasons that can have nothing to do with legal merit. That said, the charges were dropped WITHOUT PREJUDICE, and prosecutors reserved the privilege to refile if new evidence consistent with guilt developed.Last week we learned that, indeed, new evidence of guilt has developed. A state report by a firearms examiner has concluded that the pistol in Alec Baldwin's hand that killed Hutchins could not have fired without the trigger being pulled--despite Baldwin's protestations that the gun did precisely that, discharging without him depressing the trigger. Does this mean that we can look forward to some genuine criminal justice in the criminal killing of Halyna Hutchins? The night of February 18, 2023 a Colorado Deputy pulled over 28-year-old Brent Thompson, and sought to arrest him for suspected driving under the influence, and other charges.Thompson fled from the Deputy on foot, towards Interstate 25. The Deputy pursued, shouting commands.As Thompson stepped onto I25 the Deputy effectively TASERd Thompson, who fell to the roadway. Moments later, Thompson was struck and killed by a passing vehicle.All of this was caught on the Deputy's body worn camera.Recently the local District Attorney announced that the Deputy involved would face no criminal charges over the arrest-associated death of Thompson. On August 9, 2023, a three-judge Federal Court of Appeals for the 5th Circuit reversed the conviction of Patrick Daniels, a habitual marijuana user who at trial had been found guilty of violating a federal statute making it a felony for unlawful users of drugs to be in possession of firearms.Daniels had been found with a pistol and rifle in his vehicle during a traffic stop. Following his conviction Daniels was sentenced to nearly four years in federal prison.This Court of Appeals found in this 3-0 decision that the relevant statute, §922(g)(3), as applied to Daniels, violated the Second Amendment of the US Constitution. This week saw the sentencing of former police officer Tou Thao over the in-custody death of #GeorgeFloyd on May 25, 2020.
