Byrna is a company that manufactures various OC products for purposes of less-lethal self-defense (Byrna.com).Though I'm generally a fan of OC as a less-lethal self-defense options, I've for years had serious concerns about the product design choices made by Bryna--specifically, their production of less-lethal OC devices that closely resemble actual firearms. Less than two weeks ago the Missouri Court of Appeals handed down a decision involving a self-defense case where the defender was accused of having been the initial aggressor in the confrontation--and because of that accusation the jury was given a very damaging "initial aggressor" jury instruction. During the early morning hours of Friday, June 23, three San Antonio Police Department officers responded to the apartment of 46-year-old Melissa Perez, who appeared to be experiencing a mental health crisis. Perez fled into her apartment, armed herself with a hammer, and as the three officers stood just outside her front door they shot and killed her. Yesterday, a New York City grand jury indicted Daniel Penny, who had been charged with second-degree (reckless) manslaughter in the choke-hold death of Jordan Neely on a NYC subway on May 1. Penny has claimed that he put Jordan in a restraining choke-hold position because Jordan had been making violent threats to the passengers on the subway car, and Penny was attempting to hold him for police. Penny is white and Neely was black. Also yesterday, Jordan Williams was arrested on a charge of manslaughter for stabbing to death Devictor Ouedraogo, also on a NYC subway car, purportedly in defense of Williams' girlfriend from Ouedraogo's threatening conduct towards her. Last Friday a black woman, Ajike Owens, was shot and killed by a white woman, Susan Lorincz, in Ocala FL, as Owens angrily approached Lorincz' front door over a years-long simmering acrimonious relationship. After several days of investigation Lorincz has been charged with manslaughter and other criminal offenses.I've not yet seen a sufficiently comprehensive set of facts that would allow a reasonable sense of whether this shooting was lawful self-defense or manslaughter.What I have seen, however, is the usual racial grievance industrial complex--led by the ubiquotous racial arsonist Attorney Benjamin Crump--spin up a comprehensive propaganda campaign about this unfortunate event. In today's show we cover the recent successful appeal of a Washington state woman who had overturned her conviction on a charge of first-degree (reckless, unintentional) manslaughter over the stabbing death of abusive boyfriend. The reason for the reversal of the conviction? The woman's trial attorney--and, apparently, the trial court itself--MISTAKENLY believed that self-defense was not a legal defense to the crime of reckless manslaughter.It is true that the legal defense of self-defense operates in a subtly different manner when raised against reckless manslaughter than when raised against an intentional killing, and we'll discuss just how that works.The real take home message, however, is that it is extremely dangerous to presume that even a well-experienced criminal defense attorney is really comprehensively informed on the actual law of self-defense--and if they get it wrong, it's YOU who goes to prison. In 2018 Officer William Darby, accompanied by two fellow officers, responded to the home of a suicidal Jeffrey Parker, who sat on his couch with a gun to his head. After Parker ignored repeated demands to put down his gun, Darby fired a single shotgun round into Parker, causing mortal injury. Darby would be charged with murder for this shooting. His pre-trial self-defense immunity plea was rejected by the trial judge, and he was convicted of murder at trial and sentenced to 25 years. This past March, however, Darby's conviction was overturned on grounds of improper jury instructions, and he was remanded for a re-trial. The gun control propagandists have launched a fresh wave of attacks on both gun ownership and self-defense, and of course the mainstream media is fully on board in driving forward this propaganda war on our civil rights.I've three examples of recent media reporting on the self-defense doctrine of "stand-your-ground." Today's show is prompted by a news report of an Ohio woman just sentenced to two years in prison for having sicced two of her Pitt Bulls on a group of children, resulting in one 6-year-old girl requiring multiple emergency surgeries as a result of bites to her head and body. As is common in high-profile, politically- and racially-charged shootings, I'm seeing an enormous amount of bad legal takes on whether the shooting of Ralph Yarl by Andrew Lester could possibly have been lawful.In fact, Missouri law explicitly allows for the use of deadly defensive force under the circumstances in which Lester encountered Yarl, and we'll explore that in today's show.One caveat--Yarl claims that the second time he was shot was while he was on the ground. I've seen no evidence to corroborate that claim, but there may well be forensic evidence decisive on that issue. If Yarl's claim is supported by the evidence, that second shot might be difficult to justify. Any shots fired while Yarl was upright and apparently attempting to unlawfully enter Lester's dwelling, however, were almost certainly lawful under Missouri law. Interested in learning why? In the late night hours of April 13, an 84-year-old homeowner living alone was awoken by someone banging on his front door. Lester prudently armed himself with a .32 caliber pistol, and opened his front door to respond to the person outside. Before him an unknown 6-foot-tall male, trespassing in violation of several no-trespassing signs, was attempting to force entry through his locked storm door--an apparent forcible home invasion. The homeowner shot at the attempted intruder twice, and the intruder fled. The homeowner then promptly called 911 to report the event.For this, the homeowner, Andrew Lester has been immediately targeted for racial arson by Benjamin Crump and others of his ilk, with a full-blown propaganda campaign raging across Twitter and news media demonizing Lester for having shot 16-year-old Ralph Yari simply for the "crime" of having rung Lester's doorbell. Within a day Lester was charged by Prosecutor Zachary Thompson with the life felony of first-degree assault, as well as 15-year felony armed criminal action. Notably, Prosecutor Thompson informed the public that "It's been my goal from the very beginning to get justice for the child involved in the case." Two days ago the defense team for Daniel Perry, found guilty this past Friday for the murder of Garrett Foster, filed a motion for a new trial. Yesterday we covered the interesting appellate reversal of the murder conviction of a woman who claimed self-defense in the shooting death of her boyfriend. She shot him dead under circumstances in which he wasn't in the moment presenting an immediate threat to her. Generally this would mean she killed in the absence of an imminent threat, which should result in the rejection of her self-defense justification. Indeed, the jury did exactly that, and convicted her of murder as charged. On March 5, 2020 Stephanie Clark, mother of a 5-year-old, found herself once again subject to violent domestic abuse by her live-in boyfriend. After inflicting serious physical and mental abuse for some time, the boyfriend threatened to break Clark's ribs after she had fallen asleep.Clark retrieved a gun, shot the boyfriend once, then retrieved a second gun and shot him again. He would die of his injuries.The next day, March 6, Minnesota Attorney General Keith Ellison charged Clark with second-degree murder. Clark raised the legal defense of self-defense.At trial, the jury interrupted deliberations to ask the judge for clarification on what was meant by the legal term "imminent," a required element of self-defense. The judge responded that "imminent" meant "immediate." The jury then convicted Clark as charged.This past Monday a MN court of appeals reversed Clark's conviction, holding that "immediate" was too narrow a definition of "imminent." Minnesotta v.
