Retired basketball player All-Star and current cannabis entrepreneur Shawn Kemp got into a gunfight outside a Tacoma shopping mall last week after his efforts to recover the cell phone stolen from his car resulted in an exchange of gunshots. Although Kemp was originally arrested at the scene after the other party fled, he appears to have promptly and prudently lawyered up, and has now been released based on his claim that he shot in self-defense. In June 2021, Eric Popper was involved in a road rage incident while driving down I-95 in the Miami FL area. He would ultimately empty his pistol through the passenger window and windshield of his car, in an act he would characterize as self-defense. On March 1, 2023, a Farmington UT police officer pulled over 25-year-old Chase Allan for failure to display proper registration tags on his BMW automobile. Within just a few minutes, Allen would die in a hail of bullets fired by five officers. A week or two ago, while guesting on Rekieta Law during our relentless and arduous coverage of the Alex Murdaugh trial, news broke that #alecbaldwin had been relieved of the sentencing enhancement charge that the NM prosecutor had brought against him on top of the involuntary manslaughter charge. I had taken a quick look at the relevant law just before coming onto Rekieta Law, and while waiting for the Murdaugh trial to start up I opined that it seemed to me that the enhancement certainly should have been dismissed as against armorer Hannah Guttierez-Reed, but that dismissing the enhancement against Baldwin did not seem legally necessay.I. WAS. WRONG! I meant to get to this earlier, but it's been hell catching up on stuff since Murdaugh's conviction. On February 14, 2023, Dr. T. Markus Funk, PhD, published a 10-page paper entitled "Busting the Durable Myth That US Self-Defense Law is Uniquely Harsh." That paper is the subject of today's LIVE show. Dr. Funk is a former federal prosecutor, US State Department Section Chief, and has taught at such esteemed academic institutions as Northwestern University, the University of Chicago, the University of Colorado, and Oxford University. Despite those impressive credentials, however, this paper is very much a mixed bag in terms of its strength of understanding of self-defense law. This is not a particular criticism of Dr. Funk--in my experience virtually all of the legal scholarship on self-defense law is pretty awful, regardless of author.Today we'll take the opportunity to apply a critical eye to Dr. Funk's "Busting the Durable Myth" paper, in part as a cautionary tale to not assume that a scholarly paper on self-defense law is of the quality one might like, even if the author has the most impressive of academic credentials. This past Friday a Paulding GA Sheriff's Office dash camera video was released of the March 4, 2022 arrest of burglary suspect Tyler Canaris. Deupties were responding to calls that a person matching the description of Canaris was attempting to break into neighborhood cars during the dark hours of that early morning. When Canaris was repeatedly non-compliant with a Deputy's attempt to secure his investigatory detention, the Deputy bear-hugged Canaris and took him to the ground, followed by securing him in handcuffs with the assistance of a second Deputy who then appears on scene. Canaris would suffer a broken collar bone and concussion as a result of his impact with the street.It would later appear that Canaris was not, in fact, the suspect burglarizing neighborhood crimes, and he was never charged with burglary. He was, however, charged with obstruction of justice after he filed a civil suit against the Paulding GA Sheriff's Office. On January 31, 2023, New Mexico First Judicial District Attorney Mary Carmack-Altwies filed a statement of probable cause for involuntary manslaughter in the October 21, 2021 shooting death of Halyna Hutchins on the set of low-budget western movie "Rust."My own legal analysis of that event, beginning the day following the shooting, had 13 months prior to the probable cause statement concluded that a charge of involuntary manslaughter was overwhelmingly warranted by the facts and law in this case--so, it's nice to see the New Mexico legal system begin to catch up. Tyre Nichols died three days after violently resisting his January 7, 2023 arrest by the Memphis police department. This past Friday, video of that arrest was released. Now five Memphis police officers have been fired and are facing charges of murder. Not that it should matter, but the five officers as well as Nichols are all black. The death of Nichols has become highly politicized, and the general public is having the usual emotional reaction to the just-released video of yet another bad outcome use-of-force event. Judging by the last day's worth of social media, much of the internet believes absolutely that the released video provides incontrovertible proof that the death of Nichols was nothing but a vicious murder. On Wednesday, January 18 the Minnesota Court of Appeals heard oral argument on Derek Chauvin's appeal from his conviction in the death of George Floyd. Chauvin was convicted in Minnesota state court of second-degree unintentional murder, third-degree murder and second-degree manslaughter (note that all of these are unintentional forms of unlawful killing, what most states would refer to as "felony murder" or "involuntary manslaughter" rather than "murder").Today's show will essentially be a response the video of that oral argument, with contextual explanation for why appeals are for losers, how they work, and why it's unlikely that Chauvin will obtain any meaningful relief in this case.Join me LIVE at Noon ET today!NEW! In the early morning hours of December 13, 2022 a heavily armed Cherokee County NC Sheriff's SWAT team arrived that the trailer home of Jason Kloepfer and Alison Mahler, and began shouting orders at the couple sleeping inside. Awakened, Kloepfer and Mahler stumbled to the door of their trailer, and opened to shouted commands. Quickly, however, numerous shots were fired by officers, striking Kloepfer to the floor of his trailer.Shortly after the shooting the Cherokee County Sheriff's Office released a statement claiming that Kloepfer had "engaged in a verbal altercation with officers and emerged from a caper trailer and confronted officers. They charged Kloepfer with communicating threats and resisting, obstruction, and delay and indicated additional charges may follow.Yesterday, however, Kloepfer released video footage taken by a camera inside his trailer. This morning New Mexico District Attorney Mary Carmack-Altwies announced that actor Alec Baldwin would be charged with two counts of manslaughter in the October 21, 2021 shooting death of cinematographer Halyna Hutchins as the two worked together on the set of the low-budget movie “Rust.”This decision to charge Baldwin with manslaughter comes a mere 13 months after my own legal analysis of the shooting, suggesting manslaughter, published at Legal Insurrection the day after the shooting.That piece was quickly followed up by a much more detailed legal analysis concluding manslaughter was likely the appropriate charge in this case, published here just three days later.I’ve written numerous follow-up pieces on Baldwin’s shooting of Hutchins (all of which can be found collected here -- https://lawofselfdefense.com/baldwin), but nothing during the 13 months since that event has changed my fundamental conclusion that a proper application of New Mexico law to the apparent facts in this case leads to anything but an act of reckless (involuntary) manslaughter on the part of Baldwin—ultimately the charge announced today by DA Carmack-Altwies.Here I’ll quickly hit the high points of my previous analysis, so we’re all on the same page in terms of the legal merits of this charge of manslaughter. This past Thursday night, Jan. 5, 2023, an armed and masked armed robber was plying his trade in Ranchito #4 Taqueria in Houston TX, when one of the customers decided to express his objections--in the form of nine rounds fired into the robber, unsurprisingly with fatal results. The shooter fled the scene and has not yet been identified, although authorities are looking--though they state that they have not yet decided whether to charge the shooter.Although the initial shots fired by the shooter appear to be legally justified as defense of self, defense of others, and (uniquely under Texas law) perhaps even defense of property, the last shot fired looks more difficult to justify. At the moment that ninth shot was fired the robber was apparently unconscious on the floor and had been disarmed of the only weapon he was known to possess, when the shooter fired one last shot, apparently into the robber's head. Fortunately for all of us, this event was captured on video, and today I conduct legal analysis and commentary on this video, in the context of Texas use-of-force law--and with special guest Attorney Steve Gosney!NEW! Aaron Dean, convicted last week of reckless manslaughter in the shooting death of Atatiana Jefferson, was sentenced by the jury today to a term of 11 years, 10 months, and 12 days.The 10 months and 12 days is likely simply because the shooting occurred on October 12, of 2019--10/12.So, an extra year, almost, for the month and date of the tragic event. Justice.This was an unjust conviction--no rational jury properly informed of the law and evidence could have arrived at a conviction on the charge of reckless manslaughter, while also acquitting Dean of the murder charge on the grounds of self-defense--and by extension this is an unjust sentence.But the State was relentless in lying to the jury about both the law and evidence, and sadly Dean's defense team did a pathetically bad job in defending their client.This would have been a very different trial had I been consulting on this case. Sadly for Dean, he got railroaded, and there was nobody to stop the train that ran him over.

On November 30 a civil lawsuit was filed against the Sig Sauer firearms company in Federal court in New Hampshire. The suit is brought by no fewer than 20 plaintiffs, all with similar claims--that the company's P320 pistol was defectively designed, that this defect caused them serious injury, and that Sig Sauer should be held liable for those injuries. This suit is of particular interest to me in that I've carried a variety of Sig pistols--including for many years the P320--for personal protection. I was also for more than a decade a subject matter expert adjunct instructor at the Sig Academy on use-of-force law. That said, my expertise is use-of-force law, and this is a civil suit--so I've invited on Attorney Dani Ahn, an experienced civil litigator, to share her expert insights into this lawsuit.
