Police Shoot Fleeing Malachi Williams in the BACK! Lawful? YES!
A white police officer shoots a fleeing black suspect—Malachi Williams--in the back, at a moment where the suspect presents no immediate threat to the officer. Worse, the officer’s body worn camera footage shows no apparent indication that the suspect was armed. Is this police shooting of a fleeing, apparently unarmed, black suspect in the back yet another example of police systemic racism and excessive force? The answer is no—because, as usual, the devil is in the details. THERE IS ONLY ONE SELF-DEFENSE "INSURANCE" PROVIDER I TRUST!There are lots of self-defense "insurance" companies out there. You Choose: Actual Lawyering Lawyer or Internet Popular Lawyer?
Today's LIVE show is in response to the video posted on August 25 by the channel "Washington Gun Law" (Attorney William Kirk) regarding the shooting death of Roger Fortson by a Florida deputy back in May. The deputy was responding to reports of an apparently violent domestic violence complaint when Fortson responded to the door knock with a gun in hand--at which point the deputy shot Fortson.Kirk had previously concluded that the shooting of Fortson was an outright execution for Fortson having merely exercised his Second Amendment rights. I critiqued Kirk's conclusion that the Fortson shooting was an outright execution on the basis that (despite claiming to be a criminal defense attorney providing legal analysis) he never made a single reference to any relevant Florida use-of-force law whatever, nor entertained any legal argument that might favor the deputy who shot Fortson. It is frankly unimaginable to me that a criminal defense attorney can offer a legal analysis to the public on a use-of-event of high public interest and controversy without even once considering the likely defendant's legal defenses. In my own critique I made actual use of the relevant Florida law that, combined with the facts available, provides a sound foundation for the legal conclusion that the deputy's shooting of Fortson was lawful, if awful. The Kirk video we'll be taking a look at today is apparently in part a response to my critique.Full disclosure: I have not myself watched this Attorney Kirk video, so I'll be seeing it for the first time during today's live stream. So join me for my own LIVE response to Kirk's latest video in this series at 1PM ET!In the interests of full transparency, here's my previous LOSD legal analysis of this unfortunate shooting (along with WGL content links):LOSD: REAL LAWYER | The Roger Fortson Shooting: Awful? SHOCKING New Duty-to-Retreat Law! The DISSENT!
Last week the Minnesota Supreme Court filed its ruling in the case of State v. Blevins, a case in which the defendant pulled out a machete on a train platform and brandished it at several people.Today we read the DISSENT of that ruling. We previously read the majority opinion of that ruling HERE.The defendant was charged with felony assault, and raised the legal defense of self-defense. At a bench trial the judge ruled that the defendant's conduct could not qualify as self-defense because he failed to satisfy Minnesota's generalized legal duty to retreat in the context of self-defense.Minnesota is, indeed, one of the small minority of states (eleven) that impose a generalized legal duty to retreat before deadly force can be used in self-defense--but never before has this duty been expanded to include the mere threat of deadly force, as opposed to the actual use of deadly force. In today's LIVE show we read through the DISSENT of State v. Blevins, consistent with our mission at Law of Self Defense of basing our understanding of the law of self-defense on ACTUAL law. REAL LAWYER: NEW Minnesota Duty-to-Retreat Law: What's it MEAN?

Sonya Massey Shooting: Awful but Lawful Self-Defense
Today I’m going to share with you proof that the tragic shooting death of Sonya Massey at the hands of then-Deputy Sean Grayson was to a reasonable degree of legal certainty a lawful use of deadly force in self-defense.FIRST we’re going to review once again the body worn camera footage of the encounter between Sonya Massey and deputies that led to her death, streaming right through without commentary or pause.THEN we’re going to do a legal analysis of this event applying ACTUAL law and ACTUAL police use of force policies to ACTUAL evidence—and not merely succumb to our emotions over this admittedly tragic and bad outcome shooting.Emotionally hysterical hand-waving may make internet audiences feel good, and if that’s what you’re looking for it’s out there. If you want actual legal analysis, however, you’re in the right place. That’s what we do here at Law of Self Defense, because emotionless analysis is how real lawyers practice law.Plus, a BONUS—how YOU can better prepare to make better informed, more confident, more DECISIVE, and LEGALLY SOUND decisions in defense of yourself and your family, and your make yourself hard to kill.Get Your FREE Copy of Our Best-Selling Book: "The Law of Self Defense: Principles"Visit Here: https://lawofselfdefense.com/getthebook"You are wise to buy this material. LIVE! Sonya Massey Shooting: Legal Analysis Q&A
On Wednesday I published the video of my legal analysis of the Sonya Massey shooting. Massey was shot and killed by Deputy Sean Grayson inside her own apartment earlier this month. Grayson has since been fired and charged with murder and other crimes. In my legal analysis I concluded that the available evidence--in the form of the body worn camera video of Grayson and a second deputy with him at the time--made clear that the shooting of Massey, while tragic, was almost certainly lawful self-defense.This, of course, has led to a tsunami of protesting comments, as my analysis runs counter to the consensus view of this police use-of-force event. In this live stream I will sift through a selected portion of the more substantive comments and questions I've received across social media, and address those with law-based analysis and the actual evidence in the case. HOW Incompetent Was Secret Service Agent? THIS Incompetent!
President Donald Trump was shot by an attempted assassin on Saturday, July 13, a day that exposed a horrific degree of incompetence of both the US Secret Service generally and some of its purportedly elite agents on scene in particular.Exactly how incompetent were some of those agents on scene? In today's show we illustrate exactly their level of incompetence, by contrasting their performance with that of a normal street cop actually in a gun fight. An Indianapolis driver got very angry with another vehicle, and approached that other in a rage with a gun in hand. REAL LAWYER: How to STOP an Assassination INSTANTLY
This past Saturday a rifle-armed assassin came within millimeters of killing President Donald Trump. Fortunately, the President survived with a flesh wound to his ear.Perhaps even worse, the more we learn about this assassination attempt, and especially the US Secret Service preparations for and response to this threat, the more inexcusable the whole scenario becomes. Join me to discuss how the law of self-defense provides MORE than sufficient perfectly legal options for the US Secrete Service, local law enforcement, and even mere bystanders to have STOPPED this assassin in his tracks, before he was ever able to to fire his first murderous shot. REAL LAWYER: A Brooklyn Pew: Lawful?
On Saturday July 6th an event called "Freaknik Picnic" held in Brooklyn NYC's Prospect Park (nearly?) almost had a bit of fisticuffs turn into a fatal shooting--and a rather unusual shooting, at that, as it appears to have involved a derringer! With only a very short (~7 second) video clip of the confrontation available, and little news reporting that I was able to find, it's not easy to arrive at any definitively RIGHT ANSWERS about who might have been acting lawfully--or not. What we can do, however, is identify the RIGHT QUESTIONS as a foundation for any legal analysis of this event, and that's what we'll do in today's show. After all, you can hardly expect to ever arrive at right answers if you don't even know the right questions. Good Pew: Bad Pew
The body worn camera for two police shootings were just brought to my attention, and I thought they provided good examples of how police shootings can be straightforward GOOD shoots, as well as how they can be straightforward BAD shoots. In today's show we break down the legal elements that make each of these shooting lawful and unlawful, respectively. Unfortunately, of the two, it was the unlawful shooting that resulted in an unnecessary death. Will Judge DISMISS the Baldwin Manslaughter Indictment?
On October 21, 2021, actor Alec Baldwin, on the set of low-budget Western movie "Rust," pointed what he knew to be a real gun directly at cinematographer Halyna Hutchins, cocked the hammer, depressed the trigger, and fired a fatal bullet into her body.Baldwin is now approaching trial on a charge of involuntary manslaughter.Last week the Baldwin defense team began arguing to the court that the manslaughter indictment should be dismissed WITH PREJUDICE--so that it could never be brought again--on the grounds that the prosecution "destroyed" evidence. The "destroyed" evidence consists of the revolver used by Baldwin to kill Hutchins, which had some small internal parts broken during function testing by the FBI.In today's live stream we complete this argument to the court, hear the State's response, and hopefully get an immediate real-time decision by the judge.THERE IS ONLY ONE SELF-DEFENSE "INSURANCE" PROVIDER I TRUST!There are lots of self-defense "insurance" companies out there. State to Expose Baldwin's Reckless Conduct!
New Mexico has charged actor Alec Baldwin with reckless manslaughter over his shooting dead cinematographer Halyna Hutchins on the set of the low-budget western movie "Rust." Baldwin's immediate conduct that results in the firing of the bullet that killed Hutchins ought to be enough, on the legal merits, to support his conviction beyond any reasonable doubt--he (obviously) never checked to ensure there was no live ammo in the gun, he pointed what he knew to be a real gun directly at Halyna Hutchins, he manipulated the hammer of the gun while doing so, and he arguably manipulated the trigger at the same time. BLAM!Prosecutors, however, want to introduce evidence of Baldwin's firearm recklessness beyond this conduct immediately proximate to the gun in his hand discharging into Hutchins. They also want to introduce evidence of Baldwin's reckless firearms conduct--and misconduct--in the days immediately proceeding the shooting.Normally, evidence of "prior bad acts" for which the defendant is not charged is presumptively inadmissible in court--but Prosecutor Kari Morrissey is arguing that THESE prior bad acts are an exception, and in the motion we'll cover today she explains to the court exactly why. In California Shooting a Burglar = Murder?
A 77-year-old Oakland CA homeowner is confronted by multiple burglars in a stolen vehicle, armed with a crowbar, a fake gun, and disparity of numbers. Car thieves wave an apparently full-auto Glock with a drum magazine at the door camera of the victim's home, obviously threatening overwhelming deadly force if the victim attempts to thwart their theft of his vehicle. If Only USCCA Had Done It Right: Part 1
The United States Concealed Carry Association (USCCA) along with its partner Delta Defense LLC purport to pay their members legal expenses if the member is involved in a use-of force event. Indeed, their sophisticated internet advertising campaigns frequently feature CEO Tim Schmidt assuring the public that "We've got your back!"In recent years, however, USCCA has refused to meet that apparent obligation to its members. When asked about this the organization has either provided no particularly substantive reasons--e.g., "we just feel we're not obligated to do so"--or has made up an outrageously not credible explanation months after the fact--e.g., "actually that member preferred we not help them."It is for these reasons that I'm personally unable to recommend USCCA in good faith to anybody seeking legal services coverage in a use-of-force context. That said, there DO EXIST scenarios in which it would arguably be appropriate for ANY use-of-force legal services company to decline to provide coverage--and we'll explore one of those scenarios in the context of a recent New Mexico Supreme Court decision. If THIS had been USCCA's explanation for its repeated failure to cover its members, they'd have had a point. Too bad for them, however, that this was NOT their explanation.THERE IS ONLY ONE SELF-DEFENSE "INSURANCE" PROVIDER I TRUST!There are lots of self-defense "insurance" companies out there. State "Destroyed" Baldwin Revolver ... Charges Dismissed? (w/ Steve Gosney!)
The legal defense for actor Alec Baldwin, scheduled for a manslaughter trial next month over the shooting death of Halyna Hutchins on the movie set of "Rust, is once again trying to get his indictment dismissed, this time with prejudice (meaning, he could not be re-indicted). An earlier effort to have the indictment dismissed on the premise that it "failed to allege a criminal offense" was recently swatted down by trial Judge Mary Marlowe Summer--but now the defense is taking another swing. The FBI examination of the Baldwin revolver involved a mallet test, in which the revolver was struck with a mallet from various angles to see if the gun could be fired without the trigger being pressed (Baldwin denies having pressed the trigger, and claims the gun "just went off.") At one point the cocked hammer of the revolver was struck hard enough that the hammer-sear engagement surfaces within the revolver were broken. The defense is now characterizing this as the prosecution having "destroyed evidence," and arguing that the indictment against Baldwin should be dismissed with prejudice as a result. Sound argument? Or just more smoke and mirrors?THERE IS ONLY ONE SELF-DEFENSE "INSURANCE" PROVIDER I TRUST!There are lots of self-defense "insurance" companies out there. Some are hot garbage. “Rust“ Armorer to Testify against Alec Baldwin?
The prosecutors in the upcoming manslaughter trial of Alec Baldwin for the shooting death of Halyna Hutchins on the movie set of "Rust" have asked the court to order set armorer Hannah Gutierrez--herself recently convicted of manslaughter in this case--to be compelled to testify against Baldwin. In addition, the Baldwin defense has abruptly decided to withdraw several of its planned witnesses, for reasons the prosecution suggests indicate that these defense witnesses would testified in a manner harmful to Baldwin. OnlyFans Killer Mini-Trial: Key Testimony! | Courtney Clenney (2/5)
In today's show we cover the Courtney Clenney Arthur hearing testimony of the lead investigator, Detective Brecino. Specifically, we cover Brecino's cross-examination by Defense Counsel Frank Prieto.Overview:This week we're covering "OnlyFans Killer" Courtney Clenney, who on April 3, 2022 killed her boyfriend Christian Obumseli with a knife in their Miami apartment. Obumseli suffered a single knife wound to the chest.Clenney would tell investigators that the much larger and heavier Obumseli was a domestic abuser, and had pinned her to the wall by her throat and thrown her to the ground. She somehow managed to escape, move 10 feet away, grab a small kitchen knife, and toss it in his direction. That knife managed to penetrate Obumseli's chest, severing carotid arteries, and quickly leading to his death from massive blood loss.Although investigators initially perceived the event as an act of self-defense, they quickly began to suspect otherwise. Much evidence emerged that Clenney had been a violent abuser in the relationship--indeed, it seemed that she had previously stabbed Obumseli on an earlier occasion, simply because she was angry that he had stayed late to watch the overtime of a football game. There also emerged video of Clenney attacking Obumseli with her fists in an elevator.Ultimately Clenney was charged with second degree malice murder by Florida prosecutors, and she is in jail awaiting trial on that charge today. In late 2022 Clenney sought pre-trial release, offering to stay under house arrest with her parents in Texas. Florida prosecutors disagreed, and a motion was filed for an Arthur hearing. This is a Florida-specific hearing that is essentially a mini-trial, in which prosecutors have to prove by a strong presumption that the defendant is likely to be convicted at trial (Phase 1) as well as that the defendant is a flight risk if released (Phase 2).The Arthur hearing was held on Tuesday, November 15, 2022, and Thursday, November 17, 2022, with key testimony primarily from the lead investigator and the medical examiner on those two days, respectively. Spoiler: On December 8, 2022, the hearing judge would ultimately deny pre-trial release. Nevertheless, the testimony of these witnesses provides us with insight into how the evidence is likely to be presented at the actual trial.Over the next few Law of Self Defense shows I will be working our way through those two days of Arthur hearings and testimony.THERE IS ONLY ONE SELF-DEFENSE "INSURANCE" PROVIDER I TRUST!There are lots of self-defense "insurance" companies out there. Motion to Dismiss Alec Baldwin Indictment is DENIED!
A week ago last Friday, on May 17, Judge Mary Marlow Sommer, presiding over the manslaughter trial of Alec Baldwin in the shooting death of cinematographer Halyna Hutchins on the set of low-budge western movie "Rust," heard oral arguments around the defense team's motion to dismiss the grand jury indictment on a number of grounds. This motion was, of course, contested by Special Prosecutor Kari Morrissey. Although my own legal sense is that the motion was without substantive merit, it was interesting to observe Judge Sommer go rather hard at Prosecutor Morrissey on some of the key arguments raised by the defense team.I covered that oral argument here at Law of Self Defense last Saturday, May 18.Nevertheless, last week Judge Morrissey issued her ruling denying the defense motion to dismiss the grand jury indictment, and so we will be proceeding to the actual manslaughter trial, with jury selection scheduled for July 9 and the trial proper scheduled to begin July 10. I will, of course, be live streaming the trial for its duration. Today we dig into Judge Sommer's denial order, and see to what extent it tracks with my own legal reasoning on the dismissal of the indictment arguments on each side. OOPS BANG! Unintentional Shooting = Self-Defense?
A New York City liquor store owner finds two men stealing, and shoves them out the door onto the sidewalk. A verbal dispute continues, and one of the thieves charges at the store owner standing in his doorway, punching and kicking. The store owner then follows the thief out onto the sidewalk, and throws a right hand at the thief. In that right hand, however, was a pistol, and it discharges as the blow lands, resulting in a gun shot wound to the thief. Presumably the shot is unintentional. The store owner has now ben charged with two counts of assault and is looking at 7 years in prison. (The thieves have been charged with petit larceny, and are looking at 1 year each.)Could this shooting be justified as self-defense by the store owner? Baldwin Lawyers Argue 'Rust' Killing Simply Lawful
Is it possible that pointing what one knows to be a real gun at another human being, cocking the hammer, pulling the trigger, contrary to all industry practices and safety guidelines, and without first ensuring there is no live ammo in the gun, and killing someone as a result, is simply not a crime?Earlier this month the defense lawyers for Alec Baldwin--awaiting trial on a charge of involuntary manslaughter for the shooting death of cinematographer Halyna Hutchins on the movie set of "Rust" after Baldwin fired a fatal bullet into her chest--filed a motion with the trial court essentially arguing that even if everything the prosecution says about Baldwin's conduct is true, it still does not amount to a crime. In today's show we'll both cover the general legal doctrines that govern in the context of causing an unintended death in the course of mishandling an inherently dangerous instrument, such as a gun, as well as walk through the defense "Motion to Dismiss the Indictment for Failure to Allege a Criminal Offense."#alecbaldwin #rust #halynahutchins THERE IS ONLY ONE SELF-DEFENSE "INSURANCE" PROVIDER I TRUST!There are lots of self-defense "insurance" companies out there. HEARING: Will Alec Baldwin's Indictment Be Dismissed?
Yesterday Judge Mary Marlowe Sommer, presiding over the upcoming manslaughter trial of Alec Baldwin, for the killing of cinematographer Halyna Hutchins on the set of low-budget western movie "Rust," held a hearing to resolve a motion by Baldwin's highly paid defense team asking that the grand jury indictment against their client be dismissed. Arguing counter to that defense motion is prosecutor Kari T. Morrissey. Morriseey also prosecuted the manslaughter charges against "Rust" armorer Hannah Gutierrez, whose trial was also presided over by Judge Sommer. Gutierrez was found guilty of involuntary manslaughter, and sentenced to the maximum of 18 months by Judge Sommer. The Baldwin defense team has filed several motions demanding that his indictment be dismissed, largely on grounds that seem spurious. Nevertheless, they are being highly paid to advocate zealously for their client, and this challenge of the indictment is part of that defense. Yesterday Judge Morrow finally heard the oral arguments of the parties, as a final step before she issues a ruling on the defense motion to dismiss the grand jury indictment--and THAT'S what we'll be covering in today's show. REAL LAWYER | Daniel Perry Pardoned! Justice? Or Fascism?
Yesterday, May 16, Texas Governor Greg Abbott issued a full and complete pardon to Daniel Perry, on the recommendation of the Texas Board of Pardons and Paroles. Perry had been convicted of the murder of AK-47 armed Black Lives Matter protestor Garrett Foster during a 2020 BLM protest in Austin TX. The jury rejected Perry's claim of self-defense, and Perry was subsequently sentenced to 25 years in prison.Although Gov. Abbott had soon after the trial promised to pardon Perry if the Board of Pardons so recommended, I'd personally expressed some skepticism that a pardon would ever actually issue--not for legal reasons, but for political reasons. Now that a pardon has issued, the firestorm of outrage over this case has re-ignited. Is the Governor's pardon a lawless genuflection to racist fascism, as the Progressive Left claims? Or is the pardon simple justice for an American serviceman who was merely exercising his Second Amend right to bear arms and his legal privilege of self-defense, and whose conviction was itself unjust? Sound Legal Analysis, or Shameful Misinformation?
Two days ago, Attorney William Kirk, the President of law firm Washington Gun Law, released a YouTube video on his extremely popular channel (~360,000 subscribers) providing legal analysis of the tragic shooting death of Roger Fortson. The title of that video: "The Florida Man Who Was Executed for Exercising His Constitutional Rights." (Find it here: https://youtu.be/IWepSw11YiA?si=_mxXs...)Given that this analysis was by a fellow attorney popular with the gun community, I eagerly looked forward to his analysis. It was, to say the least, disappointing. Indeed, a good case can be made that the video not only failed to provide anything resembling sound legal analysis, it was rife with emotionally-laden misinformation. Indeed, the video makes zero--as in zip, zilch, none--reference to any relevant Florida law that would determine if Fortson's shooting was legally justified. Not a word. In my opinion, criminal defense lawyers in particular should do better when covering such high-profile, emotionally-charged use-of-force events. REAL LAWYER | The Roger Fortson Shooting: Awful? Lawful? Both?
On Friday, May 3 a Florida deputy responded to a domestic violence call. Arriving at the apartment complex the deputy was met by the woman who'd made the call, who directed him to apartment 1401, in which she believed the violence to be occurring. The deputy knocked on the door, standing on either side for purposes of safety. When the door opened, the deputy was presented with a man with a gun plainly visible in his hand. The deputy immediately drew his service pistol and shot the man, killing him. That man would turn out to be Roger Fortson, a US Airman who was not, in fact, involved in a domestic violence event, and who by all accounts was doing nothing illegal at all when fatally shot by the deputy. Fueled by the usual lies of race baiter Benjamin Crump, as well as by visions of how the world might be if perfect, the internet is hysterical with outrage. Could this tragic shooting nevertheless be lawful? Is it necessarily murder? Manslaughter? Or is it simply not a crime at all under the law of self-defense?Join me for an EMOTION-LESS, LAW-BASED analysis of the police shooting of Roger Fortson. 8 COPS SHOT, 4 KILLED : Real Lawyer Analysis!
On Monday, April 29, 2024, around 1:30 p.m., the U.S. Marshals Fugitive Task Force was attempting to serve active felony warrants for unlawful felon gun possession and felony flight to elude on 39-year-old convict Terry Clark Hughes, Jr. As officers approached, Hughes began firing at them, striking multiple officers. The officers responded in kind, and the gunfight was on.By the time the smoke cleared, Hughes was dead. Unfortunately, eight of the officers involved had been short, four of them fatally. Today we'll take a look at a variety of legal questions that arise from these kinds of engagements including: Is the suspect's home the safest place to secure their arrest? Can it ever be lawful to shoot at police? Should a felon who has served their time regain their gun rights? And much more! We'll also, of course, take Q&A from our Law of Self Defense Members.FREE BOOK! “The Law of Self Defense: Principles”Physical book, 200+ pages, we just ask that you cover the S&H:http://lawofselfdefense.com/freebookDisclaimer - Content is for educational & entertainment purposes only, and does not constitute legal advice.Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. VIDEO! The Deadly Limits on Open Carry!
An Ohio police officer responds to a call of a man walking around a residential neighborhood pointing a gun at homes. As the officer pulls up, he sees a suspect that matches the description called in. The officer begins to verbally engage with the suspect--and within seconds has fired a shot as he spots an apparent gun in the suspect's hand. The apparent gun would later be determined to be a toy. Ohio happens to be an Open Carry state, meaning it is lawful to openly carry a firearm in public. Does that make this officer's shooting of this suspect unlawful? What if it is determined that the suspect had only the most innocent of intentions in possessing that apparent gun.
