Special Counsel Jack Smith has filed an unusual request - asking the Supreme Court to swiftly take up the issue of Donald Trump's claim that he can't be prosecuted for the crimes he committed while president. Smith wants to leapfrog the case over the DC federal circuit court of appeals and have the Supreme Court resolve the issue quickly so the case can proceed to trial on schedule by March 4th. The Colorado Supreme Court has heard oral arguments on whether the 14th Amendment's disqualification clause means Trump will have his name taken off the presidential ballot. Glenn reviews some of the arguments made by the parties and highlights some of the absurd positions taken by Trump's lawyers. For example: they are claiming that the January 6th attack on the US Capitol wasn't really an insurrection because "it only lasted three hours" or because "it only targeted one building." Then, the DC federal circuit court of appeals largely affirmed the gag order Judge Tanya Chutkan imposed on Donald Trump, trying to address his dangerous speech and posts. This time in our longform weekend podcast - Glenn runs down the legal stories of the week. First, Donald Trump said during Sean Hannity's interview - if he's elected - he'll be a dictator on day one. Even worse, he just put something in a new court filing in his criminal case in DC that indicates he also intends to act like a dictator in his criminal case - deciding legal issues himself rather than waiting for or abiding by legal issues as decided by Judge Tanya Chutkan. The Donald Trump gag orders are beginning to cross-pollenate. After Trump posted attacks on Judge Engoron's law clerk in New York, hundreds of threats poured in from Trump's supporters. Last week, Colorado Judge Sarah Wallace entered a finding that Donald Trump engaged in an insurrection on January 6, 2021. However, Judge Wallace went on to rule that the 14th Amendment does not disqualify a president who engaged in an insurrection from again serving as president of the United States. Both parties have now filed appeals in the case. Trump has appealed the judge's finding that he engaged in an insurrection, and Crew - the organization that brought the suit on behalf of Colorado voters - appealed her ruling that Trump is not disqualified by the 14th Amendment. Glenn says one of the important factors in assessing the likely result on appeal involves the different standards of review that are applied to a trial court's factual determinations versus its legal determinations. Then, if you thought the New York fraud trial couldn't get any worse for Donald Trump - it just did. In a colossal tactical blunder, Trump's own lawyer put a witness on the stand that, as the Business Insider reported, "ties (Trump) to the conspiracy." Trump's lawyers called as a witness longtime comptroller for the Trump Organization Jeffrey McConney. After Trump had previously testified that he knew little to nothing about the annual net-worth statements of his own business, McConney testified that the statements were actually provided to Trump for his final review. Indeed, the attorney for the New York Attorney General's office cross-examined McConney with his own hand-written note on the financial documents that plainly stated, " DJT to get final review." Glenn says - in other words, Trump's own lawyers called a witness that blew up their client's defense. A three-judge appellate court panel heard arguments regarding the constitutionality of the gag order Judge Tanya Chutkan placed on Donald Trump in an attempt to prevent him from endangering witnesses, court staff, prosecutors and their family members. In a very spirited 2.5-hour argument, the judges had pointed questions for both the prosecution and the defense. A Colorado judge has ruled that the evidence presented during the course of a trial proves that Donald Trump engaged in an insurrection against the United States. Judge Sarah Wallace spends 95 pages of her 102-page ruling meticulously detailing the evidence supporting her findings that Trump did indeed engage in an insurrection. But in the last pages of her ruling, she says that while there "are persuasive arguments on both sides" of the disqualification issue, "it appears to the Court that for whatever reason the drafters of Section Three (of the 14th Amendment) did not intend to include (for disqualification purposes) a person who had only taken the Presidential Oath." And accordingly, Judge Wallace declined to find that Trump was disqualified from holding office in the future. In today's longform weekend podcast - Glenn begins with some good news and tells us why the color ORANGE used to be a favorite but now gives him the creeps. He explains the silver lining hiding behind the big dark cloud and talks about Judge Chutkan's determination to start Trump's election interference trial on march 4th. She set a date for Jury selection to begin on February 9th in Trump's trial for trying to overthrow the 2020 election. Glenn says he'll be in court that day to report on the proceedings. Next, "The boss is not going to leave under any circumstances. We are just going to stay in power." That's the quote from a proffer video that was leaked to the press and it could mean big trouble for Trump in his Georgia RICO case. After flipping and pleading guilty, Trump co-defendant Jenna Ellis provided videotaped statements to the prosecution. This was leaked to the press by another co-defendant's lawyer. Glenn says this testimony is really incriminating. Then finally, more on-again off-again gag orders for Trump. One of the two gag orders judges have imposed on Donald Trump in attempts to protect witnesses, court staff and prosecutors, has been stayed or paused by the DC appellate court pending an oral argument scheduled for November 20th. As the reporting indicates, each of the three appellate court judges who will sit on the panel for the gag order appeal was appointed by a democrat president. In the age of Trump, we are always asking the question, "who appointed this federal judge?" But it hasn't always been that way. Glenn also takes on the differences between how the Obama administration approached the task of appointing federal judges versus how the Trump administration approached the same task. Former Vice President Mike Pence announced that he's suspending his bid for the presidency, but vows to keep working to help "principled Republicans" get elected. At a campaign stop, Donald Trump mentioned that Pence dropped out, and laughed when someone in the crowd yelled, "Traitor!" Trump then said that Pence "could have done what he could have done," an obvious reference to Trump's continued lie that Pence should have violated the law - the Electoral Count Act - and corruptly declared Trump the winner of the 2020 presidential election. Glenn explains that Pence will have the last laugh (figuratively speaking) when he is called as a prosecution witness to testify against Trump at his DC trial, about Trump's illegal pressure campaign attempting to get Pence to go along with his criminal scheme. Then, New York Judge Arthur Engoron ruled that Ivanka Trump must testify in the New York fraud trial against her father and her brothers Don Jr. and Eric. So now, Ivanka, Don Jr., Eric, and Donald Trump himself are all expected to testify. In our longform weekend podcast - Glenn recounts this week's Trump news. First, District Attorney Fani Willis tells Representative Jim Jordan, in no uncertain terms, that he is abusing his authority by interfering in her RICO prosecution of Donald Trump. Glenn says unfortunately, this abuse by Jordan and other Trump insurrectionists in Congress will continue until the Department of Justice indicts them for their crimes. Then, Special Counsel Jack Smith has filed a motion urging DC federal court Judge Tanya Chutkan to adopt jury procedures to protect jurors from Donald Trump. And on Monday, October 16, Judge Chutkan will take up Smith's request for a gag order on Trump to protect witnesses and others from Trump's continued threatening speech and posts. Special Counsel Jack Smith has filed a motion in Donald Trump's DC prosecution seeking to protect jurors from Trump's dangerous speech and social media posts. The "Motion for Fair and Protective Jury Procedures" seeks to have the court use a juror questionnaire to streamline the jury selection process in the DC case, and seeks to prohibit Trump and his lawyers from publicly disclosing the identities of - or attempt to communicate with - prospective jurors in any way. Notably in the motion, Smith lays out Trump's "attack," via a social media post, on New York Judge Engoron's law clerk and the ensuing gag order imposed by the judge. The New York Times reported: "Trump said to have revealed nuclear submarine secrets to Australian businessman." Defendant Trump is on pretrial release in four felony cases: two state and two federal. If the law was applied as intended, Trump would be in a jail cell, detained pending trial. But he's not. Instead, he's ruminating about perhaps being the next Speaker of the House of Representative. Donald Trump's civil fraud trial in New York has begun, and he predictably started the day with dangerous rhetoric directed at the Judge and New York Attorney General Letitia James. Specifically, Trump said people should "go after the Attorney General." On a lighter note, one of Trump's attorney's, Christopher Kise (who was previously sanctioned by the judge for his conduct in the pretrial litigation in this case), said in his opening statement that there is no such thing as an "objective valuation" for property. Glenn says - perhaps not, but there is rampant, transparent and obvious fraud, as reflected in Trump's absurd and inconsistent valuations of his properties. Then Judge Arthur Engoron - in a long overdue development, FINALLY placed a limited restriction on Trump's speech and posts. He was angry after Trump posted a picture of his law clerk taken with Senator Chuck Schumer. Trump was mocking the picture claiming the law clerk was "Schumer's girlfriend" and insisting that his fraud case should therefore be dismissed. There have been recent developments in the Georgia RICO case against Donald Trump, Mark Meadows, Rudy Giuliani, Sidney Powell, John Eastman, Jeffrey Clark, Kenneth Chesebro, and others.
