No one can accuse Donald Trump of being a strategic thinker. Donald Trump is as transparent as child when it comes to what he tries to accomplish with his lies, his disinformation, and his propaganda. For example, when he posts lies like, "the prosecutors are not coming after me, they're coming after you," it's a rallying cry designed to dupe his followers into feeling like they have a personal stake in the Trump prosecutions. Of course, the reality is that it is Trump, not his supporters, who is facing 91 felony charges in four cases, both state and federal. In his recent post, Trump tipped his hand, making it clear that even he knows that he will be convicted at trial. We've seen this movie before: some government official, some prosecutor, some law enforcement agent does something to hold Donald Trump accountable for his crimes, and Trump posts things about the person designed to inspire his supporters to threats and violence against that person. Most recently, Maine Secretary of State Shenna Bellows followed Maine's elections laws and her oath of office, and disqualified Trump from the Maine ballot. So, of course, Trump posted Secretary Bellows' bio and the threats started pouring in. Trump is on pretrial release in four felony cases. The law provides that, when there is clear and convincing evidence that a person under felony indictment poses a threat to the community or any person in the community, that defendant is to be detained pending trial. Glenn says it's long past time that the institutions of government apply the nation's pretrial detention laws to Trump as those laws are applied to every other person who is pending trial in a felony case. As the 50 states continue to decide the question of whether Donald Trump should be disqualified from state election ballots pursuant to the 14th Amendment because he engaged in insurrection against the United States, it looks like one conservative Supreme Court Justice ruled on that issue previously. In the ruling handed down by the Colorado Supreme Court disqualifying Trump from the presidential ballot in Colorado, the court relied on a legal opinion authored by Neil Gorsuch when he was a federal appellate court judge. The issue was whether the states had the authority to ban from their election ballots a candidate who was disqualified under the Constitution. Here are the precise words of then-Judge (now Supreme Court Justice) Neil Gorsuch: "a state's legitimate interest in protecting the integrity and practical functioning of the political process permits it to exclude from the ballot candidates who are constitutionally prohibited from assuming office. "Glenn says: So the only question left is - will Gorsuch remain consistent with his prior ruling and allow Colorado and the other states to disqualify Trump from their state ballots? Then, Donald Trump has asked the DC Circuit Court of Appeals to rule that he is above the law - absolutely immune from being prosecuted for the crimes he committed while in office. The Michigan Supreme Court has refused to review a case that sought to ban Donald Trump from having his name placed on the Republican primary ballot in Michigan. This ruling is unsurprising given the unique election laws and procedures in Michigan. If the Michigan Republican Party wants to place a name on its presidential primary ballot, it can put any name it likes, including someone who may otherwise be disqualified from holding public office. That may make little sense, but each state has the right to enact its own election laws and regulations, and Michigan has chose a . . . curious way to go about things. Notably, the Michigan Secretary of State has no legal authority to reject Trump's name even though he engaged in an insurrection. So the Michigan Supreme Court opted to not review the case, as it involved no violation of Michigan election laws. However, if Trump were to win the Republican nomination, the suit will be refiled and the court may then HAVE to review and resolve the case. Special Counsel Jack Smith has filed an unusual request - asking the Supreme Court to swiftly take up the issue of Donald Trump's claim that he can't be prosecuted for the crimes he committed while president. The Colorado Supreme Court has heard oral arguments on whether the 14th Amendment's disqualification clause means Trump will have his name taken off the presidential ballot. Glenn reviews some of the arguments made by the parties and highlights some of the absurd positions taken by Trump's lawyers. For example: they are claiming that the January 6th attack on the US Capitol wasn't really an insurrection because "it only lasted three hours" or because "it only targeted one building." Then, the DC federal circuit court of appeals largely affirmed the gag order Judge Tanya Chutkan imposed on Donald Trump, trying to address his dangerous speech and posts. Last week, Colorado Judge Sarah Wallace entered a finding that Donald Trump engaged in an insurrection on January 6, 2021. However, Judge Wallace went on to rule that the 14th Amendment does not disqualify a president who engaged in an insurrection from again serving as president of the United States. Both parties have now filed appeals in the case. Trump has appealed the judge's finding that he engaged in an insurrection, and Crew - the organization that brought the suit on behalf of Colorado voters - appealed her ruling that Trump is not disqualified by the 14th Amendment. Glenn says one of the important factors in assessing the likely result on appeal involves the different standards of review that are applied to a trial court's factual determinations versus its legal determinations. Then, if you thought the New York fraud trial couldn't get any worse for Donald Trump - it just did. In a colossal tactical blunder, Trump's own lawyer put a witness on the stand that, as the Business Insider reported, "ties (Trump) to the conspiracy." Trump's lawyers called as a witness longtime comptroller for the Trump Organization Jeffrey McConney. After Trump had previously testified that he knew little to nothing about the annual net-worth statements of his own business, McConney testified that the statements were actually provided to Trump for his final review. Indeed, the attorney for the New York Attorney General's office cross-examined McConney with his own hand-written note on the financial documents that plainly stated, " DJT to get final review." Glenn says - in other words, Trump's own lawyers called a witness that blew up their client's defense. A Colorado judge has ruled that the evidence presented during the course of a trial proves that Donald Trump engaged in an insurrection against the United States. Judge Sarah Wallace spends 95 pages of her 102-page ruling meticulously detailing the evidence supporting her findings that Trump did indeed engage in an insurrection. But in the last pages of her ruling, she says that while there "are persuasive arguments on both sides" of the disqualification issue, "it appears to the Court that for whatever reason the drafters of Section Three (of the 14th Amendment) did not intend to include (for disqualification purposes) a person who had only taken the Presidential Oath." And accordingly, Judge Wallace declined to find that Trump was disqualified from holding office in the future. In today's longform weekend podcast - Glenn begins with some good news and tells us why the color ORANGE used to be a favorite but now gives him the creeps. He explains the silver lining hiding behind the big dark cloud and talks about Judge Chutkan's determination to start Trump's election interference trial on march 4th. She set a date for Jury selection to begin on February 9th in Trump's trial for trying to overthrow the 2020 election. Glenn says he'll be in court that day to report on the proceedings. Next, "The boss is not going to leave under any circumstances. We are just going to stay in power." That's the quote from a proffer video that was leaked to the press and it could mean big trouble for Trump in his Georgia RICO case. After flipping and pleading guilty, Trump co-defendant Jenna Ellis provided videotaped statements to the prosecution. This was leaked to the press by another co-defendant's lawyer. Glenn says this testimony is really incriminating. Then finally, more on-again off-again gag orders for Trump. Glenn explains the details of the gag order "reflex" from the courts and it seems all of the gag order guardrails that keep Trump from saying or posting harmful things about court staff or witnesses are not holding in place due to the many appeals Trump keeps filing. One of the two gag orders judges have imposed on Donald Trump in attempts to protect witnesses, court staff and prosecutors, has been stayed or paused by the DC appellate court pending an oral argument scheduled for November 20th. As the reporting indicates, each of the three appellate court judges who will sit on the panel for the gag order appeal was appointed by a democrat president. In the age of Trump, we are always asking the question, "who appointed this federal judge?" But it hasn't always been that way. Glenn also takes on the differences between how the Obama administration approached the task of appointing federal judges versus how the Trump administration approached the same task. Then, in a remarkable revelation, one of Trump's co-defendants in the Georgie RICO case, Jenna Ellis, told prosecutors that Trump's close aid, Dan Scavino, said that Trump had decided he would not leave the presidency even though he lost the election. In today's weekend longform podcast Glenn gives us the latest updates in the Trump Trials. He begins with his review of the recent election. Then, Ivanka Trump has testified in the New York family fraud civil case. Glenn says it appears amnesia runs in the family. Next, a federal appeals court has temporarily lifted a gag order on Donald Trump in his 2020 election interference case in Washington D.C. Glenn says he'll be there on November 20th in the appellate court when they make their determination. Then finally, CNN has reported that several Mar-a-Lago employees are expected to testify against Donald Trump in his federal prosecution in Florida in his classified documents/obstruction of justice/espionage case. These witnesses reportedly include a plumber, a maid, a chauffeur, and a woodworker, among others. Upon learning of this, Trump erupted with an unhinged rant against the CNN reporting, against Jack Smith, and against Joe Biden. In today's longform weekend podcast - Glenn recaps some GOOD NEWS stories of the week - starting off with a fresh new story about DC Judge Tanya Chutkan - who is already preparing for Donald Trump's trial on March 4th. As just reported by the Washington Post, Judge Chutkan will now begin jury selection in Trump's DC case on Feb. 9. This reinforces that Chutkan's trial "will not yield to an election cycle," which she stated in open court when Trump's lawyers asked her to continue the trial until after the Nov. 2024 presidential election. The next good news story: Gag-order-palooza for the month of October. It started with a NY judge gagging Trump and the month ended with a DC judge gagging Trump. All-in-all, a pretty good month.
