In a move that again highlights why Judge Aileen Cannon should be recused from presiding over Donald Trump's federal prosecution in Florida, she refused to set a trial date during a hearing on Friday. This is inexplicable given that Jack Smith proposed a trial date of July 8th and Trump's lawyers proposed one for August 12th. This prompted Jack Smith's prosecutor to tell Judge Cannon that the one thing the parties seem to agree on is that there can be a summer trial date - which would at least get the case tried before the November presidential election. But Judge Cannon said she was "skeptical" of the case being ready to be tried this summer, even though Trump's lawyers said they could do it. The federal law requires that a judge "shall" recuse themself from presiding over a case "if their impartiality might reasonably be questioned." In a stunning development, the Supreme Court not only decides to take up on appeal Donald Trump's absurd, baseless presidential immunity claim, but they won't even hear oral arguments in the case for nearly two months. The DC federal circuit court of appeals has unanimously ruled that Trump is not immune from prosecution for his January 6th crimes. In their opinion - the court pointed out the Constitution expressly states that presidents can be criminally prosecuted EVEN IF they're first impeached. A New York jury has issued its verdict in the second defamation case that E. Jean Carroll bought against Donald Trump: Trump must pay Ms. Carroll $83.3 million in compensatory and punitive damages. Today was not a particularly good day for justice. Although Peter Navarro was sentenced to four months in prison for contempt of Congress, the judge DID NOT order him to be taken into custody. As the 50 states continue to decide the question of whether Donald Trump should be disqualified from state election ballots pursuant to the 14th Amendment because he engaged in insurrection against the United States, it looks like one conservative Supreme Court Justice ruled on that issue previously. In the ruling handed down by the Colorado Supreme Court disqualifying Trump from the presidential ballot in Colorado, the court relied on a legal opinion authored by Neil Gorsuch when he was a federal appellate court judge. The issue was whether the states had the authority to ban from their election ballots a candidate who was disqualified under the Constitution. Here are the precise words of then-Judge (now Supreme Court Justice) Neil Gorsuch: "a state's legitimate interest in protecting the integrity and practical functioning of the political process permits it to exclude from the ballot candidates who are constitutionally prohibited from assuming office. Then, Donald Trump has asked the DC Circuit Court of Appeals to rule that he is above the law - absolutely immune from being prosecuted for the crimes he committed while in office. The Michigan Supreme Court has refused to review a case that sought to ban Donald Trump from having his name placed on the Republican primary ballot in Michigan. This ruling is unsurprising given the unique election laws and procedures in Michigan. If the Michigan Republican Party wants to place a name on its presidential primary ballot, it can put any name it likes, including someone who may otherwise be disqualified from holding public office. That may make little sense, but each state has the right to enact its own election laws and regulations, and Michigan has chose a . . . curious way to go about things. Notably, the Michigan Secretary of State has no legal authority to reject Trump's name even though he engaged in an insurrection. So the Michigan Supreme Court opted to not review the case, as it involved no violation of Michigan election laws. However, if Trump were to win the Republican nomination, the suit will be refiled and the court may then HAVE to review and resolve the case.
