The Climate Trial of the Century is over, and the result is an absolutely travesty of justice. A D.C. jury ruled yesterday that Mark Steyn must pay $1 in compensatory damages and an absurd $1 million in punitive damages to climate media star Michael Mann for his claimed defamation. His co-defendant, Rand Simberg, was socked with paying $1 in compensatory damages, but only $1,000 in punitive damages.We followed the trial every day for nearly four weeks, and we can tell you that it was a disgrace to the professions in our legal system, the “profession” of juries to administer justice, and the professions in alarmist climate science. You see the reports in the news all the time, a patient on life support has given the “gift of life” by donating organs. Few people realize but organ donors needs to be alive to do this. Hospitals can legally declare people with a brain death diagnosis allowing them to take their vital organs for transplant. Dr. Heidi Klessig is author of The Brain Death Fallacy. She discusses whether brain death is irreversible and how the organ transplant business has grown since the decision in 1968 to include brain function in the legal definition of death. Klessig: “People defined to be brain dead or dead by neurological criteria have beating hearts, digest food, excrete urine, and even gestate pregnancies and deliver healthy babies. These people are not biologically dead, and their spirits have not departed. Brain death is not death. Many people who were diagnosed as being brain dead have recovered. If brain death was real death, people should not recover even once.” Klessig also discusses the Uniform Declaration of Death Act, and how New Jersey is the only state that allow families to demand treatment for patients declared “brain dead.” Patients and families can take measures before a crisis to make sure hospitals do not violate their wishes when it comes to life and death issues. After 12 years of delays, the defamation lawsuit brought by climate scientist Michael Mann and writer Mark Steyn finally began this week. Mann sued Steyn and others in 2012 claiming they libeled him when they mocked his infamous “hockey stick” graph that has been the lynchpin of climate alarmism for decades. Steyn compared the cover-up of Mann’s shoddy science at his then-employer Penn State University to the way the school covered up the horrible sexual abuse crimes conducted by disgraced football coach Jerry Sandusky and then whitewashed an internal investigation.Steyn, who gave one of the greatest keynotes ever at a Heartland climate conference about this case a while back (see below for a link), has been itching for this trial to finally happen since Obama was just starting his second term. It was Mann who employed one delaying tactic after another in an attempt to scare Steyn off.Steyn never backs down from a fight, and is putting Mann’s hockey stick itself on trial. The Heartland Institute’s Donald Kendal and Jim Lakely are joined by entertainment writer Christian Toto for our annual end-of-year look at movies, TV, and pop culture. This was, by even the accounts of the suck-up mainstream entertainment press, a disastrous year for Hollywood. Disney Studios set records for box office bombs, and delivered them one after the other in 2023: “Ant-Man and The Wasp: Quantummania”; “Indiana Jones and the Dial of Destiny”; “The Little Mermaid”; “Elemental”; “Haunted Mansion”; and “Wish.” Those productions alone, predicted to make billions, instead racked up at least $1 billion in losses for the once-infallible studio. And then there is Warner Bros., whose DC Comics Cinematic Universe tried its best to keep up in the bomb department with “Shazam! Fury of the Gods”; “The Flash”, “Blue Beetle”, and “Aquaman and the Lost Kingdom.” Those movies combined to nearly wipe out the studio’s $1 billion profit from its smash hit “Barbie.” Have we just witnessed the death of the “big franchise” movie? Was it “woke” that killed the beast? What about the effect of the writers’ and actors’ strikes on Hollywood? It sure looks like the events of 2023 created a perfect storm that will either force modern Hollywood to start putting entertainment above “The Message,” or become culturally irrelevant. Speaking of that, with the success of foreign products – namely, “Godzilla Minus One” – that aim to entertain its audience instead of lecture and berate them, is Hollywood truly vulnerable long-term from foreign and independent productions? The other day, Donald Kendal, deputy director of the Socialism Research Center at The Heartland Institute, was a guest on the nationally syndicated Charlie Kirk Show. Charlie was SHOCKED by the results of a poll by The Heartland Institute and Rasmussen Reports, released in December that showed one-in-five American likely voters who voted by mail-in ballot in the 2020 election committed some form or another of voter fraud. The other day, Heartland Institute Vice President Jim Lakely was asked to be on the Tony Katz Today show to talk about a new Heartland Institute/Rasmussen poll that caused a media earthquake. The Heartland Institute released a poll in December 2023 that caused a media earthquake. We commissioned Rasmussen to ask likely voters who mailed in their ballots in 2023 if they committed voter fraud. Well ... we didn't ask it in that way. We asked questions such as, "During the 2020 election, did you fill out a ballot, in part or in full, on behalf of a friend or family member, such as a spouse or child?" That is voter fraud. That is a crime. 21% of likely voters said "yes."WE asked: "Did you cast a mail-in ballot in a state where you were no longer a permanent resident?" 17% of Likely Voters said "yes." That is clearly voter fraud. A crime.We asked: "Did you sign a ballot or ballot envelope on behalf of a friend or family member, with or without his or her permission?" Again, that is about as clear as it gets when it comes to committing the crime of voter fraud. But 17% of likely voters polled by Heartland and Rasmussen said "yes." Heartland got a TON of media attention for this blockbuster poll that changes the national conversation about the integrity of the 2020 election. For years, Medicare has paid hospitals and their affiliates more for services than it has to others. The reasons are complex, but this policy significantly incentivizes hospitals to absorb independent practices, creating “monopolies” that reduce competition and increase prices for everyone. Dr. Richard Kube, M.D., founder and CEO of the Prairie Spine and Pain Institute—an independent practice in Illinois—experiences first-hand how this policy and other top-down government regulations work against patients. Kube, an advocate for “site-neutral” payment, recently discussed this topic in Newsweek. “Site-neutral payment would end the unfair policies promoting consolidation and encouraging higher prices,” Kube writes. “Such proposals have bipartisan support in Congress. Several congressional committees are currently debating a health reform package, including provisions to establish site neutrality under limited circumstances. This would be an essential first step, one that physicians nationwide hope will soon extend to other services. For almost 4 weeks, four-year-old Autumn Schall has been virtually trapped at Lucile Packard Children’s Hospital, in Palo Alto, CA against the will of her parents. Today, mother Hope Schacter joins the program to discuss Autumn’s situation. Autumn was admitted to the teaching hospital for an e-coli infection but within days, she became critically ill, receiving care in the ICU, being given intravenously a cocktail of risky drugs, and eventually put on a ventilator. When the parents questioned the treatment, the hospital reported them to Child Protective Services. They are working with advocates and a lawyer to have her moved to another hospital where their daughter won’t be viewed as a “case study,” and the family is treated like an ally not an adversary. Autumn was referred to Lucile Packard Children’s Hospital for a diagnostic work to examine her bowel after a week-long case of diarrhea. Her bowel was normal, but the hospital diagnosed an e-coli condition and wanted to admit her. After the parents agreed, the hospital proceeded with an aggressive treatment plan including powerful drugs such as Lasix, Diarel, and Aminophalen. “Their protocol was very aggressive. My daughter was never on Tylenol before. She was never really sick and when they’re throwing all these diuretics at you, and given the side effects these can produce, I just thought it was a lot for her constitution,” said Hope Schacter. The family has been working with Remnant Nursing advocacy services which has identified multiple ethical and clinical lapses. Schacter believes the hospital is trying to cover up clinical errors at the beginning of care that damaged her daughter’s kidneys and caused her to have a seizure. They complied with all treatment recommendations, even an MRI, which required intubation. Autumn has also had to undergo a blood transfusion. There was a hearing involving the CPS complaint. The hospital is trying to get the parents to sign off on all intervention deemed “emergency,” but the parents say it has been vaguely defined. The other day, Heartland Institute Research Fellow for Environment and Energy Policy Linnea Lueken was a guest on the Ron Arquette Show on KRNS radio in Salt Lake City, Utah. She was invited on to talk about a new paper she wrote with Heartland's Tim Benson titled "Debunking Four Persistent Myths About Hydraulic Fracturing." As Linnea explains, "fracking," as it's commonly called, is the process of extracting natural gas and oil from several miles deep beneath the surface of the Earth. This revolutionary technique -- combined with horizontal drilling -- has made America a global energy leader again and created thousands of good-paying jobs. But opponents of fracking peddle myths about damage the process does to drinking water, causing air pollution, health problems, and even earthquakes.Heartland was happy to be able to bust these myths on Rod Arquette's show. Stephen Moses, one of the leading experts on long-term care in the U.S., says the nation can dramatically improve the quality of our health care system if we could get rid of the loopholes that allow nearly everyone to qualify for Medicaid coverage. The current system encourages few people save for long-term care because it is widely accepted that the government will pick up the tab. While this may be true, government control limits innovation and leads to worsening health outcomes. Moses, and the Paragon Institute released their latest report on the problems with long term care in the U.S., called Long-Term Care: The Solution. In October 2022, Moses and Paragon outlined the problems in Long-Term Care: The Problem. People prefer to live out their final years in the comfort of their own home but surprisingly, many of the elderly end up in institutional care. That is no accident. Medicaid is the largest payer of long-term care, and one reason is because you don’t have to be impoverished to qualify. This has put a huge strain on the federal budget, on Medicaid reimbursements and significantly compromised the quality and supply of care. Few innovations exist because there is little presence of a free market. As a result, institutional care has become the “go-to.” This podcast begins with a discussion on Medicaid loopholes, the response from Congress, whether a solution is workable immediately, and how special interests might respond to closing off loopholes. The conversation then turns to why the public needs to be better educated on long-term care. The idea that it must be debilitatingly expensive isn’t true. The Heartland Institute’s Jim Lakely, Chris Talgo, Linnea Lueken, and special guest Jason Isaac of the Texas Public Policy Foundation present episode 422 of The In the Tank podcast. The Biden administration is continuing to mandate the electrification of everything while at the same time pulling offline the reliable and affordable power generation and transmission that would make it remotely possible. And this is a global delusion, not just a growing problem in the United States. Energy prices are skyrocketing and the “green energy” industry is now demanding even more government handouts – and permission to hike prices even more – to keep the scam going. But are we seeing signs that a rapid collapse of the scam is near? Investments in “alternative energy” companies took off in 2020, but all those gains are now gone. General Electric announced that it will post $1 billion in losses in its wind division. The S&P Global Clean Energy Index is down more than 30 percent this year and still dropping. Siemens, one of the premier German manufacturers of wind turbines, saw its stock price crash by nearly 40 percent in one day last week and now wants a 15-billion-euros handout from the German government. It also appears that “Big Oil” is giving up on pretending to be a part of the “green energy” future and is consolidating to produce even more oil and gas in the future. And in signs that the EV bubble is collapsing, Ford announced that it lost $1.3 billion in its EV division during the third quarter of 2023 – which translates into a loss of $62,016 for each of the 20,962 EVs it sold during the period. The CEO of Mercedes Benz said of the glut of EVs on the market that the public doesn’t want: “I can hardly imagine the current status quo is fully sustainable for everybody.” Even Elon Musk is warning that demand is just not there for this massive, government-driven push for EVs. The other day Heartland Institute Vice President Jim Lakely (that's me) was a guest on the Cut Jib Newsletter Podcast, part of the excellent and must-read Ace of Spades blog. The executive president of one of the nation’s largest teachers unions is under fire for the revelation that her eldest son attends a private school. Teachers unions universally oppose school choice programs that include private schools, and in doing so they deny education opportunities to children whose parents cannot afford to pay for them to leave the deteriorating public schools. This is an especially troubling problem in nearly all the nation’s big cities, where the public schools are plagued by poor student achievement, disorderly behavior in classrooms and other facilities, disastrous teaching methods based on ridiculous fads, and politicized curricula. Denisha Allen, a senior fellow at the American Federation for Children and founder of Black Minds Matter, joins School Reform News to discuss this problem.
