The Supreme Judicial Court denied Karen Read's motion regarding dismissing counts 1 and 3. Trooper Michael Proctor, the lead investigator, is undergoing disciplinary hearings. These hearings are currently ongoing and Day 3 will continue in March. The Re-trial is scheduled for April 1st. The defense is requesting the court to order the prosecution to produce all video evidence and associated metadata in a forensically sound manner. We are still waiting for the defense to file their Motion to Dismiss and the deadline is Feb 20th. Karen Read's motion for expert expenses was denied because the Commonwealth had expressed concerns that the original video footage might not exist. It was revealed that a now retired detective had downloaded selected videos from that day and saved them on a hard drive and possibly a iCloud account. These videos had not been turned over to the defense before the first trial. The Commonwealth has turned over voluminous new discovery to the defense ahead of the second trial, including new experts, expert reports, and full files. The retrial is expected to be a completely different case, with a new accident reconstructionist and a new accident reconstruction process. The “It Ends With Us” lawsuits have a court date of March 9th, 2026. The attorneys faced off in Court on February 3rd, 2025, arguing who started the smear campaign and the judge promptly told them to knock it off. The Blake Lively and Justin Baldoni Federal lawsuits against each other have been consolidated and many issues were addressed. The Joneswork PR vs Baldoni lawsuit was filed on January 27th, 2025, and is a related lawsuit to the consolidated cases. The NY Times hasn’t been served yet and Lively’s attorneys argued that the case may need to be unconsolidated after just being recently consolidated due to The NY Times being a defendant. Lively intends to file a Protective Order on Discovery which is normal for high profile cases. Diddy received a Superseding Indictment which added additional victims to the racketeering conspiracy charges. Shortly after Karen Read’s Hearing on January 31st, 2025, Judge Cannone made a ruling not to do a Daubert Hearing on the defense digital forensics expert, Mr. Green. She had also narrowed a prior ruling regarding journalist Gretchen Voss’ notes allowing most of it to remain private. Sarah Boone wrote a letter to the courts because she said that a Notice to Appeal was not filed on her case. The Court wrote back to her informing who her Appellate Attorney is. According to the Sarah Boone’s Online Docket, it says that the Notice of Appeal was filed on December 18th, 2024 but received by the Clerk on January 31st, 2025. It seems like a clerical error and it should not affect the progress of her case. On January 31st, 2025, the Karen Read case continues with a hearing focused on motions and discovery. The defense argues over expert witness fees due to unavailable evidence, while the prosecution provides updates on new experts and witness interviews. The judge also indicated that a Daubert hearing regarding the defense's expert, Mr. Green, was unlikely and that they would issue an order by Monday. The defense requested more time to file a motion to dismiss, while the prosecution stated that they were still providing discovery to the defense. Kouri Richins, accused of killing her husband with a poisoned Moscow Mule, is back in court on January 23rd, 2025. The defense has filed motions to suppress key evidence, including electronic data, statements made by Kouri, and the infamous "Walk The Dog Letter." The defense argues that this letter is inadmissible because it was obtained illegally. The judge has not yet ruled on the motions to suppress. The trial is set to begin in at the end of April. Surprisingly, Prosecutor Attorney Bloodworth, said that every Law Nerd on the internet calls Docket 214, the "Walk The Dog Letter." Indeed we do. The prosecution has asked for a hearing to determine whether or not Mr. Green, Karen Read's digital forensic expert, can testify. The defense argued that all forensic experts use the same methodology—they take the digital extraction, run it through different tools, and interpret the information. The defense also argued that the prosecution's efforts to prevent the expert from testifying are "dystopian" and "Orwellian." The defense asked the court to deny the motion and not have a Daubert Hearing. The prosecution's police expert, Trooper Guarino, ran Jen McCabe's phone through two different analyzer programs and one program indicated that the Google search was there, and that was not turned over to the defense in the initial report. It'll be interesting to see what happens Friday's hearing and we'll be paying attention to how many times Mr. Alessi says "Orwellian" and if the court brings up the ACCRA experts and the discovery issue. In the ‘It Ends With Us’ Lawsuit Saga, the attorneys are accusing each other of making statements that could prejudice a future jury, and are a breadth away from asking for sanctions. In the Karen Reed case, the defense filed a new motion regarding the waste of their experts' time and shared some new information about what the prosecution hasn’t turned over. Keefe D's Las Vegas prosecution for the murder of Tupac Shakur is moving forward despite his argument that a past immunity offer protects him from prosecution. The court indicated in its ruling that there is no proof of an immunity agreement; we will see if it gets appealed. Kouri Richins was back in court arguing her pre-trial evidence motions similar to Bryan Kohberger. Finally, Bryan Kohberger was in court for two days, covering multiple hearings, and the judge will be ruling on those in the near future. The Bryan Kohberger case held hearings on January 23rd and 24th, 2025. The first part of the hearing was sealed, and the rest were public. The defense argued motions to suppress evidence, including what was gathered from Kohberger's apartment, Amazon account, Apple accounts, cell phone data, and vehicle. The defense also requested a Franks Hearing to determine if there were misstatements or omissions in the affidavits that led to the search warrants. The court indicated that it was not persuaded that the Investigative Genetic Genealogy (IGG) DNA evidence would be suppressed and questioned Kohberger's right to privacy in DNA databases that he had not submitted his DNA to. The court also questioned whether DNA on a knife sheath that tracked back to the defendant was enough for a judge or magistrate to find probable cause for search warrant affidavits. The court warned the state that its expert disclosure work was not done and needed to be supplemented. The judge has been thoughtful in their rulings and has taken charge of the trial, toning down the courtroom theatrics. On Friday, January 17th, 2025, the US Supreme Court upheld as constitutional the law that would effectively ban TikTok if it doesn’t divest from Byte Dance, who operates the app before January 19th. That leads to the app ‘going dark’ on Saturday, January 18th, due to the law, and then surprising users by reinstating some service on January 19th. The Bill allows for a one-time 90-day extension to the Bill's implementation with some very specific carve outs. Let’s take a look at what those are. On Thursday, January 16th, the latest in the saga of litigation stemming from the set of ‘It Ends With Us’ was filed in Federal Court in New York. This suit, which attorney Bryan Freedman had been stating would be filed, sues Blake Lively, her husband Ryan Reynolds, and their PR representative Leslie Sloan and Sloan’s company. The suit alleges essentially the opposite of Lively’s previously filed suit, that it was Lively who contrived a media smear campaign against Baldoni and her complaints of harassment on set was fabricated to use as leverage to ‘take over’ the movie and wrest control from Baldoni as director and Wayfarer as the studio. Both Lively’s suit and Baldoni’s suit now have the same Southern District of New York Judge, and the first date is set in the Baldoni suit. Lively and Reynolds waived service, so their answers are due on March 2nd, 2025. In February 2022, I went over these documents with the Law Nerds before the Court sealed all of the filings and any future activity. Wells Fargo froze Wendy Williams’ accounts and was seeking a guardianship over her finances. Williams filed an emergency petition for a preliminary injunction and temporary restraining order to regain access to her accounts. Wells Fargo claimed it froze Williams’ accounts due to concerns about undue influence and financial exploitation, citing advisement from Williams’ former financial advisor and other unnamed third parties. The court ordered Wells Fargo to show cause why an order should not be entered to unfreeze Williams’ accounts. Wells Fargo filed a guardianship petition and requested that the records be sealed to protect Williams’ privacy. The court granted Wells Fargo’s request to seal the records. Diddy's lawyers filed a document that was later stricken from the docket and resubmitted in a more redacted version due to it containing information that characterized things watched on videos that are subject to a protective order. The government and the victim were displeased with the original filing. The defense argues that they complied with the court's order by filing a more redacted version but believe it's unfair and will result in an unfairly polluted jury pool. They also argue that their characterization of the evidence was appropriate and should not be sealed. The defense's argument that the protective order is too broad is disagreed with, as the protective order is already in place and they should wait for it to change before filing things not under seal. A hearing will likely be held in February to determine if the protective order will be modified, including whether the defense will have digital and physical access to the videos in question. The trial is still expected to be in May, but dealing with digital experts is not a swift process, so it may be delayed. In the Karen Reed case, Trooper Proctor, the lead investigator, faces a disciplinary trial on January 15, 2025, with potential termination on the table. The Commonwealth may exclude the accident reconstruction biomechanical engineers from ARKA, who testified that John O'Keefe's injuries weren't consistent with a vehicle collision. Dr. Russell's testimony that O'Keefe's arm injuries were more consistent with a dog bite than a car accident will be allowed, but the court noted she didn't compare the dog's dentition to the injuries. The Supreme Court heard arguments to uphold the Protecting Americans From Foreign Adversary Controlled Applications Act or strike it down. Elizabeth Prelogar, US Solicitor General, argued that TikTok poses a national security threat and that the ban is necessary to protect American data. Noel Francisco represented TikTok and argued that the ban is unconstitutional and violates the First Amendment rights of its users. Jeffrey L Fisher, TikTok Creators Representative, also made similar arguments. TikTok argued that its algorithm is an editorial decision and that it is a publisher, not just a host of user-generated content. Could this admission remove Section 230 protection from TikTok? This raises questions about the role of social media platforms in moderating content and the extent to which they can be held liable for the actions of their users. Alec Baldwin is suing Kari Morrissey and others involved in the Rust case. The lawsuit stems from Baldwin claiming he was wrongly prosecuted for the accidental shooting death of Helena Hutchins on the set of Rust. The case was dismissed due to prosecutorial misconduct. Baldwin is suing for violation of his civil rights, conspiracy, malicious abuse of process, defamation and other causes of action. Attorney Alex Spiro represents both Baldwin and Jay-Z. The judge in the Jay-Z case has had enough of his antics, who has asked him to tone down his inflammatory language, ad hominem attacks and filing copious amounts of litigation to seemingly drown the other side. The "It Ends With Us" lawsuits are a trilogy of litigation. The lawsuits are centered around allegations of harassment, retaliation, and breach of contract. Stephanie Jones and her company, Jonesworks, are suing Justin Baldoni, Wayfarer, Jennifer Abel, Melissa Nathan, and up to 10 John Does for secretly coordinating a media smear campaign against Baldoni's film co-star, Blake Lively, and then used the crisis as an opportunity to drive a wedge between Jones and Baldoni, and to publicly pin blame for this smear campaign on Jones - when Jones had no knowledge or involvement in it. Justin Baldoni sued The New York Times for an article published on December 21st, 2024 covering a complaint filed by Blake Lively with the California Civil Rights Department. He alleges the Times failed to properly investigate these claims before publishing its article and it is defamatory, constitutes false light, invasion of privacy, promissory fraud, and breach of implied-in-fact contract. Blake Lively filed a lawsuit against Justin Baldoni, Jamey Heath, Wayfarer, Jennifer Abel, Melissa Nathan in New York alleging the same things filed in the California Complaint. We’re not sure why this wasn’t filed in California but think this has to be a strategic advantage. They are evaluating the Defense 'dog bite expert' to determine what testimony will be permitted in the re-trial and the scope of Dr. Russell's testimony. We also learned that the prosecution actually went and found the dog, Chloe, and did measurements on her claws and paws and did molds of her jaws and bites as well. Blake Lively filed a complaint against Justin Baldoni, his studio Wayfarer, and others, alleging sexual harassment and retaliation. The Complaint was filed with the California Civil Rights Department, which is a necessary step before a lawsuit can be filed in the superior court. Blake Lively alleges that Baldoni and his associates hired a crisis PR team to embark on a reputationally damaging social media campaign to protect Bladoni’s reputation from allegations of harassment on set during the filming of ‘It Ends With Us.’ Through his legal team, Baldoni gave a statement to the New York Times stating, “[t]hese claims are completely false, outrageous and intentionally salacious with an intent to publicly hurt and rehash a narrative in the media.” Is this about reputation, is it about retaliation, or is there more to come? During the Alex Murdaugh Murder Trial, Juror No. 787 AKA Egg Lady Juror, was dismissed prior to Closing Arguments. It turned out that she had been talking to people about the case that weren't jurors. That is not allowed. She wrote a book about how she was wrongfully kicked off of the trial called Enough is Enough. She is requesting to unseal the record so that she can prove to the media and bloggers what happened to her was unfair. The Supreme Court of South Carolina denied the motion because when she agreed to see the sealed proceedings, she also agreed to not disseminate it. Diddy is denied Motion Seeking Discovery and Evidentiary Hearing related to alleged case leak information by the government. Diddy is allowed to have access to a laptop that doesn’t have access to the internet so that he can review discovery information regarding his case from his lawyers. Alec Murdaugh filed his full appeal to the South Carolina Supreme Court as they have agreed to take up his case. This can change the standing law of the state that can overturn the verdict. The main grounds for appeal is that an elected official, Clerk of Court, Becky Hill, tampered with the jury. Karen Read is back in court for a Daubert Hearing. Dr. Russell is the Defense Expert Witness and is being questioned by both the Defense and the Prosecution to see if the testimony should come into the Re-Trial. Dr. Russell explained why she thinks the marks on John O'Keefe are specifically from a dog attack which is different than what she said on the stand in the first trial when she said it might be from a dog bite. The Prosecution was not done questioning Dr. Russell but it was time for court to end. It is scheduled to resume on Jan 7th, 2025, at 9am ET. A Daubert Hearing is used to challenge an expert witness. The Judge acts as the gatekeeper of the evidence when determining if there is sufficient reliability for admissibility under FRE 702. The court can examine the methodology and reasoning behind the expert's opinion. Donna Adelson had a Status Conference Hearing on December 10th, 2024, with the new attorneys that are representing her. The Defense and Prosecution proposed the dates of June 16th - July 2nd of 2025. Kouri Richins had a surprise ruling in her case. The Presiding Judge Denied Request for In-person Voir Dire and Jury Selection even thought the Trial Judge allowed the motion. Many defendants pled out in the YSL RICO Case. Only 2 defendants remained - Deamonte Kendrick (aka Yak Gotti) and Shannon Stillwell. Kendrick was found not guilty on all the counts against him, and Stillwell was found guilty only on one count: Possession of a firearm by a convicted felon. Stillwell was sentenced in court to 10 years, only two to serve in jail, and he was credited with time already served and the rest is probation. I'm sure Jeffery Williams aka Young Thug's attorney is kicking himself right now, but it was his defendant's choice to plead open to the court and that needed to be accepted. On Tuesday, November 19th, Diddy had a hearing to go over his concerns with an MDC raid that happened in his cell looking for contraband. The Defense argues that his attorney-client-privileges were trampled on because during the raid some of his legal pads were confiscated and it had the word LEGAL written on them clearly identifying that it shouldn't have been reviewed. The court reviewed the images of the legal pad from the raid and that identification was not visible. There is now a bail hearing on Friday, November 22nd, and the court says that the defense better be prepared to provide context for why that label was not there. The YSL RICO prosecution in Georgia started with jury selection in January 2023. On October 31st, 2024, the case came to a shocking end for the lead defendant, Jeffery Williams, AKA Young Thug. Young Thug’s attorney, Brian Steel, made it clear he wasn’t happy with his clients' choice to plea open to the court without a plea deal secured after negotiations with prosecutors broke down. It became apparent in the hearing that Young Thug wanted to get out of custody and was willing to sign up for an extensive probationary period to accomplish an immediate release from custody. Plus, last week, we learned that the Grand Jury investigating Sean ‘Diddy’ Combs is ongoing and hearing from witnesses. Diddy’s lawyers are pissed that one of those recent grand jury witnesses is speaking to the media and is allegedly ‘shopping’ a video of Diddy before that testimony. The court asked for an immediate response from the defense, and we may soon see a hearing on a Gag Order in the federal prosecution. One of the Juror’s attorney told the media that they witnessed a video of Diddy victimizing celebrities. In one of the Buzbee civil cases, a judge ordered that Jane Doe's name be released or the case will be dismissed. I will go more in depth on Wednesday's 'The Emily Show'. Jeffery Williams, AKA Young Thug, was released from court on Halloween 2024. He pleaded open to the court and the judge gave him 40 years with 5 served in custody, 15 years of probation, then backloaded 20 years if there is a probation violation. I will also go into more detail on this decision on Wednesday. Logan Paul & KSI have been sued by Lionel Messi because they accused Mas + of copying Prime drink’s aesthetic. Messi would like the court to make a decision if they infringe on the trademark and trade dress. The prosecutor in the Menedez Brothers case recommended resentencing. I explain why, if the judge agrees on December 11th, 2024, they will not be let out right away. Sarah Boone was convicted of Second Degree Murder after just an hour and half of jury deliberation. I will cover the sentencing on December 2nd, 2024. Shasta County and its sheriff’s office, agreed to settle the improper seizure of a then 9-year-old girl’s goat called Cedar for $300,000 while Mark Longo’s pets - Peanut the Squirrel and Fred the Racoon - were seized and euthanized by the New York Department of Environmental Conservation.
