Blake Lively filed a complaint against Justin Baldoni, his studio Wayfarer, and others, alleging sexual harassment and retaliation. The Complaint was filed with the California Civil Rights Department, which is a necessary step before a lawsuit can be filed in the superior court. Blake Lively alleges that Baldoni and his associates hired a crisis PR team to embark on a reputationally damaging social media campaign to protect Bladoni’s reputation from allegations of harassment on set during the filming of ‘It Ends With Us.’ Through his legal team, Baldoni gave a statement to the New York Times stating, “[t]hese claims are completely false, outrageous and intentionally salacious with an intent to publicly hurt and rehash a narrative in the media.” Is this about reputation, is it about retaliation, or is there more to come? During the Alex Murdaugh Murder Trial, Juror No. 787 AKA Egg Lady Juror, was dismissed prior to Closing Arguments. It turned out that she had been talking to people about the case that weren't jurors. That is not allowed. She wrote a book about how she was wrongfully kicked off of the trial called Enough is Enough. She is requesting to unseal the record so that she can prove to the media and bloggers what happened to her was unfair. The Supreme Court of South Carolina denied the motion because when she agreed to see the sealed proceedings, she also agreed to not disseminate it. Her attorney fired back that Courthouse Clerk Becky Hill talked about the in camera hearing in her book, Behind the Doors of Justice. I know what I'll be reading during the holiday break! Diddy is denied Motion Seeking Discovery and Evidentiary Hearing related to alleged case leak information by the government. Diddy is allowed to have access to a laptop that doesn’t have access to the internet so that he can review discovery information regarding his case from his lawyers. Alec Murdaugh filed his full appeal to the South Carolina Supreme Court as they have agreed to take up his case. This can change the standing law of the state that can overturn the verdict. The main grounds for appeal is that an elected official, Clerk of Court, Becky Hill, tampered with the jury. Becky Hill’s 76 Ethics Complaints are on hold while the criminal investigation is in progress. Karen Read is back in court for a Daubert Hearing. Dr. Russell is the Defense Expert Witness and is being questioned by both the Defense and the Prosecution to see if the testimony should come into the Re-Trial. Dr. Russell explained why she thinks the marks on John O'Keefe are specifically from a dog attack which is different than what she said on the stand in the first trial when she said it might be from a dog bite. The Prosecution was not done questioning Dr. Russell but it was time for court to end. It is scheduled to resume on Jan 7th, 2025, at 9am ET. A Daubert Hearing is used to challenge an expert witness. The Judge acts as the gatekeeper of the evidence when determining if there is sufficient reliability for admissibility under FRE 702. The court can examine the methodology and reasoning behind the expert's opinion. Donna Adelson had a Status Conference Hearing on December 10th, 2024, with the new attorneys that are representing her. The Defense and Prosecution proposed the dates of June 16th - July 2nd of 2025. The judge said that he'll have to check with his wife about his personal calendar but that they will have a follow up hearing on February 11th, 2025, at 2:30pm ET to see how discovery is going and if they will be ready for a trial. Diddy’s Defense filed a Motion to Suppress findings in his laptop and other motions. I will go more in depth this Wednesday on The Emily Show. Haliey Welch AKA Hawk Tuah Girl, was confronted by Coffeezilla for allegedly doing a Crypto Scam. The movie Wicked is sued for misprinting their website on toy packaging; directing them to an adult site. The United States Court of Appeal agreed that TikTok’s parent company, ByteDance, must divest from foreign adversary countries in order to do business in the USA. The next step would be to appeal to the Supreme Court. This year’s Spotify Wrapped is causing uproar over its results. Kouri Richins had a surprise ruling in her case. The Presiding Judge Denied Request for In-person Voir Dire and Jury Selection even thought the Trial Judge allowed the motion. Her defense will most likely appeal, but will this be rectified by the time it goes to trial in May 2025? Unsealed Search Warrant also revealed that Kouri Richins asked her handy man for fentanyl. The handyman turned over his phone but tragically died in a motorcycle accident in September of 2024. Will the prosecutors be able to bring the text message evidence into trial? Many defendants pled out in the YSL RICO Case. Only 2 defendants remained - Deamonte Kendrick (aka Yak Gotti) and Shannon Stillwell. Kendrick was found not guilty on all the counts against him, and Stillwell was found guilty only on one count: Possession of a firearm by a convicted felon. Stillwell was sentenced in court to 10 years, only two to serve in jail, and he was credited with time already served and the rest is probation. I'm sure Jeffery Williams aka Young Thug's attorney is kicking himself right now, but it was his defendant's choice to plead open to the court and that needed to be accepted. On Tuesday, November 19th, Diddy had a hearing to go over his concerns with an MDC raid that happened in his cell looking for contraband. The Defense argues that his attorney-client-privileges were trampled on because during the raid some of his legal pads were confiscated and it had the word LEGAL written on them clearly identifying that it shouldn't have been reviewed. The court reviewed the images of the legal pad from the raid and that identification was not visible. There is now a bail hearing on Friday, November 22nd, and the court says that the defense better be prepared to provide context for why that label was not there. Russell Lucius Laffite was one of the bankers that worked with Alec Murdaugh to steal money from his clients. He's been granted a new trial because the court removed an alternate without giving the defense an opportunity to object without the defendant present. He will most likely be out on bail like the last trial. I'll keep an eye on it and let you know when a new hearing is scheduled. This is a federal case, so it won't be televised. In a Memorandum Decision and Order, a judge found that the TikToker misrepresented the facts of the case when stating that the judge who found her liable for defamation was biased. The case will go back to the same judge who ruled on the summary judgement and will have a hearing on damages. I pull up the lawsuit and break down that it is still ongoing and in the settlement conference phase, but no conclusion has been made. When watching the episode, it is later revealed that Shannon was saying that she won a defamation lawsuit against John Bellino. Kouri Richins is also back in court. She has been denied bail again, but she has won a motion to sever the murder charges from the financial charges. Judge King usually live streams his court proceedings. It has been uncovered that he sometimes has the YouTube chat open and will post comments to the live chat. Judge King also has a Civil case against him for doing a "Scared Straight" version on a 15-year-old girl that was at the court for a field trip. The student had a hard time staying awake at court and the judge found that disrespectful to him and proceeded to do a mock trial to her based on her behavior. The Laken Riley Murder trial has begun and many people have questions about where the jury is. This is a Bench Trial where the judge is the finder of fact. Cross Examination of the Lead Investigator ended, and the State rested their case. The Defense argued dismissal of the case, but the judge denied it. Sarah Boone then took the stand. After the first part of her testimony, her Defense argued there were overt acts in order to present a battered spouse syndrome to the jury. The motion was granted. The headlines are saying that Alex Murdaugh settled the Mallory Beach Boat Crash case. I break down the settlement filings to get a complete understanding of what happened with this case. We are still waiting on rulings with regard to 'Courthouse Becky’s' case. Charlie Adelson is requesting a new trial because his attorney, Mr. Rashbaum, who represented him during the trial where he received a guilty verdict, had previously represented his mother, Donna Adelson, during the investigation process of the case. This conflict of interest with an attorney could cause a problem during the appellate process and I will keep an eye on what decision will be made in the future. Tom Girardi is also asking for a new trial on the basis that he was not competent to stand trial during that time. Tanya McAlpin, a person who was hired by the Girardi family to transport him from the living facility to the court, wrote an affidavit explaining that he would say things and behave in ways that showed he was not aware of what was going on. Opening Statements in the Sarah Boone Trial were presented by both the Prosecution and Defense. The State was able to get through 10 witnesses on Day 1 which is an impressive feat. Among the civilian witnesses were Jorge Torres's Bother, Sarah Boone's Ex-Husband and the apartment neighbors. The state was able push in a lot of evidence through witnesses like the 911 operator, the assistant store manger, deputy sheriffs at the scene and the CSI forensic biologist. The defense said that Sarah Boone is expected to testify next week. If the first day is any indication of the speed of the evidence, the trial might be done before the three weeks the judge has allotted. She claimed that they were playing around while she was drunk and put him in a suitcase and accidently forgot about him overnight. She called the police after she found him dead from suffocation. The police went through her phone and found a video of Jorge pleading with her to release him from the suitcase because he couldn’t breathe. Boone instead taunted and laughed at Torres. She was arrested in 2020 and has remained in custody. Boone has had 8 public defenders and had to represent herself because she would not work with her appointed representation. Boone put out an advertisement and managed to get a private attorney to take on her case. Last week, she rejected a plea deal for the lesser charge of manslaughter serving 15 years. Sean Diddy Combs is facing six new civil cases filed against him by attorney Tony Buzbee, with more on the way. These cases will be added to the federal criminal case if there is sufficient evidence. Diddy’s attorney defended his client stating that they have full confidence in the fact that he didn’t do the things claimed in the lawsuits. His attorney’s will most likely claim that Diddy cannot adequately represent himself from the barrage of civil litigation while in custody. We’ll see what the judges will rule in early November. Bryan Kohberger is set to start trial in August 2025, and Sean ‘Diddy’ Combs is set for trial in May 2025. It’s unlikely that Diddy will go to trial in May as scheduled due to the amount of digital evidence in the case. Diddy is still trying to be released from custody and is asking to have his appeal argued in early November. Even when cases go to trial, it doesn’t mean they are done as Alec Baldwin has been learning. High-profile Houston attorney Tony Buzbee did a press conference stating that he will be bringing individual civil cases against Sean Diddy Combs. So far, he has accepted 120 clients and plans to file them within 30 days. He said that some of the victims were as recent as 2024 and one victim claims that they were as young as 9 years old when they were assaulted by Diddy. The evidence after two trials seems clear that Lyle and Erik Menendez murdered their parents in Beverly Hills in 1989. They were convicted after their second trial in 1996. The brothers filed a Habeas petition asking the court to vacate the conviction based on new evidence. On Thursday, 10-3-24, District Attorney Gascon stated there will be a hearing at the end of November. Tupac’s family hired Alex Spiro, Alec Baldwin’s attorney in the Rust case, to investigate to see if Diddy has any connection with the murder. Now that Diddy is in custody, that investigation may be easier to do. It would be natural to question Keefe D and Suge Knight. I will cover more Diddy updates in this week’s podcast. Alex Murdaugh was sentenced federally for conspiracy to commit wire fraud, bank fraud, and money laundering. Murdaugh made a plea deal with the feds to plea guilty because he had already admitted to the crimes during the the state's murder trial. The judge sentenced him to 40 years which was more than the prosecution recommended. The judge said they did this to send a message to deter attorneys who may want to steal from their clients. Alex Murdaugh Appealed the sentencing but the government dismissed it because part of the plea was that he would not appeal the decisions that would be made. Karen Read's attorneys filed their Opening Briefs to the Supreme Judicial Court in Massachusetts. The prosecution's response is due by October 16th and then Read will have a chance to reply by October 25th. Oral Arguments will most likely be at the end of November 2024 to hopefully get a decision by December 2024. There is a high likelihood that the defense will ask for the retrial to be scheduled further out. The Baby Reindeer Civil Lawsuit has a trial date set for May 2025. Netflix has filed a request for Dismissal and Anti-SLAPP. Netflix provided a Declaration from Richard Gadd many exhibits proving Fiona Harvey sent Richard Gadd harassing emails, text messages, voice mails, and also accusations of stalking a Member of Parliament's wife. These exhibits show that Harvey did do the things detailed in the mini-series but was not a "beat-by-beat" recount of what happened. The Judge denied the Anti-SLAPP motion but granted in part the motion to dismiss, reducing some of the causes of action, leaving only the Defamation and Intentional Infliction of Emotional Distress. MrBeast's Beast Games and Amazon Prime have a class action lawsuit filed against them in California. This is interesting because the production happened in Nevada but the plaintiffs live in California. We'll see if jurisdiction will be granted in this case. Let me know if you want a deep dive into these claims. Diddy's attorney did an interview with TMZ and claimed that Costco had a sale on baby oil which is why he stocked up. Costco put out a statement clarifying that none of the US stores carry baby oil. It is also reported that Diddy's new roommate is Sam Bankman-Fried while he is in the Metropolitan Detention Center. Bryan Kohberger had his first hearing with the new judge and venue. It was more of a status conference and the trial might get pushed to September 2025. Judge Steven Hippler made it clear that he wasn't happy to be there and will work faster than they are used to. Hannah Gutierrez was in court to see if she could get her case dismissed or recieve a new trial. If Gutierrez is granted a new trial she will immediately be released from custody and the defense will request that a new special prosecutor will be assigned to the case. The judge listened to the defense and the prosecution and took it all under submission and promised to make a ruling in a week. The 11th Circuit came back after oral arguments on the Todd and Julie Chrisley's Appeal and upheld the trial court's actions. They did however send Julie's case back to resentencing and her attorney argued that she should get five years instead of seven. The judge kept it at seven years stating that she already has below the federal minimum. Unfortunately, that puts her back to the same place.
