Ep 8Supreme Court Dismisses Emoluments Lawsuits. So Let's Add "Emoluments" to Trump Crimes Commission

Attorneys General of Maryland and the District of Columbia, as well as the nonprofit organization Citizens for Responsible Ethics in Washington (CREW) sued Donald Trump for his obvious and chronic violations of the emoluments clause of the Constitution (personally profiting from his office). The trial courts refused to dismiss the cases but Trump engaged in endless appeals and delays. When the cases finally made it up to the Supreme Court, the court dismissed the cases as moot because Trump is no longer president. This does little more than reward Trump for his endless delays. Sadly, the Supreme Court could have and should have relied on its own guiding principle of deciding - rather than dismissing - a case, that is "capable of repetition yet evading review." This unjust development reinforces the need for a Presidential Crimes Commission, as Congressman Eric Swalwell has called it, or a Trump Crimes Commission, as I have called it while sharing a panel with Rep. Swalwell. Given the Supreme Court's unfortunate dismissal, the emoluments issue must now be put on the Crimes Commission's agenda. The first Senate impeachment of Donald Trump was anything but a trial: no witnesses, no documents, no evidence, no testimony. Indeed, half of the Senators refused to hold Trump accountable for crimes and abuses he committed in plain sight. But if Senate Impeachment Trial part one was an embarrassment, just wait until Senate Impeachment Trial: The Sequel. Every single senator - the jurors - has a disqualifying conflict, as they are either witnesses, victims or possible instigators/perpetrators themselves. In my 30 years as a federal prosecutor I participated in jury selection hundreds of times. The first rule of jury selection is that each juror must be able to decide a case fairly and impartially, with absolutely no stake in the result. Now obviously, an impeachment trial is a political proceeding, not a criminal trial. But to suggest that senators who are witnesses to the insurrection, victims of the insurrection or enablers of the insurrection, can sit as fair jurors is pure folly. In short, accountability and justice can not be achieved in a Senate Impeachment "trial." Accountability - justice - can only be achieved in a criminal trial. Ep 2100 Trump Pardons: What Does the Supreme Court Say About the Implications of Accepting a Pardon?

It's being reported that Trump is preparing to issue as many as 100 pardons. This surprises exactly no one, as it's a fitting last act of a president who has been largely lawless during his four years in office. But what are the consequences for the people who decide to accept a pardon from Trump? The Supreme Court answered that question in 1915 in the case of George Burdick v. The United States. Mr. Burdick was the editor of the New York Tribune who refused to accept a pardon from President Woodrow Wilson. The Supreme Court ruled that Mr. Burdick was well within his right to refuse the pardon because accepting a pardon carries with it "an imputation of guilt and a confession" that you committed the crime for which you are pardoned. Ep 5The Upcoming Durham Report, Election Interference and Other Bill Barr Abuses

Bill Barr tasked U.S. Attorney John Durham with going on a witch hunt - investigating the Trump-Russia investigators - in efforts to undermine the origins of the Russia investigation, notwithstanding the fact that the Mueller Report AND the DOJ Inspector General (IG) Horowitz report AND the Senate Intelligence Committee reports all concluded that the Trump-Russia investigation was properly opened. Barr is looking for a different answer - one that helps Trump and hurts Biden. Hence, the Durham investigation. One of Durham's top prosecutors, Nora Dannehy, abruptly resigned due to Barr pressuring Durham to issue an interim report PRIOR TO the election. Barr conduct is dead wrong in two ways: first, prosecutors do not issue reports. In my 30 years as a federal prosecutor, I never once issued a report. Second, nothing should be done by prosecutors within 60 days of a presidential election that could impact public opinion about the candidates. Barr violates all DOJ norms, protocols, traditions and ethical standards by pressuring Durham to issue an interim report so close to the election. Ep 4How to Defeat Trump/McGahn/Barr's Weaponization of the Courts

EDITED: I mistakenly state that election day is "November 4, 2020." It is November, 3, 2020. My apologies for the error. Trump and his nefarious associates believe they have perfected exploiting the delay in the court system to run out the clock and never be held to account. The fix is not as difficult as you might think. There's an abundance of specialized courts created to deal with specific types of cases. For example, there are drug courts, mental health courts, juvenile courts and domestic violence courts. In federal district court in Washington, DC, for example, there is reentry court. Creating these courts do not require an act of Congress. It simply takes the judicial branch--a co-equal branch of the government--to recognize a particularized need in the criminal justice system and instituting common-sense rule changes to address the need. If there was ever a need to address a deficiency, it is in the way nefarious actors exploit the delay inherent in the system. DC federal district court can easily remedy this weakness by creating an Inter-Branch Dispute Court (IBDC). When legal disputes erupt between the executive and legislative branches, like the need to enforce the House of Representatives' subpoena for Don McGahn's testimony in the impeachment inquiry, the IBDC can give the parties 72 hours to file their briefs, another 72 hours to present their oral arguments and the court decision would be entered within 72 hours of the conclusion of those arguments. The appeals court can follow the same 72/72/72 time table. Justice can be done in a matter of weeks, as opposed to the Trumps and McGahns of the world delay justice for months or years. This common sense approach to fixing a procedurally broken judiciary is a must for the health of our democracy.
