Thriller Rundown: Tether Bomb is Dismantled

NY AG’s $850M Probe of Bitfinex, Tether Ends in an $18.5M Settlement

In a closely watched case with wide-ranging implications for the crypto market, Tether has admitted no wrongdoing and will provide reports on USDT’s reserve composition for two years.

news coming from Nikhilesh De via CoinDesk

In a statement, New York Attorney General Letitia James said, “Bitfinex and Tether recklessly and unlawfully covered up massive financial losses to keep their scheme going and protect their bottom lines. Tether’s claims that its virtual currency was fully backed by U.S. dollars at all times was a lie.”

The settlement may help resolve, one way or another, a question that has long bedeviled the entire $1.6 trillion global cryptocurrency market. By requiring Tether to provide a greater level of transparency than ever about the backing of its USDT stablecoin – a foundational piece of crypto’s plumbing – the arrangement could replace whispers and conjecture with regular data.

New York’s attorney general sued Bitfinex and Tether nearly two years ago.

Today, they settled for $18.5 million. Tether and Bitfinex have to pay $18.5 million in fines and, perhaps more damaging, cease all trading activities in New York State.

For the next two years, they’ll also be required to submit quarterly reports about how much money they have in their reserves, as well as how they’re working to exclude New Yorkers from their services.

The Attorney General has also mandated that Tether and Bitfinex include information about transfers of funds, along with “verification that Bitfinex and Tether have appropriately segregated client, reserve, and operational accounts.”

Bitcoin Completed a -20% Correction. Bitcoin prices jumped more than 10% after the announcement.

Tesla disclosed its bitcoin purchase in its latest annual report, saying the move aims to “diversify and maximize returns on our cash that is not required to maintain adequate operating liquidity.” Tesla said a board committee had approved changes to company rules on investments, adding that it can also invest cash in gold bullion and gold exchange-traded funds among other assets.
News reported from Danny Nelson via CoinDesk

A dipping of toes…

BlackRock, the world’s largest asset manager with $7.81 trillion under management, appears to have granted at least two of its funds the ability to invest in bitcoin futures.

Prospectus documents filed with the U.S. Securities and Exchange Commission Wednesday indicate that BlackRock Global Allocation Fund Inc. and BlackRock Funds V are at least eyeing bitcoin. They both include the world’s oldest cryptocurrency on their lists of derivative products cleared for use.

BlackRock did not state which commodity exchange it will choose to execute these crypto futures buys. However, the funds may only invest in cash-settled bitcoin futures. CME is the only exchange registered with the Commodity Futures Trading Commission (CFTC) that offers similar futures products at this time. The filings warn that investments in these futures could carry illiquidity risks due to the “relatively new” market. Regulatory changes, volatility and valuation risks could similarly weigh on the price and thus “adversely impact a Fund.”

The filings appear to mark BlackRock’s entrance into the bitcoin market.

Before Wednesday, the investments giant has never so much as mentioned “bitcoin” in any of its regulatory filings. Thriller Rundown: Bitcoin 146K EOY? JPMorgan Thinks So!

JP Morgan Bets Big on Bitcoin

news coming from M. Corey Goldman via The Street

In a research note to clients, analysts at JPMorgan Chase predicted a long-term bitcoin price target of more than $146,000 based on the assumption that the cryptocurrency will grow in popularity as an alternative to gold, which has traditionally been used as an inflation and volatility hedge, as well as protection against a falling U.S. dollar.

“A crowding out of gold as an ‘alternative’ currency implies big upside for bitcoin over the long term,” wrote JPMorgan Chase strategists led by Nikolaos Panigirtzoglou. However, “a convergence in volatilities between bitcoin and gold is unlikely to happen quickly, and is in our mind a multiyear process.

TradingShot Chart via Trading View

“This implies that the above $146,000 theoretical bitcoin price target should be considered as a long-term target, and thus an unsustainable price target for this year,” they said.

US Federal Regulator Says Banks Can Conduct Payments Using Stablecoins

news coming from Nikhilesh De via CoinDesk

Brian Brooks, the Acting Comptroller of the Currency, said in a statement that while other nations have built real-time payments systems, the U.S. “has relied on” the private sector to create such technologies, seemingly endorsing the use of cryptocurrencies – specifically stablecoins – as an alternative to other real-time payment systems.

Brooks has overseen the publication of two other interpretative letters and a number of other crypto-friendly moves during his time overseeing the agency, including a letter telling federal banks they can provide services to stablecoin issuers and store reserves for stablecoins.

Last month, Brooks announced his support of a letter by the President’s Working Group on Financial Markets that outlined how stablecoins should be regulated within the U.S.

President Donald Trump has twice nominated Brooks to serve a full five-year term heading up the agency, including earlier this week. However, it’s unclear whether the U.S. Senate will schedule a confirmation vote. As of press time, it does not appear likely it will do so before President-elect Joe Biden takes office on Jan. 20.

Bitcoin Fighting Regulators 👀

news coming from CoinDesk

11th hour?A comment period for a proposed set of rules that would increase reporting requirements for crypto exchanges and minimize blockchain user privacy closed yesterday, with many major crypto firms rejecting the maneuver.

Spearheaded by the U.S. Treasury Department in December, but shaped primarily by the global Financial Crimes Enforcement Network (FinCEN), the set of rules would see exchanges implement know-your-customer (KYC) requirements for transactions sent to unhosted wallet addresses, or addresses that exist outside a centralized or custodial setting.

This would mean many types of personal wallets as well as counterparties to exchanges’ customers would need to be identified. Reporting limits would be set for private wallets that receive more than $10,000 in 24 hours, and record-keeping rules for transactions valued at over $3,000. Tech-savvy people are not likely to stop looking for alternatives, until they find or invent one. And stepping in to regulate the digital currency boom, as some governments are already considering, may only accelerate this populist revolt,” he says.

Other Bullish News…

Ray Dalio, the founder of the world’s largest hedge fund, Bridgewater Associates, has offered a more positive stance on bitcoin than in comments that made headlines last month.

In a Reddit Ask Me Anything (AMA) on Tuesday, Dalio said he thought bitcoin and other cryptocurrencies had “established themselves” over the last 10 years and were interesting “gold-like asset alternatives” share similarities and differences to gold and various “limited-supply, mobile (unlike real estate) store holds of wealth.” Bitcoin “could serve as a diversifier to gold and other such store hold of wealth assets,” said Dalio. “The main thing is to have some of these type of assets … including stocks, in one’s portfolio and to diversify among them.”

Bitcoin has become the largest bank in the world for the first time, overtaking JP Morgan in market cap after it rose above $18,900.

That gave bitcoin a market cap of $350 billion, an all time high, beating JP Morgan’s $349 billion.

Bitcoin to 21K still?

Bitcoin Chart by TradingShot via Trading View

Long-Term Holders Are Selling BTC

via Glass Node Insights

And while it has yet to dip its toes in the crypto market, some of the firm’s top executives have previously spoken positively about cryptocurrencies.

The upside predictions are not humble either. Just last month, BlackRock CIO Rick Rieder went as far as stating that Bitcoin could replace gold and was “here to stay,” adding the asset showed incredible staying power and was generally well received by millennials, as opposed to the yellow metal.

Larry Fink, CEO of asset management firm BlackRock, said in a speech at the nonprofit body Council of Foreign Relations earlier this week that Bitcoin had “caught the attention and imagination of many people” and was poised to grow as an asset class.

Mentioned during episode. 👇

The Herd is Still Coming in 2021

news coming from Frank Chaparro via The Block

Lookout 👀Stablecoin Bill entered into Congress

news coming from Jeff Benson via Decrypt, Naomi Brockwell of NBTV

Three members of Congress have proposed a bill to regulate stablecoins.

The STABLE Act would hold stablecoin issuers to some of the same standards as banks.

Some cryptocurrency advocates think it will stifle innovation and further marginalize underbanked communities.

It's the dying days of the 116th Congress, which ends on January 3, 2021. Thriller Insights: BitMEX, Bitcoin and 3 Missing Men

news via CoinDesk & Decrypt

U.S. regulators and law-enforcement officials brought charges on Thursday against BitMEX, a Seychelles-based cryptocurrency exchange that has grown in recent years to be one of the industry’s biggest players.

According to the U.S. Commodity Futures Trading Commission, prosecutors accused BitMEX of facilitating unregistered trading and other violations, including “conducting significant aspects of its business from the U.S. and accepting orders and funds from U.S. customers,” as reported by CoinDesk

The news dominated cryptocurrency news headlines and sent traders and analysts scrambling to assess the damage and implications. Some 23,000 bitcoin were apparently withdrawn from BitMEX addresses in a single hour

One of the defendants involved in the BitMEX case went as far as to “brag” that “bribing” regulators in a jurisdiction outside the U.S. cost just “a coconut,” according to a statement by FBI Assistant Director William Sweeney Jr.

“One thing I know with regulators is, if you say things that are antagonistic in discoverable information places, you’re much more likely to be punished than people who do something very similar but keep their nose clean and not say anything and act respectfully,” Weisberger said.

The company has continued with normal operations and has vowed to fight the charges.

What I am thinking…

This has been coming for a while now, and while the charges are heavy and coordinated, we were well aware BitMEX was under scrutiny and it was just a matter of time.

CFTC alleged that BitMEX received some $11 billion in bitcoin deposits and made more than $1 billion in fees, “while conducting significant aspects of its business from the U.S. and accepting orders and funds from U.S. customers.”

This has more to do about controlling price discovery, and the CFTC knows this. Definitely a shot across the bow to overseas cryptocurrency exchanges that might be cutting corners on compliance.

Regulated commodities exchanges in the U.S. also typically offer trading leverage, but the most common bitcoin futures contract, from the Chicago-based CME, only allows positions with about three times the initial money down. Look for an uptick from here on out.

Bitcoin Chart by TradingShot via Trading View

Bitcoin has declined from $10,900 to $10,400 in the past 24 hours. More than 32,200 BTC (worth around $337 million) has been moved from BitMEX – 19% of the exchange's total funds, according to data source Glassnode. Bitcoin traders continued outflows from BitMEX Friday afternoon.

Open positions in bitcoin perpetuals (futures without expiry) traded on BitMEX have also declined by nearly 22% from $592 million to $462 million, according to data provided Skew, a crypto derivatives research firm.

However, liquidity, as measured by the bid/offer spread, on the exchange remains relatively stable, and the large trades can still be executed at low cost. Bid-offer spreads on other exchanges also remain stable.

Total inflows to exchanges averaged 65,000 bitcoin this last week, so BitMEX withdrawals are adding 25% more liquidity already. More than 65% of the total outflow has been transferred to other exchanges, while the rest into un-hosted wallets.

About 170,000 in Bitcoin or $1.8 billion, had been held in the BitMex wallets, according to Glassnode.
