What would the Founding Fathers think about today's surge in illegal immigration at the Southern Border when it comes to the Second Amendment. "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed". United States v. Rahimi - Gun Guy 05 06 23

2nd Amendment Rights defender Guy Relford is one of the few coming in support of the 5th Circuit Court of Appeals U.S. v. Rahimi, a post-Bruen Second Amendment ruling. To the layman, it appears that the court is okay with dangerous domestic abusers having the right keep their weapons that they will ultimately use against their victims. But the ruling is far more nuanced than that. The ruling maintains that one's Second Amendment right cannot be infringed if they have not been convicted of a crime. Domestic orders of protection aren't necessarily a result of a crime that has been committed. The 5th Circuit has ruled that the order of restraint alone cannot erase one's 2nd Amendment rights. Is President Trump an Enemy of the 2nd Amendment - Gun Guy 4 22 23

Fresh off of attending the annual NRA meeting in Downtown Indianapolis last week, Guy Relford talked about the speakers he saw there. Former President Trump was the most prominent of the speakers. While the show was winding down, Guy talked about a message he received on Twitter stating, "I'm surprised President Trump got an enthusiastic response from the NRA members since he's an enemy of the 2nd Amendment." Guy responds that he understands where this individual is coming from. First off, President Trump after the Las Vegas mass shooting directed the ATF to find a way to ban Bump Stocks. President Trump set a precedent we don't like. After the Parkland mass shooting, President Trump was talking about a national red flag law. One of his cabinet members, or a member of congress responded, "what about due process". President Trump said, "Take the guns first, due process comes later.", and a whole bunch of us said "Whoa, hold on.. I have a problem with that." Guy ends the discussion with the argument that there may be other candidates in 2024 that a have a stronger record on the 2nd Amendment than the former President. Guy can see that. Noem signed an executive order Friday that blocks state agencies from signing contracts with financial institutions that she says have discriminated against the firearms industry. Our own Indiana Republicans have not been successful getting similar legislation passed. Todd Rokita - Gun Guy Show 04 15 23

Indiana Attorney General Todd Rokita joins the Gun Guy Show to talk about his lawsuit with other states against the ATF and Attorney General Merrick Garland regarding their Pistol Stabilizing Brace rule. The new regulations require anyone using pistols with stabilizing braces to provide their fingerprints to the ATF, be registered in a federal database and pay applicable taxes, among other things. The overriding concern regarding registration, is that registration leads to gun grabs. Rokita has been a big defender of Hoosiers' 2nd Amendment rights, and this is a great fight to have. Daniel Perry murder conviction in Austin, Texas - Gun Guy 04 08 23

Guy talks about the case of Daniel Perry, an army sergeant convicted of murder in Austin Texas. Perry shot and killed Garrett Foster who approached his car with an AK-47 rifle during the George Floyd riots in 2020. While it may be an obvious case of self-defense on Perry's part, Guy discusses the mistakes Perry made prior to the fatal shooting that led to his conviction. Guy talks about the rules that preclude a defendant the argument of self-defense. The prosecution was able to submit into evidence social media posts that Perry made that worked against him in his trial. The prosecution pointed out that Perry chose to drive towards a protest, when he could have avoided it. Guy points out that while one has the right to be in a dangerous situation, it's not necessarily smart to do so. "There's legal and then there's smart... You don't ever go to jail for a conflict that never happened." Perry's posts helped the prosecution make the case that he was looking for a conflict, which led to his conviction. In the first hour, Indiana Rep Jim Lucas calls in to discuss his bill HB 1177, which would create specialized firearms safety, education, and training curriculum for teachers, school staff, and school employees. Lucas dispels some of the disinformation out there regarding his bill. Critics of such bills often make the argument that such bills would turn our schools into the Wild West. But Lucas disagrees and says it does quite the opposite. For about the same price of resource officer, 40 staff members could be properly trained with a firearm. Armed teachers and staff make a potential shooter less likely to act, since he won't know who is armed. Lucas adds that it's just misguided to rely on the police to protect our children. In fact, courts have ruled that they are not obligated to. "Our highest courts of the land have ruled that we are on our own" says Lucas. In the second hour, Guy talks about the case of 23-year-old Walter Oliver who was arrested inside Castleton Square Mall on an allegation he had a handgun with Glock switch inside. Carrying a firearm inside a mall is not against the law, as evidenced in the Greenwood Mall shooting. So, was the arrest of Oliver on the suspicion he was packing against the law?
