Ep 272Lawyer Talk Roundtable - Buckeye Firearms Foundation's Jim Irvine

E

On Tuesday, May 31, 2022, Buckeye Firearms Association presented testimony in the Senate Veterans and Public Safety Committee supporting HB 99 to expressly exempt persons authorized to go armed within a school safety zone from a requirement to complete extensive peace officer basic training and return authority over security to local school boards. The bill was amended to include annual criminal background checks for those carrying firearms in schools and also amended to incorporate Senate Bill 168, which creates a mobile training program. Members voted on party lines to pass the bill out of committee 4-2.This was the second hearing for this legislation, sponsored by State Representative Thomas Hall (R-Madison Twp.). There were many opponents to the bill testifying, most of whom appeared to oppose guns in schools even in the hands of trained personnel, or wanted severe gun control in place instead, such as AR-15 bans.On this Lawyer Talk Roundtable, we talk with Jim Irvine from Buckey Firearms Foundation about this, and the Faster Saves Lives program.

Ep 269Special Guest Ohio Secretary of State Frank LaRose

E

Ohio Secretary of State Frank LaRose will be coming in via technological advancement, on our Lawyer Talk phone. And we're going to talk to him about all sorts of things electoral-related. He is the Secretary of State for the state of Ohio. And for those who don't know what the Secretary of state does, the Secretary of State monitors, maintains, and counts the votes. They do elections. They also accept corporate filings. So if you want an LLC and you happen to be curious about that, you can go to the Secretary of State and they'll walk you through it. But that's not what we're really curious about. We want to know what's going on with Ohio's mules. I don't know. But we're going to talk to Frank LaRose in all seriousness about Ohio's elections, what Ohio has done to maintain safe, fair, and secure elections, and what Ohio has done to make sure everybody gets a chance to vote. Everybody who should vote does vote, and those who shouldn't, don't. And make sure that each vote is counted and not too many votes are counted. In other words, what are we doing right and what is everybody else doing wrong? Frank is going to tell us.VoteOhioRecorded at Channel 511.Stephen E. Ep 263Lawyer Talk Q & A - Wait, We Had A Contract!

E

A question from "Morningstar.""In the movies, it seems you can get away with anything if you have a contract allowing you to do it. If we both agree to sign a contract that allowed me to shoot you in the foot and I gave you 1 million in return, would that be legal? Now let's say you feel that you are a woman trapped in a man's body, and as a legal general surgeon, you pay me to remove functional parts of your body because you feel you no longer need them, and we make a contract to do just that. Is that legal? What if we made a contract for your life for a billion dollars given to your family? Would that be legal? Then let's twist it slightly and say you're dying from cancer and you begged me to euthanize you and we put it into a contract. Would that be legal?"A lot to unpack. Ep 256Lawyer Talk Q & A - Sovereign Citizens Society

E

A question from Jack."In the United States, there are some laws that, even though they are long-established, can sometimes be found unconstitutional. Do sovereign citizens have a validity to their argument of not having to get a driver's license to drive a car, car insurance and plates on their vehicle, making their own custom plates or not paying their taxes? Part two, have you ever defended a sovereign citizen before? And part three, if you have a client who is a sovereign citizen who got charged with crimes for not having a driver's license, car insurance, legal plates on their vehicle, but your client demands that you defend him as innocent because he genuinely believes that he is operating under separate laws, how would you handle his case?"The answers in this episode.Got a question you want answered on the podcast? Ep 254Lawyer Talk Roundtable - New Ghost Guns Law

E

What is the new ghost gun law from the Biden Administration? To help reduce the number of unmarked and hard-to-trace “ghost guns,” the rule establishes requirements for federally licensed firearms dealers and gunsmiths to have a serial number added to 3D printed guns or other un-serialized firearms they take into inventory. What are ghost guns made out of?Ghost guns, however, are made of parts and are then assembled together. The critical component in building an untraceable gun is what is known as the lower receiver. Some are sold in do-it-yourself kits and the receivers are typically made from metal or polymer. The kicker? Ghost guns are more expensive than buying a gun through normal channels. So why new legislation? That's what we talk about at The Round Table - and so much more.Recorded at Channel 511.Stephen E. Ep 248Our Special Guest J.D. Vance

E

J.D. Vance is the author of Hillbilly Elegy. It's his memoir, written about his upbringing and his transition into adulthood and into Yale Law School, after a very difficult, very challenging upbringing and child in poverty. With Appalachian, Scots Irish culture, you say he grew up in anything but traditional. And that's true for professional class people. He's anything but traditional in that sense. There are so many people who are impoverished in West Virginia, in Appalachia, Ohio, and in Kentucky, that for them, it's a lifestyle that the rest of us are unaware of. And J.D'.s book really brings that to the forefront. It's a remarkable insight into that culture. And then he attends Yale Law School, where he had to learn the whole new elite language. He has incorporated his background, his upbringing, and what he has seen in both worlds and come to a really solid foundational philosophy on government, on society, on America. He's running for a United States Senate seat, one of the two seats that each state gets in the United States Senate. He's running for one of those two seats here in Ohio, the seat that's being vacated by the retiring Rob Portman. We know you'll learn more about J.D. in just this short time we get to talk with him. S5 Ep 245Lawyer Talk Q&A - Guilty, Not Guilty and No Contest

E

From one of our listeners...In my state, you can plead three different ways, not guilty, guilty, and no contest, the judges seem to treat a no contest and a guilty plea as if they are the same thing; is it just a matter of semantics? Or is there a real legal difference? If a judge constantly oversteps their bounds or makes a major legal blunder, is there a legal process of having that judge reprimanded or removed? And does this ever happen in reality? Thanks for the question Sarah!Got a question you want answered on the podcast? Call 614-859-2119 and leave us a voicemail. Ep 244Lawyer Talk Roundtable with Attorney Rob Muise from American Freedom Law Center

E

Rob is the co-founder and Senior counselor at the American Freedom Law Center. They are in their 10th year anniversary right now, but they've been doing nonprofit civil rights litigation for well over 20 years. The American Freedom Law Center is a national nonprofit public interest law firm. They take cases that are in the public interest, typically cases involving the First Amendment, the right to free speech, the right to religious exercise. All of their work is pro-Bono for the good. They're a 501 C three organization. So all the legal work we do in the cases we do across the country, literally from Massachusetts to Hawaii. They do cases all over the country defending religious Liberty and the freedom of speech. By winning our civil rights cases, we get Attorney's fees and we also rely on donations for the work we do. But again, it's in the public interest. The courts have said time and again that upholding the constitutional rights of a party is always in the public interest right because when you defend the constitutional rights of one plaintiff, you're also defending the constitutional rights of all.He was an officer in the Marine Corps for 13 years before this second career as a lawyer. He typically describes himself not as a lawyer, but as a Marine with a law degree. And so that's kind of his approach to the litigation. They describe it also as Lawfare, because so much of what has affected our culture negatively, in their view, has occurred through the courts and not through the Democratic process. He went to law school, left his active duty infantry officer career because, in his view, there were more domestic enemies of the Constitution who are affecting our liberties and our freedoms here in the United States in the courtrooms. And so he hung up his pack and his rifle and got his law degree. He likes to think he's just continuing that same battle that same fight but doing so in the courtrooms.Recorded at Channel 511.Stephen E. Ep 238Joe Rogan Experience and Censorship

E

This is a hectic time in the podcasting world with a number of podcasters and artists taking a stance against Spotify's content policy around Joe Rogan episodes propagating vaccine misinformation.Musician Neil Young told Spotify that it can "have [Joe] Rogan or Young. Not both," reports Rolling Stone. This demand was made primarily due to the "steady stream of misinformation" on the COVID-19 vaccine that happens on Rogan's show. This action was backed by the World Health Organization (WHO).Spotify responded by pulling Young's music from the platform.Joni Mitchell declared that she stands with Young on this stance and decided to remove her music from Spotify. Guitarist Nils Lofgren followed suit "in solidarity with Neil Young." We talk about the ramifications of "content management" that is being proposed by various groups. Apparently, it's "screw the 1st Amendment time" with old rockers (who used to fight for their right of free speech).Plus much more.
