EOVI is probably the most complex area of law.And here's what I mean by that. • If you get an OVI, it immediately implicates Fourth Amendment issues. In other words, there was a stop, a seizure, and an arrest most often. • • And all those things must be justified under the Fourth Amendment. And there's an entire body of law in the Fourth Amendment that's developed around drinking and driving traffic stops and arrests. And then here in Ohio, we have field sobriety testing. EGeofence warrants are the new tool that local law enforcement uses to soak up data for further criminal investigations. Geofence warrants allow police agencies to gather data on every person in a specified area for a certain period of time. Traditional warrants, by contrast, are narrowly tailored to gather information on a specified person.And in that geofence area, they can suck up data from any member of the public and track such things as who's going to a known drug house. This could cause such mislabeling problems as what if you're going to a friend's house that happens to live next to a drug house. The question is that this is going to possibly be one of the upcoming constitutional arguments coming down the pipeline. EOn Tuesday, May 31, 2022, Buckeye Firearms Association presented testimony in the Senate Veterans and Public Safety Committee supporting HB 99 to expressly exempt persons authorized to go armed within a school safety zone from a requirement to complete extensive peace officer basic training and return authority over security to local school boards.The bill was amended to include annual criminal background checks for those carrying firearms in schools and also amended to incorporate Senate Bill 168, which creates a mobile training program. Members voted on party lines to pass the bill out of committee 4-2.This was the second hearing for this legislation, sponsored by State Representative Thomas Hall (R-Madison Twp.). EWhat is the new ghost gun law from the Biden Administration?To help reduce the number of unmarked and hard-to-trace “ghost guns,” the rule establishes requirements for federally licensed firearms dealers and gunsmiths to have a serial number added to 3D printed guns or other un-serialized firearms they take into inventory.What are ghost guns made out of?Ghost guns, however, are made of parts and are then assembled together. The critical component in building an untraceable gun is what is known as the lower receiver. Some are sold in do-it-yourself kits and the receivers are typically made from metal or polymer.The kicker? Ghost guns are more expensive than buying a gun through normal channels. ERob is the co-founder and Senior counselor at the American Freedom Law Center. They are in their 10th year anniversary right now, but they've been doing nonprofit civil rights litigation for well over 20 years. The American Freedom Law Center is a national nonprofit public interest law firm. They take cases that are in the public interest, typically cases involving the First Amendment, the right to free speech, the right to religious exercise.All of their work is pro-Bono for the good. They're a 501 C three organization. So all the legal work we do in the cases we do across the country, literally from Massachusetts to Hawaii. They do cases all over the country defending religious Liberty and the freedom of speech. By winning our civil rights cases, we get Attorney's fees and we also rely on donations for the work we do. But again, it's in the public interest. The courts have said time and again that upholding the constitutional rights of a party is always in the public interest right because when you defend the constitutional rights of one plaintiff, you're also defending the constitutional rights of all.He was an officer in the Marine Corps for 13 years before this second career as a lawyer. He typically describes himself not as a lawyer, but as a Marine with a law degree. And so that's kind of his approach to the litigation. They describe it also as Lawfare, because so much of what has affected our culture negatively, in their view, has occurred through the courts and not through the Democratic process. He went to law school, left his active duty infantry officer career because, in his view, there were more domestic enemies of the Constitution who are affecting our liberties and our freedoms here in the United States in the courtrooms. And so he hung up his pack and his rifle and got his law degree.
