Will SCOTUS Clarify Which Waters Are Regulated Under the Clean Water Act?

One of the most controversial and long-standing environmental issues deals with which waters are regulated under the Clean Water Act. For decades, the EPA and Army Corps of Engineers have tried major federal power grabs by defining “waters of the United States” (WOTUS) in a vague and overbroad manner, seeking to regulate almost every water imaginable, and arguably regulating what most people would consider to be land. These power grabs have led to wide opposition from farmers and homebuilders to local governments. There is also significant confusion for property owners as to what is even regulated. The U.S. Supreme Court’s first case of the new term, Sackett v. EPA, may provide clear and workable answers that are consistent with the Clean Water Act and the proper role of the federal government. Damien Schiff, lead counsel for the Sacketts, joins Heritage’s Daren Bakst in the leadup to oral arguments to discuss why this case is not only a critical environmental law case but also a critical case about private property rights and federalism. Government Efforts to Dictate What You Drive: What You Need to Know

For decades, many conservatives have warned that environmental extremists are trying to use the government to dictate, among other things, how you live, where you live, what you eat, and what you drive. Recent developments have certainly shown they want to dictate what you want to drive. From the so-called Inflation Reduction Act and its push for electric vehicles, California’s efforts to ban new gas-fueled cars, to the extreme federal fuel efficiency standards, the far left wants Americans to stop driving gas-powered cars, with little to no regard for the harm such policies will impose upon Americans.  In this latest edition of the Center for Energy, Climate, and Environment’s PowerCast, leading experts discuss these recent developments, the harmful impact of these efforts, and the elitism and arrogance of some who think they know better than Americans themselves as to what they should drive. The Beginning of the End of ESG

Elected officials, shareholders, and the American people are uniting against the undemocratic “Environmental, Social and Governance” (ESG) investment framework the elite left has weaponized against them. Federal legislation has been introduced that would require investment advisers to prioritize financial returns over non-pecuniary interests. State treasurers are challenging the financial institutions that discriminate against vital industries in their states. Customers are pushing back on "Woke Corporations." Shareholders are engaging CEOs directly to ask why investment firms are pouring billions of American pension dollars into China’s economy and propping up communist leaders. The Administrative State, U.S. Constitution, and the Supreme Court

The legitimacy of lawmaking by unelected regulatory officials is a controversial subject in any democratic republic, including ours. That is particularly true given that agency rules govern virtually every aspect of American life. Historically, the U.S. Supreme Court was willing to defer to agencies on the ground that regulatory officials were experts in their respective fields. Over the last decade, however, the Supreme Court has reined in agency lawmaking. In particular, the Court has questioned whether federal courts may defer to their interpretations of the law. Columbia Law School Professor Tom Merrill, an expert on administrative law, will discuss this trend and a book that he recently published on this subject. Tearing Us Apart: How Abortion Harms Everything and Solves Nothing

Violence begets violence. And so, the intimate violence of abortion, which severs the most natural bond in the world between a mother and a child, would of course create a more brutal society where innocent human life is dismissed as a choice. At this moment in American history where Roe v. Wade may be coming to an end, the struggle to end the civil rights issue of our day—abortion—is far from over. The culture of death has lied to Americans—most especially and cruelly women—and, as Ryan T. Anderson and Alexandra DeSanctis put it in their new book, Tearing Us Apart, abortion is a poison in our country’s bloodstream that hurts, not helps. Title IX in the Crosshairs: The 50th Anniversary of Women’s Equality in Education

Title IX of the Education Amendments of 1972 fundamentally reshaped the country, prohibiting discrimination based on sex in any educational program or activity that receives federal funding. Once considered a feminist triumph, Title IX leveled the educational field for women, allowing them educational, athletic, and career opportunities never before possible. Best known for its applications to sports and sexual harassment, the law covers a wide range of American education at both the K-12 and secondary level. But on the 50th anniversary of Title IX, the Biden administration is poised to eviscerate long-standing protections for women and girls by expanding “sex” to include sexual orientation and gender identity. Schools would be forced to open housing, locker rooms, sports teams, admissions, and other sex-specific offerings to the opposite sex. And this is just one of the changes the Biden administration has proposed with its new rule.Join us as a panel of experts and advocates discusses how the gains of the women’s movement and women’s equality and opportunity are teetering on the brink of erasure, and hear strategies for fighting back. A Conversation on Readiness with the Secretary of the Air Force

Since taking the helm of the Department of the Air Force last year, Secretary Frank Kendall has set the Air Force on a course to prepare for a conflict with a peer adversary by focusing on seven operational imperatives. Among the seven is the direction to increase the readiness of the department to transition to a wartime posture against a peer competitor. There are reasons to be concerned about Air Force readiness. The combat air force is half the size it was in 1991. Readiness rates, as reflected by flying hours, have decreased to all-time lows with fighter pilots who received more than 200 hours of flying time to prepare for a war with the Soviet Union now receiving less than 120 a year. Aircraft fleet readiness numbers are low. And the Operational Readiness Inspection teams that once evaluated a unit’s ability to rapidly mobilize, generate, and successfully execute combat sorties no longer exist.Join us for a conversation on the key indicators for capacity, capability, and readiness and to hear Secretary Kendall’s ideas and insights on this key topic. Cuba and Venezuela Policy in Biden’s America Last Agenda

The Biden administration has announced the most significant opening to the communist Cuban regime since Obama-era rapprochement and important sanctions relief to the narco-terrorist Maduro regime in Venezuela. These measures will directly enrich these anti-American dictatorships at the expense of their people and of U.S. national security interests.Worse yet, the Biden administration is kowtowing to the Cuba dictatorship’s repeated tactic of weaponizing illegal immigration against the U.S., with the arrival of nearly 80,000 Cubans at the southern border since November and up to 150,000 expected by this year, while continuing to ignore the border crisis. The administration is allowing U.S. companies to engage with Maduro’s collapsed oil sector, while hypocritically refusing to secure American energy independence. Meanwhile, a hostage crisis endures in Venezuela with at least eight Americans held captive by Maduro. The Biden administration should be raising the cost of attacking American sovereignty and American lives, not lowering it. Putin’s War and the Threat from Communist China: An Address by Senator Marco Rubio

We are living in the most dangerous moment since the Cuban Missile Crisis thanks to Vladimir Putin’s unprovoked invasion of Ukraine. The risk of escalation and spillover are very real, and the implications are dire. While the world is rightly focused on the immediate crisis, we cannot afford to ignore the systematic threat posed by the Chinese Communist Party (CCP).  Join us for a timely address by Senator Marco Rubio, a leader on foreign policy and intelligence issues in the U.S. Senate, who will outline why he and many in Congress have become concerned that for nearly two decades, the CCP has slowly undermined America’s economic strength and cultural cohesion by stealing critical technology and productive capacity. They’ve done so by slowly infiltrating every segment of America, from government and business to academia and entertainment. Despite the growing awareness, America risks being distracted by domestic politics and economics. Without urgent action, Beijing will only strengthen its hand, destabilize the region, and further undermine U.S. interests. When a book about the 21st century is written, the relationship between China and the United States will be a defining chapter. We need a whole of society – not just government – effort to prevail.  Hosted on Acast. See acast.com/privacy for more information.
