Federal Judge Blocks Kennedys Plan to Restrict Gender-Affirming Care for Minors
A federal judge in Oregon has halted Health Secretary Robert F. Kennedy Juniors plan to limit gender-affirming care for minors. The ruling came after attorneys general from nineteen states and Washington, D.C., challenged the policy, arguing it exceeded authority and violated federal law.
U.S. District Judge Mustafa Kasubhai granted summary judgment against the December declaration from the Department of Health and Human Services, which would have barred providers offering such care to children from receiving payments through Medicaid, Medicare, and the Childrens Health Insurance Program.
New York Attorney General Letitia James welcomed the decision, emphasizing that these health services for transgender youth remain legal and the federal government cannot penalize providers. The judge also dismissed the departments attempt to dismiss the lawsuit. Officials have not yet commented on the outcome.
