Humber Landlords Association (HLA) is taking Hull City Council to court over changes they want to make for enforcement notices issued within the Hull City Council area.
Currently, Hull City Council hasn’t been able to enforce changes with this new policy as the HLA is challenging it.

The tenant complains to the council; environmental health will visit to assess before issuing an improvement notice to the landlord. Currently, you usually get 14 days to comply and then environmental health visit again to check that the work has been completed.
- The proposed procedure is;
Environmental Healthy will charge the landlord £250 and will issue a formal enforcement notice to complete the works within 14 days. The council will then charge another £250 for Environmental Health to return and check that the work has been completed.

Why this new procedure may cause concern;
- As the property investor, you may not have even been aware of the problem as the tenant has gone straight to the council.
- Due to the fact that, with this proposal, there is the issuing of a formal notice, the property investor could also be breaking the covenant on your mortgage.
- From a landlord perspective being giving an informal notice is an opportunity to put it right.
- The proposed procedure isn’t fair on landlords as they could be in a situation where they don’t know what the problem is and have had no opportunity to correct it.
The challenge overall is two-fold and will be decided by judicial review. We will be back in the near future with the result of the court hearings. Watch this space...
