The new threshold, included in an amendment to the Customs Act, is a "reasonable general concern". What's the legal definition of that? Here's the thing: There isn't one. In an attempt to create a higher barrier to opening Canadians' devices on entry, the Alberta Court of Appeals struck down the previous threshold, but left it to the government to create a new one.
