PA Trench News - Damon Stern Part 2
In the first reporting of this video I mentioned lawyers.... you know those scary people who come after you. That's a joke. To explain where the lawyers come from, I have to explain some general information about the legal system. There are two types of ways you can be held responsible in the court of law. Criminally and Civilly. The goal of the criminal justice system is to identify a crime, and hold a person or persons responsible for that crime. This is just a general over view. The goal of the civil court system is to right a wrong. Often in the form of monetary compensation. Lets jump back about 20 years to 1995 and briefly talk about OJ Simpson. OJ Simpson was charged with the murders of Nicole Brown and Ronald Goldman in criminal court. OJ and his fleet of lawyers took these charges to trial to have a jury decided if OJ had committed these murders or not. The jury acquitted him of murder, meaning they found that there was reasonable doubt that OJ Simpson murdered Nicole Brown and Ron Goldman. This trial is where the famous line comes from "If the glove dont fit, you must acquit." In 1997 OJ Simpson was back in court facing civil charges for the wrongful death of Nicole Brown and Ron Goldman. In a civil case, the jury must decide if it was more likely than not that OJ Simpson was involved thereby deeming him liable. If a jury finds you liable in a civil court case, then they impose a penalty for your actions. In OJs case, the penalty was $33.5 million dollars. Okay we've made it through this lesson, back to the Stern Family. The commonwealth of PA investigated the police officer and announced on April 18th 2024 that the officers would not be charged for the death of Damon Stern - This is the criminal part. For the civil part, the family has retained lawyers Kevin O'Brien and Shaka Johnson from Stampone, O'Brien, Dilsheimer Holloway Injury Lawyers to represent them in a civil action against the City of Reading and the police. Meaning..... that they believe that it is more likely than not that the City of Reading and the police department are liable for the death of Damon Stern and that they will be seeking monetary damages. Money is never going to bring back Damon Stern and that is the sad fact of all of this. Just like when someone goes to jail, it doesn't magically erase the crime. However, money is a way to remind individuals or institutions that egregious actions have consequences. The process of filing a lawsuit allows everyone, including the public to see how institutions are run and to highlight errors in those practices. Money will not make this family whole again, but it may provide just a little bit of comfort for them and generations to come. Paying out money is often a great motivator to individuals and institutions to make policy changes so this doesn't happen again. The shooting death of Damon Stern was investigated by the Berks County District Attorney's office. On April 18th 2024, Berks County DA John T Adams called a press conference to announce that he will not be charging the police officers. I looked for the official press announcement on Berks County DAs website, but was unable to find it. Here is an article regarding the announcement. My first impression of this statement is "inaccurate at best." But when you dig down to the nitty gritty of criminal law, you may find a portion of it has to do with the mindset of the person causing the action and I believe that is where the law is on the side of the office. We can watch the body cam footage and see this incident from a perspective but we cant put ourselves in the perspective of the office, on this night, with the exact information he had.

Welcome to PA Trench News, your independent news report of Southern PA. We pick up where legacy media leaves off, making sure to follow the stories the whole way through. In LancasterOn Friday Sept 20th, Karina Solenzal-Rodriguez who is 16 and her 3 month old son were reported missing from their Lancaster home. As of 09/22/24 I have not been able to find an update stating that the teen and infant has been found or returned home. While searching for an update, I found a post from November 20th 2023 where Lancaster City posted the SAME TEEN missing since August of 2023. Apparently this is not the first time that she has absconded from Lancaster. In the 2023 post, the family stated to police that she might have been suspected to be in Alabama. It appears that during her 2023 departure, she had been missing since August 15th 2023 and the Lancaster police post was in November of 2023. What happened in the 3 months between the teen being missing and the Lancaster police being notified is a mystery.... If you have any information, please contact the Lancaster City police at717-735-3300. My favorite Facebook comment regarding this matter as "Why no Amber alert?" That is indeed an interesting question however we would need clarification on rather the Amber Alert was for the missing 16 year old or for her infant son and that is a whole other podcast in itself. In Schuylkill County The Skook news also posted an article about a missing teen on 09/20/24, Jeimily Juarbe who is 17 years old. She has been missing since 09/04/24. Police believe that she may be in Reading, with a boyfriend named Damani and may be in danger. Anyone with any information should contact Pottsville Police at 570-622-1234. And finally, incase you didn't notice, yesterday on 422 there was a group of riders on ATVs, 4 Wheelers, motorcycles and other misc sports bikes overtaking the roads. People are reporting that the gang was blocking traffic, overtaking intersections, running read lights and pulling out in front of people. There was also a video that surfaced late in the evening where the members were drinking at Turkey Hill in Womelsdorf PA and doing burnouts under the gas pumps. As most of us know, rural towns often do not have a 24 hour police presence which means that PA state police is responsible for patrolling those areas. As far as I can tell, it seems that the ballsy Boot-leg Bandidos were able to rule the roads for the majority of the day. Local commentors on facebook stated that the Boot-leg Bandidos were driving on sidewalks and overtaking establishments. Reading City Council has been working on amending ordinances to address some of the issues of the illegal ATVs/ dirtbikes exc. They are working towards coming to something that resembles an agreement to impose fines and require gas stations to shut off pumps when the gangs arrive. Legislation was signed in 2022 that bans people from driving ATVs and dirtbikes on public roadways, sidewalks and pedacycle lanes. It also allows police to confiscate and destroy these vehicles. If you didn't know, the rules are very strict governing ATVs/dirtbikes exc. In vague detail, off road vehicles can not be ridden on streets. They must be registered, insured and plated by DCNR at some riding establishments. If you've ever been to FRO or AOAA, there are also waivers that are required to be signed before riding at their establishments. Specific helmets are required and there are many age restrictions. I personally saw a couple on a moped riding on the side of the road, trying to catch up with the group with their small child in between them. I hate to state the obvious but this is NOT SAFE.

Welcome to PA Trench News, your independent news report of Southern PA. We pick up where legacy media leaves off, making sure to follow the stories the whole way through. In LebanonOn September 13th 2024, a fire broke on Brandywine St. The house was occupied by a grandmother and her 4 grandchildren at the time. Unfortunately the youngest child passed away. The community has been working hard to help the family during this difficult time. Despite their best intentions, Facebook has been flying off the handle regarding fake GoFundMe accounts, an absent mother and the grandma. I noticed that several hours after the fire broke out, a gofundme popped up for the family and then another, meaning there was more than one. Please make sure you are verifying online fundraisers before contributing to them. If you feel that you have donated to the wrong fundraiser, please file a dispute with GoFundMe and they will investigate it for you.Regarding mother - According to the interwebs, she has an active court case pending. In May of 2023, she was charged with altered, forged, or counterfeit documents and false reports to law enforcement officers for counterfeit inspection and emissions stickers being displayed. Please remember that all charges are alleged and that she is presumed innocent until proven guilty in a court of law. In RobesoniaOn August 29th 2024, Brian Strubhar, from Schuylkill County, was killed after a driver collided with his vehicle causing it to burst into flames. At the time, all reports stated that the crash was under investigation by the South Heidelberg PD and the State police. It has been almost a month and we have not heard a word about the other driver except that their condition was stable. Surely, one of the police departments will be announcing some information soon since somehow someone was driving so fast that they demolished a vehicle and sent it up into flames. We are all waiting patiently for the investigation to conclude and more information to be released....... right??? Facebook went into a tangent about what HIPAA is and isn't. People who saw the crash described it as absolutely horrifying. My personal favorite comment being from a top contributor stating " 422 has been unable to handle all of this traffic but yet we continue to build housing developments." In Ontelaunee TownshipOn September th 2024, Luis Meza-Saavedra was charged with theft by receiving stolen property after pirating packages off of porches several days earlier. He is being held on 50,0000 bail for the packages and 15,000 bail for other charges. His preliminary hearing is scheduled for 9/24. More to come. In Reading, On August 22nd a condemned building collapsed that was thought to possibly have kids inside. Luckily, no kids were harmed just the egos of the city council who had reports of the deteriorations of the building. A report that we will be keeping an eye on at the time of this podcast publication will be the Muhlenburg vs. Governor Mifflin football game being postponed over threats of pew-pew violence. Just a reminder to all of the parents out there that you can and will be held responsible for YOUR children misusing YOUR firearms.
