Florida Lawmakers Approve Bill to Give Homeowners Power to Dissolve HOAs
Florida lawmakers have unanimously approved a bill that allows homeowners to vote to dissolve their homeowners associations (HOAs). The bill, sponsored by Representative Juan Porras from Miami, aims to give homeowners more power and address complaints about HOA overreach.
The bill, House Bill six fifty-seven, creates a special Community Association Court in circuit courts to speed up dispute resolutions. It also drops some pre-suit mediation rules and requires associations to update their governing documents with clear language about state laws.
To end an HOA, a petition signed by at least half the voting members must be started. The board then calls a meeting within sixty days, needing two-thirds support to pass. Boards face fines up to five thousand dollars for hiding records or blocking the process.
The bill has cleared its final committee and is now heading to the full House on Thursday. If it passes there and the Senate, and gets the governors signature, the changes will kick in July first.
