Episode 225 - What happens IF the 1031 Exchange goes away after the ELECTION? Yikes!!
Suzanne Baker and Craig Brown are industry experts with 1031 exchanges. They are attorneys and leading authorities on the 1031 exchange. Under Section 1031 of the United States Internal Revenue Code, a taxpayer may defer the recognition of capital gains and related federal income tax liability on the exchange of certain types of property, a process known as a 1031 exchange…BUT what happens if a new American President decides to REPEAL this part of the code. What happens to investors that have used 1031 exchanges for the last 100 years to purchase and rehab real estate? Is it a loop hole that tax payers have used to defer capital gain taxes? Is it a preferential treatment for the "wealthy"? Arguments against the 1031 exchange tend to emphasize the continually worsening financial condition of the federal government, or they highlight the evolution of 1031 away from its alleged true purpose. Under Section 1031, taxpayers can defer capital gain taxes for as long as they hold their property. This can result in the deferral of very large tax liabilities.
