  Martin Luther King Jr once stated in an interview, “A riot is the language of the unheard.” This was in 1966 and nothing has changed since he uttered those prophetic words. That language is being heard and spoken in just about every major city in America and has reverberated to several international countries. Atlanta citizen quickly took to the street to protest not only the killing of George Floyd but the refusal to arrest the three officers who participated in this brutal murder, as well as only charging fired police officer Derek Chauvin with only 3rd-degree murder. Many watched the protest and demonstration play out on CNN and suddenly things got violent. Few know the root cause except those on the frontline. Necessary Blackness Ep: 105 – CPS Legal Kidnapping of Black Children: Is Your Child Next?

  In this episode of Necessary Blackness Podcast, we speak with Bekura Wallah Shabazz about Child Protective Services (CPS) illegal kidnapping of her granddaughter Sevyn and how they ignored the law, violate constitutional rights and fabricated evidence with a brazen arrogance totally without fear of reprimand, reprisal or consequences for their illegal actions. We talked about how Black children are being taken away from their parents by CPS far more often than white children, reflecting a racial disparity in the system that harks back to the days when African children were kidnapped from their homeland and parents to be brought to America. We discussed the financial incentive to placed children in foster care and why transracial adoption is harmful to black children.   The foster care system is just a holding place for children until they are old enough to go to prison. One of the earlier founders of Child Welfare now known as the Foster Care system was Charles Loring Brace, a racist Neanderthal who stated: “the purpose was to prevent these dangerous classes from exploding into rage against the rue of capital”. In this episode of Necessary Blackness Podcast, we discuss the Justice Department announcement that it would not be pursuing federal charges against Daniel Pantaleo, the NYPD officer accused of fatally choking Eric Garner, who was approached by police for allegedly selling loose cigarettes. The decision was apparently made by Attorney General William Barr himself after the DOJ’s Civil Rights Division favored an indictment while a competing faction in the New York office felt otherwise. The announcement on Tuesday, five years after the incident, was nothing short of a disgrace. It’s a complete abdication of responsibility, and a slap in the face to any notion of justice, particularly for Black victims. We also talk about the imprisonment of A$AP Rocky in Sweden and why the majority of Black America is not coming to his rescue. Necessary Blackness Ep: 87 Juries Have A Right To Nullify

In this episode of Necessary Blackness Podcast, Rahiem Shabazz explains why jury nullification is necessary to level the playing field in the criminal justice system for Black America. Jury nullification generally occurs when members of a criminal trial jury believe that a defendant is guilty, but choose to acquit them anyway because the jurors also believe that the law itself is unjust,[1][2] that the prosecutor has misapplied the law in the defendant’s case,[3] or that the potential punishment for breaking the law is too harsh. Some juries have also refused to convict due to their own prejudices in favour of the defendant.[4] Nullification is not an official part of criminal procedure, but is the logical consequence of two rules governing the systems in which it exists: Jurors cannot be punished for reaching a “wrong” decision (such as acquitting a defendant despite their guilt being proven beyond a reasonable doubt).[5] A defendant who is acquitted cannot be tried again for the same alleged crime in front of another jury.[6] A jury verdict that is contrary to the letter of the law pertains only to the particular case before it. However, if a pattern of acquittals develops in response to repeated attempts to prosecute a particular offence, this can have the de facto effect of invalidating the law. Such a pattern may indicate public opposition to an unwanted legislative enactment. Likewise, a jury can convict a defendant even if no law was actually broken, although such a conviction may be overturned on appeal. Nullification can also occur in civil trials. The sentencing of Elijah Nichols is a tragedy and reeks with racist implication from Judge Joey Showwalter, who sentenced Dustin Lee Moore, who attended the same school, to 2 months for killing a student during a hazing. However, Elijah will have to serve a 45 year suspended sentence for defending himself against 3 white students at a frat party. Mr. Showwalter seems to always use his discretion coupled with leniency when the defendant is White but, impose the maximum amount of sentence to Black defendants. When a freshman was busted on campus for selling marijuana, ecstasy and cocaine, Mr. Showwalter used the mercy of the court despite the defendant being found with $25,000 in cash and a 9mm gun which was found during a search of his on-campus apartment. Judge Joey Showalter is known for holding fundraisers and speaking on behalf go local and state Republican candidate and is a staunch support of President Donald Trump. Many believe the sentencing of Elijah to 45 years is symbolic to Trump being the 45th President of the United States. There has been a long history of contention between Korean business and Black customers and employees. Most famous was Latasha Harlins, Latasha Harlins, a 15-year-old who was fatally shot by 51-year-old Korean store owner Soon Ja Du in 1991. After a scuffle over orange juice, Du killed Harlins as she was walking away. She served no jail time. In 2018., nothing has changed my timeline and inbox is filled with incidents from all over the country. The recent assault on an elderly lady in Brooklyn, N.Y. illustrates that the Korean community does not respect black people or their spending power. A few days later, in Tulsa, Oklahoma a disurbing video was released showing an Asian beauty store owner physically assaulting a Black woman because presumably her child, walked out of the store with a keychain. The woman allegedly caught the child with the keychain and returned it. However, the man “followed her out of the store harassing her and telling her that she needed to keep a better eye on her kids.” After an exchanged of words the man punched her in the mouth leaving her bloody and crying in disbelief. In order to put out fires you got to deal with the people who own the water….You need money to get power and you need the power to protect the money.
