A federal judge in Pennsylvania has denied a river conservation groups request for an emergency shutdown of a York County scrap yard, J&K Salvage, due to pollution accusations. The judge cited the state Department of Environmental Protections recent order, which directs J&K to stop accepting new waste, process existing waste, and begin removal efforts. The DEP order also demands weekly receipts for waste and a plan to control pollutants in stormwater runoff. The riverkeepers had sought a court order halting all operations until J&K gets a new discharge permit, but the judge noted the DEP action already delivers the protection they sought. J&K had argued that regulators like the DEP should handle enforcement, not private groups, and claimed their yard supports environmental safety. If J&K doesnt follow the DEP order or if its pulled back, the riverkeepers can refile for an injunction.
