There's been a lot of talk about judicial review lately. That the Supreme Court decides whether a law violates the Constitution is now largely unquestioned. But it wasn't always this way. This episode we go back and revisit the contentious election of 1800 and Marbury v. Madison, the decision that set the precedent for judicial review.
