It is the responsibility of the plaintiff to establish a witness and the responsibility of the defendant is the oath.
*🌴درسِ حدیث🌴*
عَنْ ابْنِ عَبَّاسٍ، رَضِيَ اللَّهُ عَنْهما قَالَ
قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ
لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمْ، لَادَّعَى
نَاسٌ دِمَاءَ رِجَالٍ وَأَمْوَالَهُمْ،
وَلَكِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ
*نبی کریمﷺ کا فرمان*
اگر لوگوں کو ان کے دعووں کے
مطابق دے دیا جائے تو بہت سے
لوگ دوسروں کے خون اور ان کے
اموال پر دعویٰ کرنے لگیں گے
لیکن قسم مدعا علیہ پر ہے ۔‘‘

مدعی کے ذمہ گواہ قائم کرنا ہے
اور مدعیٰ علیہ کے ذمہ قسم ہے
