Plymouth Superior Court Judge William F. Sullivan has denied Lindsay Clancys request to split her murder trial into two phases. Clancy, a 35-year-old woman, is accused of killing her three children, aged five, three, and eight months, in January 2023. The trial is set to begin on July 20th, and will determine both her guilt and mental responsibility. Clancys defense team had argued for a separate phase to determine if she was mentally responsible, citing her severe postpartum depression and use of thirteen prescription medications. However, Judge Sullivan ruled that the issues overlap too much and that a single trial would avoid confusion and disputes over evidence. Prosecutors argued that Clancys defense choice already waives self-incrimination concerns. Clancy is currently paralyzed from the waist down and being held at Tewksbury Hospital for treatment. If acquitted on mental grounds, she would be sent to a state psych facility with regular reviews.
